King County prosecutors have charged an 18-year-old Seattle high school student with the rape of a classmate outside a house party in November.

Jackson Sullivan, who played for West Seattle High School’s baseball team, was arrested on investigation of second-degree rape charges late last month. He posted a $350,000 bail. He is scheduled for arraignment June 4. (Court documents show the timeline was delayed because of the coronavirus.)

Interviews with several witnesses and classmates, detailed in charging documents, allege Sullivan has what the police described as other “alarming” sexual assault accusations. The police investigation into Sullivan is still ongoing, and could result in more charges, the document stated; so far, according to the documents, three other young women have accused Sullivan of nonconsensual sexual contact.

The 16-year-old who reported she was assaulted in November now has court-ordered protection from Sullivan.

The Seattle Times could not reach Sullivan. His mother declined to comment on the allegations.

The initial investigation that led to his charges was lengthy. More than five months passed between when the assault was reported and his arrest on April 29.

The process of interviewing everyone and witnesses (for a rape case) can take awhile,” said SPD Detective Patrick Michaud, who was not aware of the case when called, but spoke in general terms last week.

The King County Prosecutor’s Office “did a careful review of the totality of evidence” in the police investigation and determined it was worth charging Sullivan, said Casey McNerthney, a spokesman for the office.

Police documents reveal details from that evening and other alleged assaults.

The 16-year-old girl was also a West Seattle High student. She said she’d been playing beer pong inside the November house party just before the assault, according to the documents. She’d had two drinks, she told police, but began to feel like she was blacking out after Sullivan handed her a third drink, which led her to suspect she might have been drugged.

She said her next memory is of the rape. After launching a “massive” search for her, friends found her in the van with the suspect, which was parked a short distance from the house, the documents said. They told police she was nonverbal, partially clothed and covered in her own vomit.

When they confronted Sullivan, the documents reported he said, “I thought she was good for it.” The documents stated a Washington State Patrol Crime Laboratory test determined Sullivan’s DNA was present on the teen’s underwear and vaginal swabs.

As officers investigated the November incident, they learned of other alleged incidents of assaults, according to the charging documents.

Two were from Halloween night 2017. One girl said Sullivan sat next to her, draped a blanket over her legs, and penetrated her with his fingers while others were present. Another young woman, who fell asleep next to Sullivan at a different party, said she awoke to him doing the same thing.

At a party following a school dance in March 2019, another girl, who said she was intoxicated at the time, said Sullivan made advances despite her protests, and penetrated her with his fingers while they were both in his car.

A spokesman for Seattle Public Schools declined to comment on whether Sullivan was still enrolled at the district.

Louisville received a notice of allegations from the NCAA on Monday, including one Level I allegation involving improper recruiting offers for former signee Brian Bowen II and the coach of another prospect and three Level II allegations, including one against former basketball coach Rick Pitino.

Louisville also is accused of failing to adequately monitor the recruitment of an incoming, high-profile student-athlete.

The NCAA alleges that Pitino, who recently was hired at Iona, did not satisfy his head coach responsibility when he failed to promote an atmosphere of compliance. Former assistant coaches Kenny Johnson and Jordan Fair are accused of providing impermissible benefits and transportation and having impermissible contact with a recruit.

Louisville is the seventh program to receive an NCAA Notice of Allegations stemming from the FBI investigation into college basketball. Kansas, NC State, Oklahoma State and South Carolina were all accused of Level I violations. USC and TCU did not publicly release their notices or the allegations they were facing.

Sources previously told ESPN that NCAA enforcement staff members also were investigating Arizona, Auburn, Creighton, LSU and possibly other programs.

Louisville officials and the former coaches have 90 days to respond to the NCAA. Athletic director Vince Tyra said during a teleconference with reporters Monday that the university could elect to adjudicate the case through the NCAA’s newly created Independent Accountability Resolution Process (IARP), which includes investigators and hearing officers with no direct ties to the NCAA or its member schools. The IARP is handling a similar case involving NC State. Its decisions are final, and there are no appeals.

In a joint statement from Louisville president Neeli Bendapudi and Tyra, the university said it is reviewing the notice of allegations and will begin formulating a response to the charges.

“It is important to remember that these are allegations — not facts — and the University will diligently prepare a full and comprehensive response and, absent an unforeseen development, submit it within the prescribed ninety-day period,” the Louisville statement said. “For those allegations that are proven to be factual, the University will take responsibility, as accountability is one of our core Cardinal Principles.

Jeff Borzello reports on the latest round of allegations Louisville is facing from the NCAA.

“However, we will not hesitate to push back where the evidence does not support the NCAA’s interpretations or allegations of charges. U of L has a right and a responsibility to stand up for itself when faced with unfair or unfounded charges and will always act in the best interests of the institution. Our legal team has begun the process of reviewing the Notice and will prepare a thorough response on behalf of the University.”

Iona said it is “aware of the report.”

“Prior to hiring Coach Pitino, we conducted extensive due diligence. We support Coach Pitino and expect him to respond within the process,” the school said in a statement.

Pitino also responded to the allegation against him.

“I firmly disagree with this allegation and will follow the protocols in addressing this allegation through the administrative process. Due to NCAA bylaws on public disclosure on enforcement issues, I will have no further comment on this matter until it is resolved.”

Much like in the NCAA compliance cases involving Kansas and NC State, the NCAA enforcement staff has alleged that Adidas and Adidas employees and associates were boosters and agents of Louisville during the period of the alleged violations and therefore acting on its behalf when they allegedly engaged in violations of NCAA bylaws.

In the notice of allegations, the NCAA enforcement staff alleges that Fair “was knowingly involved” in providing between $11,800 and $13,500 in impermissible benefits to Brad Augustine, an Orlando, Florida-based grassroots director, to influence a player to sign with the Cardinals. Former Louisville recruit Balsa Koprivica, now at Florida State, was a player in Augustine’s program at the time.

Johnson, now an assistant coach at La Salle, is accused of “knowingly” providing a $1,300 extra benefit to Bowen. The NCAA alleges that Pitino, whom Louisville fired in October 2017, “violated head coach responsibility legislation when he failed to promote an atmosphere of compliance within the men’s basketball program.”

“Specifically, the Adidas corporation (Adidas), a representative of the institution’s athletics interests, and its employee, James Gatto (Gatto), then director of global sports marketing for basketball, informed Pitino that he would assist in the recruitment of then men’s basketball student-athlete (Bowen),” the notice of allegations said. “Despite (Bowen’s) belated interest in the institution, Pitino’s knowledge of another institution’s alleged cash offer for (Bowen’s) commitment and Gatto possessing inside knowledge of the institution’s interest in and recruitment of (Bowen), Pitino failed to conduct an additional inquiry as to Gatto’s type or level of assistance, which included a $100,000 impermissible offer and $25,000 extra benefit.”

Under NCAA rules, Pitino can receive a show-cause order and be suspended for up to half a season for Level II violations. The length of the suspension is determined by the committee on infractions and depends on the “severity of the violation(s) committed, the level of the coach’s involvement and any other aggravating or mitigating factors.”

The NCAA enforcement staff noted in the notice of allegations that at the time Pitino allegedly failed to promote compliance in his program regarding Bowen’s recruitment, “he was awaiting a decision from the Committee on Infractions and subsequently subject to a show-cause order as a result of the decision, a Level I head coach responsibility infraction.”

Among the other aggravating factors cited by the enforcement staff in the notice of allegations are Louisville’s history of rules noncompliance (the Cardinals have been placed on NCAA probation three times since 1996); that the violations were premeditated, deliberate or committed after substantial planning; that one or more violations caused significant ineligibility to a student-athlete; and intentional, willful or blatant disregard for NCAA constitution and bylaws.

In September 2017, Louisville officials ruled Bowen ineligible after an FBI investigation uncovered that an Adidas employee and others conspired to pay his father $100,000 for him to sign with the Cardinals. After Bowen transferred to South Carolina, the NCAA ruled him ineligible for the 2018-19 season.

Bowen, 21, never played a game in college and wasn’t selected in the 2019 NBA draft. He signed a two-way contract with the Indiana Pacers in July 2019. He played in five games for the Pacers in the 2019-20 season.

Louisville’s recruitment of Bowen, a former five-star recruit from Saginaw, Michigan, was at the center of the federal government’s investigation into bribes and other corruption in the sport.

Gatto, former consultant Merl Code and aspiring business manager Christian Dawkins were convicted in October 2018 for their roles in pay-for-play schemes to steer recruits to Adidas-sponsored schools. The three men are appealing their convictions.

In the spring of 2017, Louisville was not involved in Bowen’s recruitment, and he had never been to campus. He favored Arizona, according to his father, Brian Bowen Sr., but they were worried about more experienced players being ahead of him.

“Louisville offered him a scholarship as a freshman, but they’d been off the radar,” Bowen Sr. testified during the federal criminal trial. “We hadn’t really talked to them.”

After Allonzo Trier and Rawle Alkins returned to Arizona for the 2017-18 season and Donovan Mitchell left Louisville for the NBA, Bowen Sr. said Dawkins approached him about the possibility of Bowen II playing for the Cardinals.

Federal prosecutor Ted Diskant showed the jury text messages between Bowen Sr. and Pitino on May 24, 2017, with Bowen Sr. asking Pitino to talk to his son.

The government also played a voicemail that Gatto left for Pitino on May 27, 2017.

“I just got a call about a player I want to discuss with you,” Gatto said.

On May 29, 2017, Bowen II, his mother, his father, a friend and Dawkins took an unofficial visit to Louisville. Bowen Sr. told the jury that Dawkins paid for the visit.

On June 1, 2017, Bowen II committed to Louisville and signed a financial aid agreement with the school. Shortly thereafter, Gatto left another voicemail for Pitino, according to the government.

“Coach, Gatto,” he said. “Hope all is well. Checking in. Heard the good news, um, and it’s going to be good, and I’m excited for you guys.”

After Adidas officials made an initial offer of $60,000 to $80,000, according to Dawkins, Bowen Sr. said the offer to attend Louisville went up to $100,000 because Dawkins alleged that Billy Preston, who had chosen to play at Kansas, received $100,000 from Adidas for his commitment. The money was to be paid in four installments of $25,000.

John Carns, Louisville’s senior associate athletic director for compliance, told the jury that he was unaware of the payments at the time.

In an interview with ESPN in 2017, Pitino reiterated that he had “no knowledge” of any payment to Bowen’s family, citing a lie detector test that he took in October of that year.

Pitino said of Bowen: “He fell into our lap in recruiting. Obviously, now with the circumstances behind it, there’s more to it than meets the eye. But I believe Brian Bowen chose the University of Louisville because he loved the visit, he loved his future teammates, and he wanted to play for me. I don’t think he’s involved in this in any way. Now, am I being naive? I don’t know. I just believe in that young man.”

The NCAA placed Louisville on probation for four years in June 2017, following a two-year investigation into allegations that a former Louisville staff member arranged for striptease dances and sex acts for players and recruits during parties at an on-campus dormitory from 2011 to 2015. The Cardinals were also forced to vacate their 2013 national championship and 2012 Final Four appearance, and they self-imposed a postseason ban for the 2015-16 season.

That scandal stemmed from allegations made by former escort Katina Powell, who wrote in a book, “Breaking Cardinal Rules: Basketball and the Escort Queen,” that former Louisville staffer Andre McGee paid her $10,000 for 22 shows at the Cardinals’ dormitory from 2010 to 2014.

Pitino denied knowledge of McGee’s actions, but the NCAA ruled that he violated NCAA head coach responsibility rules by failing to monitor McGee. Pitino received a five-game ACC suspension, and McGee was given a 10-year show cause.

“Since arriving at Louisville, I have seen up close the incredible changes that have taken place under the leadership of President Bendapudi and Director of Athletics Vince Tyra in our university and in our athletics department. The shared values and commitment to integrity is evident in their actions and has always been demanded in the programs that my staff and I have led,” current Louisville coach Chris Mack said in a statement.

“While I understand the allegations brought today, I am confident that the University will do what is right, which includes fighting back on those charges that we simply do not agree with, and for which the facts do not substantiate. The future is bright for Cardinal Basketball. Our focus will continue to be on our tremendous student-athletes.”

A Penn State football player accused in a federal lawsuit of sexually hazing a former teammate denied the “broad, bald” allegations lodged against him.

Junior defensive tackle Damion Barber joined coach James Franklin and the university in asking a federal judge to throw out the lawsuit filed by former Nittany Lion Isaiah Humphries.

Humphries alleged Barber was among a group of four players who orchestrated a campaign to haze underclassmen as a form of initiation into the team’s program.

The allegations include Humphries’ former teammates stealing clothes, simulating humping actions, grabbing the genitalia of others and placing their genitals on others while naked in the Lasch Building showers.

Barber “is not aware of, never witnessed any, and did not participate in” any initiation rituals to become or remain a member of the football team, his attorney Anthony De Boef wrote in his response filed Tuesday.

The allegations outlined in Humphries’ lawsuit were investigated by the university’s sexual misconduct and prevention office, which received an anonymous complaint six months after Humphries transferred to the California Golden Bears.

The complaint was not submitted by Humphries. It was submitted by someone else who reported the “harassment and victimization” of a second football player, Humphries’ attorney Steven Marino said in March.

Barber admitted he was charged with violating the harassment clause laid out in the university’s student conduct policy, but said his actions were not directed at Humphries.

The investigation found Barber did not haze anyone, De Boef wrote in his 20-page response.

Centre County District Attorney Bernie Cantorna’s office also investigated Humphries’ claims, but Cantorna said the evidence garnered from that investigation “did not meet the high threshold necessary to file criminal charges and prove them beyond a reasonable doubt.”

Franklin and the university in March asked for the lawsuit to be dismissed because the alleged hazing was carried out by the “least senior members” of the team and was not facilitated by either Franklin or the university.

The 10-count lawsuit is seeking unspecified monetary damages.

A former Penn State football player has filed a federal lawsuit alleging he was harassed and hazed by other team members and subjected to retaliation by the coaching staff after reporting the conduct.

Attorney Steven Marino filed the lawsuit on Monday in U.S. Middle District Court of Pennsylvania on behalf of former Nittany Lion defensive back Isaiah Humphries against the university, coach James Franklin and defensive tackle Damion Barber. Marino also represents former Penn State team doctor Scott Lynch in a separate lawsuit against Franklin and the university.

Humphries, who enrolled at Penn State in January 2018 on a football scholarship, alleges that Barber, along with teammates Micah Parsons, Jesse Luketa and Yetur Gross-Matos led “a campaign to harass and haze lower classmen members of the Penn State football team,” as a form of initiation. Parsons, Luketa and Gross-Matos are not named as defendants.

They would wrestle teammates to the ground, Humphries claims, and simulate sexual acts, as well as place their genitals on or near the alleged victims. The incidents occurred in the Lasch Football Building locker room and showers, campus dorms and other locations, according to the lawsuit.

They also allegedly stated that they intended to make lower classmen “their bitch because this is prison,” and threatened “I am going to Sandusky you,” a reference to former Penn State assistant coach Jerry Sandusky, who was convicted of child sexual abuse.

Police received a report last spring of indecent assaults by a student in the Lasch Building. In December, WJAC-TV reported that a lengthy investigation resulted from one former player’s claim of being hazed by other players. Numerous team members denied the allegations and police and the Centre County District Attorney’s Office did not file charges. One player took and passed a lie detector test according to WJAC.

Humphries, who left the program at the end of his freshman season in 2018, claims that members of the coaching staff observed the alleged conduct on multiple occasions. He also says he reported it to the coaching staff and that his father, former Penn State player Leonard Humphries, reported it directly to Franklin, who did not take any action.

Instead, the lawsuit claims, Franklin and the coaching staff retaliated against Humphries, who says he “was scorned and punished.”

Humphries alleges he was required to participate in athletic drills designed to ensure he would fail, and that performance was used to deny him playing opportunities. He also says the team’s academic advisor subjected him “to irrational and inappropriate censure.”

The lawsuit claims Humphries was denied medical accommodations for diagnosed anxiety and narcolepsy and that the coaching staff tried to get him to leave the team by offering a medical retirement option.

When he decided to transfer, Humphries says, the staff provided negative reviews to other college programs. He ultimately transferred to the University of California.

Before leaving though, he claims he was ostracized and shunned by other players in retaliation for reporting the alleged hazing, and that Luketa threatened him with physical harm.

Last spring, Penn State’s Office of Sexual Misconduct Prevention and Response received an anonymous complaint of harassment and hazing by football team members. After a formal investigation, Barber was charged with violating the student code of conduct and sanctioned by the Office of Student Conduct, according to the lawsuit.

The lawsuit claims negligence in violation of Pennsylvania’s anti-hazing law and infliction of emotional distress by each defendant. It also includes counts of assault and battery and civil conspiracy against Barber.

Humphries is seeking unspecified compensatory and punitive damages.

Barber, Parsons and Luketa are current members of the Penn State football team. Gross-Matos declared for the NFL Draft following the 2019 season.

A Penn State spokesperson has not yet responded to request for comment.

The Active Power Tennis website says Mr Younan has been a coach for over four decades.

“He has years of experience living, breathing and loving tennis,” the website reads.

“He is a member of Tennis Australia, has level 1 and 2 coaching qualifications and has previously coached ranked players.”

Tennis Australia said Mr Younan had previously been involved with the organisation, but was no longer.

Child Abuse and Sex Crimes Squad commander Detective Superintendent John Kerlatec said on Thursday morning Mr Younan had allegedly groomed the girl over a period of months, before a six-month period of offending between July and December this year which ended when the child told her parents about the alleged abuse.

“We believe … there was a series of grooming taking place,” he said.

Mr Younan had allegedly been coaching the victim for two years, Det Supt Kerlatec said.

Police will also allege some of the sexual offending also took place at the tennis centre in Lindfield’s Queen Elizabeth Park.

“We are open to information,” Det Supt Kerlatec said when asked if police were speaking to other students at the tennis school.

Mr Younan is unmarried, childless, and lives alone in Lindfield.

He briefly appeared at Hornsby Local Court on Thursday, where he was formally refused bail.

Mr Younan will return to court in January and will appear via audio-visual link.

On Monday, a lawsuit filed in federal court alleged three Michigan State basketball players of raping a student in 2015, a week after the Final Four loss to Duke, and accused the university of coercing the woman not to report it to authorities.

The case, which was filed in U.S. District Court for the Western District of Michigan Southern Division, alleges three unnamed players — identified only as John Doe 1, 2 and 3 — took the 18-year-old student Jane Doe home from an East Lansing bar between the evening of April 11, 2015 and the morning of April 12.

The suit is the latest black eye for a university and a basketball program under fire for its handling of allegations of sexual assault and violent acts against women. It’s also the third allegation of rape by multiple MSU basketball players since 2010. Only one of those incidents were reported to police.

Here’s a look at the three incidents:

April 2010: According to an ESPN Outside the Lines report, former Michigan State basketball player Travis Walton and two unnamed players from the Spartans’ 2010 Final Four team allegedly sexually assaulted a woman off campus. ESPN reported the alleged gang rape was never reported to police or the university’s Title IX office, but the network said the victim and her family reported it to athletic director Mark Hollis, who told them he would conduct his own investigation.

Walton, who was a student assistant during the 2009-10 season, admitted he knew the unnamed woman and had a relationship with her. He denied raping her.

“My encounters with this woman were more than just a single occasion, and my actions with her were always consensual,” Walton wrote in his statement.

August 2010: According to records obtained by the Free Press, former Michigan State players Keith Appling and Adreian Payne were accused of sexually assaulting a woman during the fall of their freshman year in 2010. Then-Ingham County Prosecutor Stuart Dunnings III declined to press charges in the matter, saying no crime was committed and citing insufficient evidence.

2015: The latest suit came just shy of five months before the federal Office for Civil Rights (OCR) determined MSU’s handling of some Title IX cases had created a “hostile environment” for individuals who complained about relationship violence or sexual misconduct. OCR found there was confusion in MSU’s athletic department about who should report sexual assault claims to the university’s investigation office.

The woman in the case never reported the alleged sexual assault to police, said Karen Truszkowski, the woman’s attorney. But according to the lawsuit, the woman did report the incident to a counselor at the Michigan State University Counseling Center, which she claims failed to properly advise her and even implied it would not be in her “best interest to report the incident to law enforcement.”

Former Penn State football player Harry Hamilton is allowed on State College Area School District property after District Judge Carmine Prestia modified his bail. Hamilton, who is charged with a felony count of burglary and criminal trespassing, has two sons in the school district.

He waived his right to a preliminary hearing on Wednesday after initially indicating he would ask for a continuance. Hamilton, 55, said he was going to represent himself in the case, but told Prestia he has not practiced personal law. When the two attempted to clarify the situation, Prestia discovered that Hamilton’s license was inactive, according to the Pennsylvania Disciplinary Board.

The former two-time Academic All-American and 8-year professional in the NFL also asked for a modification on a no-contact order, which was denied by Prestia.

The modification that was granted will allow him on school grounds. Hamilton said in court papers that he would like to attend school-related events for his children.

The Centre Daily Times previously reported Hamilton allegedly accused his son of drug use before punching him in the head several times. State College police said he also threw another person to the ground during the incident before he fled the residence.

Hamilton vehemently denied the allegations to the Times-Leader. He accused State College police of trying to create a big story due to his fame while ignoring a local drug dealer who he said supplies marijuana to the State College Area High School track team.

“We have no interest in chasing headlines,” police said.

The department also said they have no knowledge of a drug war cover-up, as alleged by Hamilton. Police also said they have no ill will toward him and wish nothing but the best for Hamilton and his family.

Hamilton filed a request for an immediate stay of punishment, including fingerprinting, to the U.S. District Court for the Middle District of Pennsylvania on March 23.

“Hamilton hopes to amend if Hamilton must appear and get fingerprinted and photographed entering the national criminal database within the days remaining because of the absence of a stay or other appropriate relief,” Hamilton said in the request.

In his motion for a temporary restraining order on March 26, Hamilton argues that fingerprinting and photographing is a cruel and unusual punishment upon “a man protecting and raising a son in the face of insurmountable odds with no direct answers as to the best approach.”

He also said State College authorities have tried to criminally charge him for constant and regular involvement with his children since 2006.

In his request for an immediate stay of punishment overview, Hamilton said a Caucasian mother and African-American/aboriginal father disagree about discipline. He said he believes his teenage son is pushing to do illicit activity and was surprised when he was allegedly caught and disciplined.

“Probable cause is lacking that defendant or anyone acting on defendant’s behalf was ever placed on any actual or constructive notice that he was not allowed in or on the premises of his son for any and all purposes,” Hamilton said. “Defendant is now again faced with criminality for attempting to defy statistical odds and be a strong black African/Aboriginal American male in the lives of his two teenage young men of similar background.”

United States District Judge Matthew Brann denied Hamilton’s request on March 30.

Hamilton sued the NFL for $5 million in 2014, according to Sports Illustrated. He claimed he was not made fully aware of the dangers associated with football-related head injuries.

At the time of the lawsuit, Hamilton said he has memory issues, headaches, anger management issues and occasionally relies on painkillers.
