Police have charged a suspect in the fatal stabbing of Clay Beathard, the starting quarterback on the Long Island University football team, brother of an NFL player and grandson of a former NFL general manager.

Beathard, 22, and 21-year-old Paul Trapeni III were stabbed Saturday, Dec. 21 at 2:50 a.m. in Nashville, Tennessee during a fight involving several persons outside the Dogwood Bar & Grill at 1907 Division Street, in midtown, according to Metro Nashville Police.

The stabbings appear to have resulted from an argument over a woman that began inside the bar and then turned physical when the parties went outside, police said. The dispute began over an unwanted advancement made by a man toward the woman in the bar, police added.

Multiple persons were involved in the outdoor fight during which the two men were both fatally stabbed in their sides.

Beathard, of Thompson Station, Tennessee, and Trapeni, of Franklin, Tennessee, were both transported to Vanderbilt University Medical Center where they died.

A third stabbing victim, Alvin Jefferson (A.J.) Bethurum, 21, suffered injuries to his eye and arm and is continuing to recover, said police.

Police now say 23-year-old Michael Mosley has been charged with two counts of criminal homicide and one count of attempted criminal homicide.

Mosley has a long rap sheet that includes multiple aggravated burglary, attempted aggravated burglary and drug-related arrests and convictions dating back five years.

Mosley has been identified as being present both inside and outside of the Dogwood Bar, including when the fight occurred, police said.

Beathard, a 6-foot-1, 190-pound junior, appeared in seven games before missing the remainder of the season due to injury this season.

He completed 52-percent of his pass attempts (94-for-182), throwing for 1,071 yards and four touchdowns.

Beathard was the son of country music songwriter Casey Beathard and Susan Beathard.

Clay Beathard’s brother, C.J., is a quarterback for the San Francisco 49ers. The 49ers picked up an emotional 34-31 win over the Los Angeles Rams on Saturday night after C.J. had returned home to Tennessee prior to the game to be with his family.

”The 49ers family was shocked and deeply saddened to learn of the tragedy involving C.J. Beathard’s younger brother, Clayton,” the 49ers said in a statement. “We extend our heartfelt sympathies to C.J. and the entire Beathard family as they cope with the unthinkable loss of a loved one.

Another brother, Tucker Beathard, is a country music singer/songwriter.

Grandfather, Bobby Beathard, is in the Pro Football Hall of Fame after winning four Super Bowls as an NFL general manager with four different teams: the Kansas City Chiefs, Miami Dolphins, Washington Redskins and San Diego Chargers.

“Clay was an amazing, big and soft-hearted human being with an undeniable love for the Lord,” the Beathard family said in a statement. “He had his family’s, friends’ and teammates’ backs even to a fault. I wish he would have been more inclined to take the high road but he hated ‘wrong.’

“That is what we will hold in our hearts because we know he is smiling now. He always worried about all of our welfare, never his own.”

Clay Beathard is also survived by sisters Channing and Tatum.

LIU football coach Bryan Collins said Clay Beathard had a “love of life, people, especially his teammates” and was a “shining light in our program.”

“All of my thoughts and prayers are with the Beathard Family,” Collins added. “Clay, you will be remembered always.”

SAN FRANCISCO—San Francisco 49ers linebacker Reuben Foster, 24, appeared in court on Thursday, April 12 to be charged for an alleged domestic violence incident that transpired in February. According to reports, Foster attacked his longtime girlfriend on February 11 at the Los Gatos home the couple shares. Foster reportedly dragged his girlfriend by her hair before physically throwing her out of the house and punching her several times.

As a result of the incident, Foster faces multiple felonies including charges of domestic violence with an allegation that he inflicted great bodily injury, forcefully attempting to prevent a victim from reporting a crime, and possession of an assault weapon. Foster posted the $75,000 bail immediately upon his arrest.

The weapons charge came after police found a Sig Sauer 515, as well as a large-capacity weapon magazine in the couple’s home. Both items are considered illegal in the state of California. If Foster is found guilty on all charges, he could face up to 11 years in prison.

CEO Jed York, GM John Lynch and head coach Kyle Shanahan indicated in a team statement on Sunday, April 15 that “Foster will not participate in team activities as he is tending to his legal matters. As previously stated, his future with the team will be determined by the information revealed during the legal process.”

Foster was drafted by the 49ers in the 2017 NFL draft. He was the 31st pick. A plea hearing has been set for April 30.

He also faces a related felony charge of forcefully attempting to prevent a victim from reporting a crime, as well as felony possession of an assault weapon and misdemeanor possession of a high-capacity magazine after a Sig Sauer 516 short-barreled rifle was confiscated from his home during the initial police response.

“Our focus is on holding accountable those who hurt their intimate partners,” Deputy District Attorney Kevin Smith said in a statement. “Our office handles between four and five thousand domestic violence cases each year. We only hope that this case illuminates the tragic regularity of the rest.”

“This is a process with today’s court appearance being the first step,” Bentley said in a statement. “Both Mr. Foster and myself have great respect for the court. We are most anxious to have all of the facts come out and that will happen in the courtroom, not the media.”

Outside of being released from the 49ers, any other discipline of Foster would have to come through the NFL office under its personal-conduct policy. After the charges were announced, NFL spokesman Brian McCarthy told this news organization, “We continue to monitor all developments in this matter which is under review of the personal conduct policy.”

The 49ers also issued a statement, and did not make any mention of intentions to cut Foster.

“The 49ers organization is aware of today’s disturbing charges regarding Reuben Foster,” the statement reads. “We will continue to follow this serious matter. Reuben is aware that his place in our organization is under great scrutiny and will depend on what is learned through the legal process.”

During last month’s NFL owners meeting in Florida, 49ers CEO Jed York couched his support of Foster.

“We’d love Reuben to be on this team, and we’d love him to participate for us,” York told NBC Sports Bay Area. “But if he’s not doing things off the field that allow us to be able to rely on him – or he’s doing something that we’re not comfortable with off the field and it’s proven that’s what’s going on — I think the guys have said then you’re just going to have to move on.”

Los Gatos-Monte Sereno police said officers were dispatched around 9:15 a.m. that day to a home on Shannon Road for a welfare check and to respond to a possible disturbance. Prosecutors added that the reported that the woman, who has been in a relationship with Foster for several years, flagged down a stranger’s car to get help calling 911.

Foster was eventually arrested without incident, and the rifle and magazine at the heart of the weapons charges were seized.

Sources familiar with the investigation told this news organization that the reported victim and Foster were arguing and that he threw her belongings onto a front walkway and balcony. At some point, she said he physically dragged her in an apparent attempt to remove her from the home. She also told police dispatchers during the 911 call that he owned multiple semiautomatic rifles, though only one was recovered.

The NFL has launched several public campaigns against domestic violence and fortified its personal-conduct policy after former Baltimore Ravens running back Ray Rice was suspended for two games for a 2014 assault on his then-fiancée, then was suspended indefinitely after security footage surfaced depicting the brutal attack.

That same year, Carolina Panthers defensive end Greg Hardy was convicted of assaulting his ex-girlfriend, and given a 10-game suspension from the NFL that was later reduced to four games by an arbitrator after Hardy appealed. He later played with the Dallas Cowboys.

In 2014, after the Rice case, the NFL granted Commissioner Roger Goodell authority to give players a baseline six-game suspension for domestic violence allegations, even without a conviction, with the discretion to decrease or lengthen based on the circumstances of a case. That was exercised with Cowboys running back Ezekiel Elliott this past season.

Last offseason, the 49ers drafted Foster with the 31st overall pick in the first round, with his stock having slid amid concerns about his surgically repaired shoulder and perhaps his off-the-field issues.

Foster’s rookie season covered multiple highs and lows. An ankle sprain in the season opener kept him out five games, and a rib injury kept him out another. Off the field, he and then-teammate Ray-Ray Armstrong reportedly avoided an armed robbery at a San Francisco nightclub in October. Foster’s dominant play on the field earned him NFL Defensive Rookie of the Month honors for November, and his 72 tackles, in just nine games, ranked second on the 49ers behind cornerback Dontae Johnson’s 76.

While the 49ers have led the league in player arrests over the past six years, Foster is only the second player arrested since coach Kyle Shanahan and general manager John Lynch assumed their roles last year.

Last April, the 49ers released Tramaine Brock hours after he was arrested for alleged domestic violence. Four months later, prosecutors declined to file charges, Brock avoided an NFL-imposed suspension, and he resumed his career with the Minnesota Vikings.

That prompt exit from the 49ers was similar to fullback Bruce Miller getting released hours after his September 2016 arrest for an alleged assault in San Francisco.

However, when Miller was charged in May 2015 with misdemeanor vandalism following a domestic incident, the 49ers took a wait-and-see approach and stated they would “monitor these legal proceedings closely.” Miller eventually pleaded no contest in August 2015 to a misdemeanor disturbing-the-peace charge and was ordered to attend domestic-violence counseling.

In an unrelated case, Foster was charged in Alabama for a second-degree marijuana possession charge in Tuscaloosa — home of his alma mater, the University of Alabama.

Since 2012, the 49ers’ front office has more experience dealing with players’ off-field legal issues than any other team in the NFL. During that time, the 49ers have seen an NFL-high 17 player arrests, including allegations of domestic violence that have been dealt with in a variety of ways.

More times than not, the team did not immediately cut ties with its players.

Thursday, following news that Santa Clara County prosecutors filed multiple charges against Reuben Foster, including one felony count of domestic violence, the 49ers issued a statement that did not make any mention of intentions to cut their star linebacker.

“The 49ers organization is aware of today’s disturbing charges regarding Reuben Foster,” the statement reads. “We will continue to follow this serious matter. Reuben is aware that his place in our organization is under great scrutiny and will depend on what is learned through the legal process.”

The majority of players arrested or criminally charged since 2012 were handled during former general manager Trent Baakle’s tenure. John Lynch was named the team’s GM in January, 2017.

Jed York has served as the team’s chief executive officer since 2010.

The charges against Foster, a first-round pick in 2017, stem from an alleged attack Feb. 11 that investigators say left his 28-year-old girlfriend with a ruptured eardrum, according to a news release from the Santa Clara County District Attorney’s Office.

During last month’s NFL owners meeting in Florida, York couched his support of Foster.

The 49ers did not offer the same support to defensive back Tramaine Brock, who was released last April just hours after his arrest in a domestic-violence incident that left his girlfriend with “visible injuries.” Santa Clara County prosecutors declined to filed charges against Brock, who resumed his career with the Minnesota Vikings.

Brock was signed by the 49ers as an undrafted free-agent out of college.

Over the past few years, domestic-violence or sexual assault charges were filed against players who at the time were on the 49ers roster, including Bruce Miller, Ray McDonald and Ahmad Brooks.

McDonald played the majority of the 2014 season, including the team’s opening game in September, just one week after his arrest on suspicion of domestic violence. That November, Santa Clara County prosecutors opted not to file domestic-violence charges against McDonald, citing insufficient evidence and that it appeared the fiancee initiated the physical contact that led to his arrest.

But McDonald was cut by the 49ers in December, 2014, citing ” a pattern of poor decision-making” following a string of off-field incidents. At the time of his release, McDonald was being investigated by San Jose police on a sexual-assault allegation. Prosecutors later filed a rape charge against McDonald, only to drop the charge in April, 2017 when the alleged victim refused to testify.

In August, 2015, Santa Clara County prosecutors filed a misdemeanor sexual battery charge against 49ers linebacker Ahmad Brooks over an incident with an intoxicated woman at a December house party held at McDonald’s house. Brooks played in 14 games that season, and in 16 games in the 2016 season before being released in August, 2017.

In January, Brooks agreed to a plea deal with prosecutors, and sexual battery charges were reduced to simple battery after a defense lawyer claimed that a Santa Clara County prosecutor had made false statements about the case in a sworn declaration. The defense did acknowledge in a court document that Brooks “touched (the victim) intimately over her pants.”

When Miller was charged in May 2015 with misdemeanor vandalism following a domestic incident, the 49ers took a wait-and-see approach and stated they would “monitor these legal proceedings closely.” Miller eventually pleaded no contest in August 2015 to a misdemeanor disturbing-the-peace charge and was ordered to attend domestic-violence counseling. He remained with the team until September, 2016, when he was released by the 49ers hours after his arrest on suspicion of beating a 70-year-old man with a cane in a drunken assault at a Fisherman’s Wharf hotel.

The former 49er who endured the most legal trouble while with the team was Aldon Smith, who was drafted in the first round (No. 7 overall) in 2011 and was arrested five times during his tenure with the team. In 2013, Smith was allowed to practice with the team just hours after his arrest on suspicion of DUI in San Jose.

LOS GATOS — The domestic-violence arrest of San Francisco 49ers linebacker Reuben Foster stemmed from his girlfriend’s accusation that he physically dragged her during an argument at a Los Gatos home Sunday morning, according to sources familiar with the investigation.

The reported victim, who has been in a relationship with Foster for several years, also told police dispatchers during a 911 call that he owned multiple semiautomatic rifles, according to an archived recording. Officers ended up recovering one firearm, a SIG Sauer 516 short-barreled rifle, sources said.

The encounter left the woman injured, sources said, but the extent of her injuries was not disclosed.

Altogether, the allegations were the basis of Foster getting booked at the Santa Clara County Main Jail on suspicion of domestic violence, making criminal threats, and possessing an assault weapon. He was released Sunday evening after posting $75,000 bail.

Foster’s agent did not immediately return a message seeking comment to the accusations. Foster has not commented since the arrest, including on his frequently-used social-media channels.

On Monday, Foster visited the 49ers training facility in Santa Clara to meet with team officials, according to Ian Rapoport of the NFL Network. Sunday evening, the 49ers sent out a statement acknowledging Foster’s arrest and that it is “gathering all pertinent information” in the case. The NFL is also conducting an investigation of the case to determine any potential suspensions and penalties from the league.

In 2014, amid criticism of its handling of the infamous Ray Rice case, the NFL gave Commissioner Roger Goodell authority to give players a minimum six-game suspension for domestic violence allegations, even without a conviction. That was exercised with star Dallas Cowboys running back Ezekiel Elliott this past season.

Because Foster is free on bail, he will not likely be charged or arraigned within the typical 72-hour window for jailed suspects. On Monday, Los Gatos-Monte Sereno police forwarded their investigation to the Santa Clara County District Attorney’s Office for review.

Prosecutors will have up to 30 days to decide on whether to file charges against Foster. All three offenses for which he was arrested are known as “wobblers,” meaning that if they are charged, they can be filed as either misdemeanors or felonies based on the discretion of the District Attorney’s Office or a Superior Court judge.

The criminal threats allegation, if charged as a felony, would count as a strike under the state’s “Three Strikes” law.

“The severity of the crime, any injuries, and prior criminal history factor into whether a charge gets reduced to a misdemeanor,” said Steven Clark, a legal analyst and former Santa Clara County prosecutor.

Clark added that it’s also not a certainty that prosecutors will file charges based on the initial investigation.

“The DA may ask for more information, such as whether there is a previous history of domestic violence, or if alcohol and drugs were involved,” he said.

According to an archived police dispatch radio recording of the 911 call, “the RP (reporting party) advises there should be at least two AR-15 weapons in the house.”

Both that statement and the domestic-violence allegation would provide cause for police to search for and remove any firearms from the home. It was apparently during that search that officers found the allegedly illegal rifle.

The weapons allegation against Foster evoked memories of the 49ers’ experience with former star linebacker Aldon Smith, who was given probation after being convicted of possessing three illegal assault rifles after gunfire erupted at his home in the San Jose hills in 2012.

Like in that case, the weapons allegation could take some time for prosecutors to sort out. For starters, the legality of possessing the SIG Sauer 516 short-barreled rifle will likely be debated between them and Foster’s legal defense.

The 516 does not appear on the list of illegal AR-15 variants at the California Department of Justice website, perhaps because it’s a recent release — the list hasn’t been updated in more than a decade; the 516 has been produced since 2010. State law also includes generic characteristics that make a gun illegal, such as whether it has the capacity to accept a detachable ammunition magazine, and at least one of a list of military-style characteristics like “a pistol grip that protrudes conspicuously beneath the action of the weapon” and a flash suppressor.

“It can sometimes be difficult to determine when you’re in possession of an illegal weapon, and these characteristics are difficult to know,” Clark said. “You have to find out if it was properly stored, was there ammunition inside of it. Was it just sitting inside a closet or was it being used? How did he obtain it?”

SAN FRANCISCO (AP) — Authorities say San Francisco 49ers linebacker Reuben Foster has been arrested on suspicion of domestic violence and possessing an assault rifle.

Arrest records show Foster was booked at the Santa Clara County jail Sunday with bail set at $75,000.

The East Bay Times reports that a woman who has been in a long-term relationship with Foster told officers an assault occurred after an argument. Officers located the rifle while responding to the call.

The 49ers released a statement saying the organization is aware of the arrest and is collecting information.

In January, Foster was arrested and charged with second-degree marijuana possession in Alabama. He also was put in the league’s substance-abuse program for a diluted urine sample at least year’s combine.

According to the Santa Clara County Sheriff’s Department jail website, Foster was booked into the Santa Clara County Jail on charges relating to domestic violence. The 23-year-old was arrested in Los Gatos and was released on $75,000 bail.

Authorities said police responded at 9:15 a.m. to a home on Shannon Road to do a welfare check and check on a possible disturbance. Officers spoke with the victim and Foster and as a result of an investigation Foster was arrested and taken to jail.

The 49ers issued a statement saying: “The San Francisco 49ers organization is aware of the report regarding Reuben Foster. We take matters of this nature seriously and are gathering all pertinent information.”

Calls to the Los Gatos-Monte Sereno Police Department were not immediately returned Sunday.

Recordings of police dispatchers indicated that Foster was found to be in possession of at least two AR-16 assault rifles.

Foster was arrested in mid-January while being back in Tuscaloosa, Ala. where he starred for the University of Alabama Crimson Tide. He has been charged with second-degree marijuana possession.

Foster is coming off an outstanding rookie season despite suffering an ankle sprain that sidelined him for five games. He was named the NFL’s Defensive Rookie of the Month for November and finished the season ranked second on the team in tackles (72).

The team had hoped it had put its legal troubles behind them. Last spring, cornerback Tramaine Brock was arrested on domestic violence and immediately cut by the team.

Prosecutors later dropped the charges due insufficient evidence, but the team said it would have no tolerance for players even if they charged.

Foster could face a six-game suspension from the NFL if he is formally charged with domestic violence. A second charge could lead to a lifetime ban.

The latest arrest has continued a pattern for the 49ers. Despite changes in both the coaching staff and the front office, the team has had an ongoing problem with players getting into legal trouble.

17 49ers have been arrested since 2012, the most in the NFL for that period of time.

San Francisco 49ers linebacker Reuben Foster was arrested Sunday on charges of domestic violence and gun possession after an argument with his girlfriend got heated, according to reports.

Foster, a 23-year-old first-round pick in last year’s NFL draft, was arrested in Los Gatos in Santa Clara County, California, and is currently being held without bail, the San Francisco Chronicle reported.

County jail records show the NFL player’s bail has been set at $75,000.

Foster also was arrested on suspicion of possessing an assault rifle, according to The Mercury News.

The 49ers organization said it was “aware” of reports of Foster’s arrest, and added: “We take matters of this nature seriously and are gathering all pertinent information.”

Sources told The Mercury News that officers were called to Foster’s home in Los Gatos for a domestic disturbance. A woman in a long-term relationship with Foster reportedly told police the two got into an argument.

Police discovered what appeared to be an assault rifle as they responded to the disturbance, according to the newspaper.

Foster’s arrest would be his second within a month. On Jan. 18, he was arrested and charged with second-degree possession of marijuana.
