A man has been charged with attacking a fellow baseball player with a bat during a post-game spat in Pontiac last week, the Oakland County Sheriff’s Office announced Friday.

Deputies responding to a report of a large fight in Aaron Perry Park at about 7:30 p.m. Sunday found a 31-year-old man laying on the baseball field “bleeding heavily from a head wound,” investigators said in a statement.

Witnesses told them he had been struck when members of two teams in an adult recreational baseball league who had just ended a game started arguing.

None of the witnesses could name the man who wielded the bat, and neither could the victim, who was rushed to McLaren Oakland Hospital, sheriff’s officials said.

Authorities later identified the suspect as Carlos Medina of Waterford Township.

The 33-year-old was arraigned Friday in Pontiac’s 50th District Court on one count of assault with intent to murder.

Judge Cynthia Walker set bond at $25,000. Medina’s next court date is scheduled for June 30.

In 1986, Lenny Dykstra led the New York Mets to a World Series victory and almost won the National League MVP. He was a muscular, dominant offensive player and adept in the outfield. Unfortunately, Dykstra’s life off the ball field has not been anything to celebrate.

Most recently, he has made headlines for his lewd rants on Twitter during the Coronavirus (COVID-19) quarantine. Although the post might seem shocking, it is merely one more bizarre antic fans have seen. The question is, how did Dykstra go from stardom to a bankrupt drug user?

Shining career brought down by poor choices

Southern California native, Lenny Dykstra, was nicknamed “Nails” due to his tough persona both on the field and off. He was known for getting into fights in bars, but he was also known for doing everything possible to make a play on the baseball field.

He ran running into walls and face planted as he dove to catch balls. His power at the plate was equally impressive. The Mets victory in the 1986 World Series was in no small part due to Dykstra’s performance including a leadoff home run. 

Unfortunately, Dykstra’s life off the field began to catch up with him. Soon after being traded to the Philadelphia Phillies, he drove drunk, causing an accident that severely injured his teammate as well as himself.

The police determined his blood-alcohol level was .178 at the time of the accident. After the incident, Dykstra struggled with injuries before finally retiring from baseball at the age of 33.

Following his baseball career, from the outside, things did not look so bad for Dykstra. He owned a successful car wash with his family, and he made several successful investments.

Financial expert Jim Cramer of “Mad Money,” was so impressed with Dykstra’s economic prowess that he gave him a column on thestreet.com. 

Armed with expert endorsements and media success, Dykstra launched a new enterprise, The Players Club. This venture was a magazine, private jet rental, and financial advisement service all in one.

The company targeted professional athletes, claiming the desire to help them grow their money after retirement. The business was fraught with drama. One embittered ex-employee sat down with GQ to recount Dykstra’s manic behavior and poor spending habits.

It was no surprise to him that The Player’s Club would go under. Dykstra himself would find himself in court for legal proceedings that would wind up with him serving jail time. 

In 2012 Dykstra was sentenced to jail time for falsifying documents to lease luxury vehicles. While he was in jail serving time for this Grand Theft Auto conviction, he found himself in court again concerning bankruptcy fraud.

The judge in the Players Club case indicated he was light in sentencing Dykstra due to his issues with alcohol and drugs. When the police searched his house during his initial arrest, they found cocaine, ecstasy, and human growth hormone. Drugs had been a part of Dykstra’s life since his MLB days. He struggled with pain pills and faced steroid accusations by his brother.

Unfortunately, Dykstra’s time in jail did not end his drug use. In 2018, he found himself in legal trouble once again. He had threatened to shoot an UBER driver in the head.

When the police arrested him, they found cocaine and MDMA in his possession. Dykstra contended that the driver had kidnapped him after he asked to change destinations. The charges against Dykstra were dropped, according to NBC. But he is still facing ongoing charges for renting rooms in his house.

Dykstra once lived a dream life as an MLB All-Star. Drugs and money mismanagement have led him down a path of destruction that does not seem to have an end in sight.

Last year, Minor League baseball player, Blake Bivens learned about the tragic deaths of his wife, young son, and mother-in-law from a post on Facebook.

According to CNN, the 24-year-old pitcher shared the story with Pastor Travis Gore from the River Church in Danville, Virginia, in a live streamed interview Sunday, eight months after the triple homicide that left his family dead.

Bivens, who was in Tennessee at the time finishing a series of games with Tampa Bay Rays Double-A affiliate the Montgomery Biscuits, said the morning of their deaths was “complete chaos.”

It began at 9 a.m. as he was waking up to get ready for a game. He checked his phone and, seeing no messages from his wife, decided to check Facebook.

“As soon as I clicked on Facebook, I just saw a headline, and the headline was just (that) they were looking for my brother-in-law. And so I knew then there’s something going on, so I immediately called my parents,” Bivens said.

“They were trying to figure out everything that was going on also. So at that point I knew I needed to get my stuff together. I needed to probably get an airplane trip home, not knowing the extent of anything going on.”

About 30 minutes later, Bivens was at the airport ready to go home. He kept trying to call his wife but wasn’t getting any answers.

He decided to check Facebook in hopes of getting more information when his eyes landed on the first headline: a story about two women and a child who were killed.

“I immediately knew that was them. I found out my family was gone over a Facebook headline. And I just immediately began to scream in the middle of the airport,” he said.

Bivens’ mother-in-law, Joan Denise Jefferson Bernard, 62; his wife Emily Bernard Bivens, 25; and their son, Cullen Micah Bivens, 14 months, were found dead that day in August 2019 in a south Virginia town.

Matthew Thomas Bernard, the brother of Bivens’ wife, was arrested and charged with three counts of first-degree murder in August.

A moment after making the disturbing discovery, Bivens received a call from Montgomery Biscuits’ manager Morgan Ensberg, who accompanied him home.

“The only thing I really remember from the whole plane ride is I just kind of went through periods of — I just stared at the back of the seat the whole time, trying to get my mind to wrap around what I’m hearing,” Bivens said.

“It’s almost kind of like, this isn’t really happening. And I (was) just more of in a state of shock. I would go through periods of shaking and then I would kind of start to lose it a little bit and break down and cry. And it was kind of just a circle and the plane rides just seemed like they took forever.”

The pitcher told Gore his faith in God has been his greatest comfort as he continues to heal from the devastating loss of his family.

Virginia (NBC) (05/06/20)— Minor league baseball player Blake Bivens said he found out through Facebook that his wife, their 14-month-old son, and his mother-in-law had been killed.

Bivens, who pitched last season for the Montgomery, Alabama, Biscuits, a Double-A affiliate of the Tampa Bay Rays, opened up about the deaths in August while speaking with a pastor from The River Church in Danville, Virginia.

Matthew Bernard, his brother-in-law, has been charged with three counts of first-degree murder. Bernard is accused of killing his mother, Joan Bernard, age 62; his sister Emily Bernard Bivens, age 25; and her child, Cullen Bivens, 14 months.

Bivens said he was with his teammates in Chattanooga, Tennessee, finishing up a series of games when he woke up and checked his phone but didn’t have any messages from his family. He logged on to Facebook and immediately saw a headline about a search for Bernard.

“I knew then there’s something going on so immediately called my parents,” Bivens said during a conversation that aired Sunday on Facebook Live. “They were trying to figure out everything that was going on also. I knew I needed to get my stuff together. I needed to probably get an airplane trip home, not knowing the extent of anything going on.”

The Rays arranged a flight for Bivens to head home to Pittsylvania County, Virginia. He said that while he waited at the airport, he checked Facebook again and the first thing that popped up was a headline that said two women and a small child had been killed.

“I immediately knew that was them. I found out my family was gone over a Facebook headline. And I just immediately began to scream in the middle of the airport,” he said.

Bivens said that during the plane ride home, he would just start shaking, and then he would break down and cry.

The Pittsylvania County Sheriff’s Office was called to a home in southern Virginia after a neighbor reported that someone might have been shot. Bernard was arrested while running around naked after an hours-long manhunt.

A competency review and determination hearing is scheduled for next week to determine whether Bernard is able to stand trial, according to ESPN.  

Bivens said the hardest moment came when he walked into his son’s room for the first time after his death.

“That was the worst moment in my life. Nothing ever will come close to feeling the way I felt at that moment. But then again, I know I will see him again one day, and it won’t be long,” he said.

Bivens said that his faith has been getting him through the more than eight months since the killings and that he has sought comfort in knowing that they are “in the arms of Jesus and they’re waiting for me to be there with them.”

“It’s been amazing how the Lord has helped and gave us peace through everything,” Bivens said.

A witness told Hidalgo County Sheriff’s Office investigators that the 17-year-old high school baseball player from PSJA Memorial sought a gun from an associate before allegedly shooting and killing 19-year-old Genaro Isaiah “Izzy” Castillo.

The sheriff’s office arrested Carlos Julian Contreras on Jan. 15 and charged him with the murder of Castillo, who was found 10 to 15 minutes after he died on a caliche road in the Donna Lakes area near a sugarcane field, according to authorities.

After his arrest, Contreras admitted to picking up Castillo in his white Ford F150 and driving him to the area before someone he knew only as Jorge, shot Castillo several times with a black handgun, according to a probable cause affidavit.

At a news conference after the man’s arraignment last week, Sheriff J.E. “Eddie” Guerra said investigators determined that Jorge did not exist.

“Sheriff’s Investigators were able to identify and locate one of Carlos’ associates by the name of Brandon Marquez,” the charging document read. “Brandon advises that he had spoken to one of Carlos’ friends by the name of Jacob Villalon who said Carlos had been looking for a gun to ‘take out ‘Izzy’ and ‘Reggie’ before they took him out.’”

Investigators interviewed Villalon, who stated Contreras “was asking him for a gun to take out ‘Izzy,’” according to the affidavit.

Guerra said at the news conference that Contreras is the sole suspect in the case.

Hidalgo County Sheriff’s Office investigators and crime scene specialists were at the scene of the homicide the evening of Tuesday, Jan. 14, in the Donna Lakes area. (Joel Martinez | jmartinez@themonitor.com)

Guerra also said investigators arrested Contreras at his home and discovered a bloody napkin and .40 caliber casings in his truck, while describing Contreras as a “bully” who made people fearful.

The official said investigators also believe that Contreras and Castillo were involved in a criminal enterprise, but did not elaborate. The probable cause affidavit provides no details on the alleged criminal enterprise.

Castillo was shot in the head, torso and chest, according to the sheriff’s office.

At his arraignment, Contreras’ attorney, Aviel Flores, said his client had been on the varsity baseball team and was a fire explorer for the city of Alamo.

Flores was asking for a bond reduction, which was denied. Contreras remains jailed on a $1 million bond.

Public records indicate that Contreras is the son of Alamo Fire Chief Ray Contreras.

Two men who had been involved in a fender-bender decided to drive recklessly when they sped down a busy street and crashed into a minivan, killing a 16-year-old high school baseball player and critically injuring his father in south Torrance nearly three years ago, a prosecutor told jurors Wednesday, Jan. 15.

But defense attorneys for both Darryl Leander Hicks Jr., 31, of Los Angeles and Tung Ming, 24, of Rancho Palos Verdes said several complicating factors, and not mere recklessness, led the pair to speed down the hill from Rolling Hills Estates on March 7, 2017.

They said the prosecution overreached in charging the men with gross vehicular manslaughter in a three-vehicle crash that killed Jesse Esphorst Jr. and critically injured his father, also Jesse, during opening statements of an anticipated 10-day trial in Torrance Superior Court.

But prosecutor Ryan Gould told the jury that usually after a fender bender, both parties pull over, exchange information and move on.

“That is not what happened here,” he said. “Because of a series of choices both defendants made, they drove recklessly, carelessly and without regard for human life.”

Witnesses and police estimated the two vehicles to be traveling about 80 miles per hour when they collided in succession with the Esphorts’ minivan as it attempted to make a left turn on a green arrow from southbound Crenshaw Boulevard to eastbound Crest Road.

The minivan clipped Hicks’ vehicle as it sped by on a red light, but Ming’s SUV followed and hit the minivan head on, which was believed to be the fatal collision.

Witnesses who ran up to render aid found Jesse Esphorst Sr. slumped over his son in the passenger seat, with the younger Esphorst’s upper body partly hanging out the passenger window.

The son suffered a broken sternum, skull fractures and a neck dislocation, while the father suffered a broken right nasal bone, a three-centimeter cut on his scalp requiring 10 staples and brain hemorrhaging, Gould said.

Ming stayed at the scene following the collision while Hicks fled. His damaged car was found a quarter-mile away from the crash site and he was arrested days later.

Both men face counts of vehicular manslaughter and reckless driving on a highway causing injuries and death. Hicks also faces counts of hit-and-run driving resulting in death or serious injury to another person, hit-and-run driving resulting in injury to another person and misdemeanor counts of hit-and-run resulting in property damage and driving on a suspended license.

Hicks faces 12 years in prison if convicted as charged, while Ming faces nine years. Both men are free on bail.

The incident began when Hicks made an illegal U-turn to go southbound on Crenshaw Boulevard while Ming was making a legal left turn from Silver Spur Road. Their cars collided before Hicks fled and Ming pursued while calling 911, which led to the fatal crash, Gould said.

Richard Hutton, representing Ming, said the case was unique in the fact that the co-defendants had never met.

Hicks’ attorney Daniel Perlman told the jury his client was headed home with his girlfriend when he made the U-turn. After the collision, Ming’s SUV appeared to veer toward Hicks’ sedan and Hicks fled out of fear that Ming would retaliate, Perlman said.

Hutton told the jury that Ming was simply following the order of a sheriff’s department 911 operator, who asked him three times to try to get the license plate number of the vehicle that had hit him, only to request he stop chasing the vehicle almost simultaneously with the moment of impact, which was heard on the recording.

The defense attorneys were not disputing that the collisions occurred, or that there was tremendous loss as a result, but disagreed with the vehicular manslaughter charge and the contention that gross negligence was involved.

Perlman said Hicks’ girlfriend, seated in the passenger seat of his car, told him that she could no longer see Ming’s SUV in the rear view mirror and suggested he slow down in the seconds before the collision with the Esphorsts, adding Hicks was unaware Ming also hit the minivan.

“You will hear evidence and testimony that my client did not know the second collision occurred or how serious it was,” Perlman told the jury.

Hicks heard about the fatal collision on the news, Perlman said, adding Hicks called him and planned to turn himself in, but was called in to work first and arrested there by police.

Hutton followed and pointed out that Ming was the listed victim in one of the counts against Hicks. He argued that if Hicks was truly afraid, he should have called 911. He claimed Hicks may have fled because he had been drinking and was driving on a suspended license.

Ultimately, Ming didn’t display the mental state of someone with a disregard for human life, Hutton argued.

“It doesn’t make it right, but maybe there are other factors involved,” Hutton said. “In no way, shape or form do we blame the Esphorsts for any part of what happened. It’s a true tragedy and my client feels terrible about it.”

Jesse Esphorst Jr. was a talented shortstop for the South Torrance High baseball team and had just hit a home run to lead his team to victory hours prior to the crash.

More than 2,000 people, including hundreds who knew him through high school and Little League, attended his funeral.

GEORGETOWN— A woman who claims she was sexually assaulted by a former University of Delaware baseball player accused of multiple rapes told a jury Tuesday that she was surprised when he agreed to connect with her on an online dating site.

“He was a UD baseball player, and I was surprised that he would match with me,” the woman said, recounting how she connected with Clay Conaway on the meeting site Bumble. “He seemed just somewhat out of my league. … I couldn’t imagine that he would want to get to know me.”

The alleged victim is one of six women that Conaway, 23, is accused of sexually assaulting between 2013 and 2018. She was to resume testifying Wednesday.
The woman, 21, shared her excitement about connecting with Conaway in text messages with friends, sharing screenshots of his Bumble profile and his Instagram page, which she said she still follows.

“OMG I matched with a Delaware baseball player. … He’s so hot I’m screaming,” the woman texted to a friend.
She also testified that the day after she and Conaway connected on Bumble in May 2018, Conaway sent her a nude photo of himself on Snapchat. In a text exchange with a friend, she estimated the size of his genitalia and expressed amusement about receiving the photo. The friend advised that she block Conaway from her Snapchat account.

“I’ll keep him but now I know what he’s on Bumble for,” the woman responded, explaining to the jury that she understood then that “he was not on there to necessarily date.”
A week later, the woman, who had recently broken up with her boyfriend, told a friend in a text that she wanted “to hook up with somebody.”
“I think I’ve made up my mind,” added the woman, who explained to the jury that hooking up didn’t necessarily mean having sex, but also was not something “super serious.”
In a message to her friend, the woman named five men, including Conaway, whom she could “hit up.”
Two weeks later, she drove to Conaway’s house, where she says he raped her.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they come forward publicly.
Earlier Tuesday, former high school classmate Carey Karl, who described the accuser as her best friend, recounted a text exchange with her shortly before she met Conaway.

“I know that he just wants to have sex so I don’t know how to feel about that to be honest,” the woman wrote. She also indicated that she had told Conaway that she was not comfortable with “the whole hit it and quit it deal,” and that he understood.

Karl said the woman called her later that day crying, saying she wanted to talk and didn’t want to go home. The two sat for about an hour in Karl’s car before she and the woman’s mother convinced her to go to the hospital to be examined.

“She was shaking and kind of hunched over. … She told me that she had ended up having sex and that she didn’t want to,” Karl said.

An Augustana University football and baseball player was arrested early Saturday on several charges, including first-degree burglary.

According to jail records, Peyton Zabel was booked into the Minnehaha County Jail at about 6 a.m. Saturday and was charged with first-degree burglary, disorderly conduct and underage possession of alcohol. Those charges were later amended to four counts of first-degree burglary and one count of simple assault.

Police say Zabel, 19, was arrested after he drunkenly walked into a woman’s unlocked room at 4:30 a.m. Saturday on the Augustana campus in the 2300 block of South Grange Avenue and got into her bed. The victim, 18, told police Zabel grabbed her, police spokesman Sam Clemens said. 

After a struggle, Zabel let go, and the victim went to a friend’s room to call police, Clemens said. The victim didn’t know it was Zabel during the incident, but Clemens said the two know each other.

When authorities arrived, Zabel was passed out in the bed, Clemens said. Zabel woke up in a hospital room and told authorities he didn’t know what had happened. Clemens said Zabel had a PBT of .163.

There was no sign of forced entry in the victim’s room, Clemens said. The woman was not hurt.

At his initial court appearance on Monday, Judge Sara Pokela gave Zabel a $5,000 cash or surety bond, which his attorney Clint Sargent did not contest. His preliminary hearing will be held within 15 days.

Suspended from athletics

A Pierre native, Zabel committed to Augustana in 2018 after turning down an opportunity to play professional baseball for the Milwaukee Brewers. Zabel has pitched in two games for the Vikings this season and is also a quarterback.

Augustana’s Office of the Dean of Students released a statement about the arrest:

“Augustana University is investigating the incident that took place the morning of May 11 and is currently working with the authorities regarding the matter. The university does not comment on the specifics of individual student cases due to federal student privacy laws but adheres to a code of conduct for its students. Per the Augustana University Code of Conduct and the Athletic Code of Conduct, the student-athlete is suspended indefinitely from all athletic activity until the investigation is completed.”

Why a burglary charge?

First-degree burglary is a class 2 felony in South Dakota, punishable by up to 25 years in prison and/or a $50,000 fine.

Under South Dakota law, burglary is defined as entering an occupied structure with the intent of committing a crime. In Zabel’s case, that crime is alleged to be simple assault.

Clemens said the woman was not hurt, but was “very upset” by Zabel’s presence in her room.

The burglary charge was made at the discretion of the arresting officers, Clemens said, and could be amended by the state’s attorney later on.

CHARLOTTE, N.C. (WBTV) – The murder charge for a teen accused in the deadly shooting of a college baseball player will be dropped in exchange for his testimony.

Demonte McCain, 17, and Jahzion Wilson, 15, were both charged with murder in the death of 21-year-old Zachary Finch.

Finch was shot and killed in June 2017 in the 2300 block of Farmer Street in west Charlotte. Finch was reportedly in the area to buy an upgraded iPhone and used an app where he thought he was meeting a legitimate seller.

McCain pleaded guilty Thursday to attempted robbery with a dangerous weapon and conspiracy to commit robbery with a dangerous robbery. McCain will testify against Wilson as part of the deal. He faces up to 11.5 years in prison.

“It’s not justice, but at least he’s going away,” said Tara Finch, Zachary’s mother. “I hope that every night when they close their eyes they see his face.”

Wilson was arrested in July and McCain was arrested in October.

Wilson pleaded not guilty two weeks ago and will go to trial on a first-degree murder charge.

“I want him to go to jail for a really long time, and if that means I have to go to trial, then I’ll go to trial,” said Finch. “It’s disgusting. It makes your stomach turn.”

Wilson’s attorney previously asked the judge to continue the arraignment to another date.

Finch was a senior at the University of the Cumberlands (UC) in Williamsburg, Ky., and a member of the Patriots baseball team, the University says.

To honor Finch’s love for baseball, and his position on the University of Cumberlands’ baseball team, many who attended Finch’s funeral wore University of Cumberlands’ baseball t-shirts.

After Finch’s killing, police opened 14 “exchange zones” at QuikTrip convenience stores where people can more safely conduct online transactions.

Wilson is being tried as an adult.

“But to move on, you don’t move on, you don’t move through this,” said Finch. “This is a part of who we are.”
