A Guatemalan immigrant accused of killing an NFL player and an Uber driver in a drunk driving crash in Indiana has been charged with four felony counts related to the crash.

Manuel Orrego-Savala, 37, was arrested early Sunday morning after driving his pick-up truck while drunk and killing NFL linebacker Edwin Jackson and ride-sharing operator Jeffrey Monroe.

Orrego-Savala gave an alias at the scene – Alex Cabrera Gonsales – before attempting to flee on foot.

Orrego-Savala was deported from the U.S. in 2007 and 2009 and was currently living in the U.S. illegally. He is scheduled for an initial hearing in Marion County Circuit Court on Wednesday.

In Tuesday’s federal criminal complaint, he was charged with illegal re-entry of a previously deported alien.

The judge set his bond at $200,000 after entering a not guilty plea on his behalf, and charged him with four felonies. Orrego-Savala was charged with two counts of each felony: leaving the scene of an accident and causing death while driving intoxicated.

Appearing before a judge on Tuesday, Orrego-Savala said: “I don’t know why I’m here,” claiming that he wasn’t the one driving the car in the crash despite police saying he had a blood alcohol content level that was three times the legal limit.

Orrego-Savala had a 2005 conviction for driving under the influence in Redwood City, California.

“I was very saddened to hear of the passing of Indianapolis [Colts] linebacker Edwin Jackson,” Vice President Mike Pence tweeted Monday night. “This is a great loss for the entire Indiana community. My prayers are with his family in their time of grief.”

President Donald Trump tweeted about Jackson’s death, giving his prayers and best wishes to the Jackson family. Trump also called for Democrats to be tougher on illegal immigration.

“So disgraceful that a person illegally in our country killed [Colts] linebacker Edwin Jackson. This is just one of many such preventable tragedies. We must get the Dems to get tough on the Border, and with illegal immigration, FAST,” Trump tweeted.

“My prayers and best wishes are with the family of Edwin Jackson, a wonderful young man whose life was so senselessly taken,” Trump tweeted.

Marion County Prosecutor Terry Curry criticized President Trump and others for politicizing the fatal crash.

“We will vigorously prosecute this matter, just like any comparable crime, not because of the immigration status of an accused, but because two innocent men lost their lives in this horrible incident,” Curry said.

“We are disheartened that ghoulish and inappropriate public commentary has politicized this tragedy. Much of such commentary, including tweets by the President, fails to acknowledge that both Edwin Jackson and Jeffrey Monroe lost their lives on Sunday,” he said. “We will simply seek justice on behalf of the families of those two victims.”

The illegal immigrant suspected of killing an Indianapolis Colts player and another man in a drunken roadside crash over the weekend has been charged with a felony immigration violation, federal prosecutors announced Tuesday.

Manuel Orrego-Savala, a 37-year-old Guatemalan national, was charged with illegal re-entry of a previously deported alien. He was deported in 2007 and 2009, according to Immigration and Customs Enforcement.

“The defendant in this case allegedly re-entered the country illegally for the second time before he put the public safety of Indianapolis at risk and took the lives of two innocent men early Sunday morning,” U.S. Attorney Josh J. Minkler said in a statement. “In April, Attorney General [Jeff] Sessions directed all federal prosecutors to prioritize charging aliens that illegally re-enter the country, especially if they are a risk to public safety or there is a criminal history present.”

Authorities arrested Orrego-Savala early Sunday morning shortly after he slammed into Colts linebacker Edwin Jackson and Uber driver Jeffrey Monroe as they were standing on the emergency shoulder of Interstate 70 in Indianapolis. He tried to flee the scene but was arrested by a responding officer on a nearby exit ramp, according to Indiana State Police.

Jackson, 26, and Monroe, 54, were standing near Monroe’s car when Orrego-Savala drove his Ford F-150 pickup onto the emergency shoulder and struck both men, police say. Investigators believe Monroe had pulled over and exited the car to assist Jackson, who had become ill.

Orrego-Savala’s blood alcohol level was 0.239 percent—nearly three times the legal limit in Indiana—reports the Indianapolis Star, citing a preliminary probable cause affidavit filed in Marion County Superior Court.

Immigration officers first arrested Orrego-Savala in San Francisco in 2006, an ICE spokeswoman confirmed Monday evening. After an immigration hearing, he was deported back to Guatemala in January 2007.

Just over two years later, ICE officers again arrested Orrego-Savala in San Francisco. He was deported to Guatemala a second time in May 2009.

Aside from his two prior deportations, Orrego-Savala was convicted in 2005 for driving under the influence in Redwood City, California, according to ICE. He has additional criminal convictions in California and Indiana.

Orrego-Savala will remain in custody while the local case is investigated by the Indiana State Police and the Marion County Prosecutor’s Office. He was formally charged Wednesday with two counts of failure to remain at the scene of an accident and two counts tied to drunken driving death, reports the Star.

The immigration charges will remain pending until the state case is concluded, federal prosecutors say. Orrego-Savala faces up to 10 years in prison if convicted of the federal charge.

The Department of Justice announced on Tuesday night that it filed felony immigration charges against the twice-deported criminal alien charged in the deaths of Indianapolis Colts Linebacker Edwin Jackson and his Uber driver, Jeffrey Monroe. The charge could land the illegal immigrant in federal prison for up to 20 years.

United States Attorney for the Southern District of Indiana Josh Minkler announced late Tuesday night that his office filed a criminal complaint against 37-year-old Manuel Orrego-Zavala for aggravated illegal re-entry of a previously deported felon, according to a statement provided by the Department of Justice to Breitbart Texas.

“The defendant in this case allegedly re-entered the country illegally for the second time before he put the public safety of Indianapolis at risk and took the lives of two innocent men early Sunday morning,” US Attorney Minkler said in the written statement. “In April, Attorney General Sessions directed all federal prosecutor to prioritize charging aliens that illegally re-enter the country, especially if they are a risk to public safety or there is a criminal history present. Following the rule of law is the foundation of our American democracy, and my office is committed to fulfilling the Attorney General’s directive.”

In a copy of the criminal complaint (attached below), the DOJ states that Indiana State Police arrested Orrego-Zavala following a fatal vehicle crash in Interstate 70 near Indianapolis. The suspect fled the scene of the crash and police located him a short time later. He initially provided false information about his identity, claiming to be a Mexican national named Alex G. Cabrera.

“Homeland Security agents soon learned—through cooperation and information sharing with the Indianapolis Metro Police Department—his true identity was Manuel Orrego-Zavala, a citizen of Guatemala,” the complaint states.

Immigration officers in San Francisco arrested Orrego-Zavala on October 27, 2006. The agents processed the Guatemalan national for removal and on January 17, 2007, Enforcement and Removal Operations (ERO) officers from ICE returned Orrego-Zavala to his home country. At that time, officials served him with notice that he could not enter, attempt to enter, or be present in the United States for a period of 10 years.

Despite that warning, ICE-ERO officers again arrested Orrego-Zavala in San Francisco on March 26, 2009. ERO officers transported the criminal alien to Phoenix where they transported him to Guatemala on May 12, 2009. At this time, ERO officers served him with a warning that he is prohibited from re-entering, attempting to re-enter or be physically present in the United States for a period of 20 years.

HSI agents obtained fingerprints on the suspected drunk driver following his February 4 arrest in Indianapolis. The agents determined the migrant’s true identity.

Orrega-Zavala is facing state charges of driving under the influence resulting in death. For each count, he could face up to six years in state prison.

The federal charges of aggravated re-entry after removal bring a possible sentence of up to 20 years in federal prison.
