Cody Latimer’s attorney said the altercation, which began during a poker game, involved allegations of sexual assault on a 4-year-old.

DOUGLAS COUNTY, Colo. — Former Broncos receiver Cody Latimer had his first virtual court appearance Monday afternoon after he was arrested over the weekend on suspicion of assault and illegal discharge of a gun.

Latimer appeared on a video call before Judge Patricia Herron with his Denver-based attorney Harvey Steinberg. He was released Saturday from Douglas County Jail after a $25,000 bond was posted.

According to the Douglas County Sheriff’s Office (DCSO), a deputy responded to an apartment on Zenith Meridian Drive in unincorporated Douglas County just after midnight Saturday.

According to the arrest report, one man, later determined to be the victim, was detained and escorted for medical attention for a contusion on top of his head and a cut on his face.

The victim told deputies that Latimer, who he said was his best friend, called to set up a poker game at his apartment, the report says. About seven or eight people arrived at his apartment at about 8 p.m., according to the report. Latimer was there, as well as the victim’s girlfriend. The report says alcohol was being consumed during the poker game, including by the victim and Latimer.

During the game, Latimer became involved in an argument with another person, the report says. The report did not mention what the argument was about, however, Latimer’s attorney in court on Monday said the argument involved an allegation of a sexual assault on a 4-year-old.  

The victim told police he separated the two and kicked everyone out of his apartment. About 30 minutes later, Latimer showed up at his apartment, the report says.

According to the victim, Latimer was agitated, angry and blamed him for his confrontation with the other person. The victim said Latimer then pulled out a black handgun from the pocket of his hoodie and said he saved two bullets for the victim and the victim’s girlfriend, according to the police report.

Latimer waved the gun around, although he didn’t point it directly at the victim or the victim’s girlfriend, the report says. According to the victim, he and his girlfriend were scared as Latimer said he was going to “kill everybody,” the report says.

Latimer then said he would never hurt the victim or his girlfriend, according to the report, and emptied the magazine and cleared the chamber of his gun. But then Latimer became angry again and at one point fired two shots in close proximity to the victim, the police report says.

The victim then pinned Latimer against the wall, and Latimer struck him on top of the head with the gun, the police report says, and he fell, maintaining hold of Latimer. Again, the victim pushed Latimer against the wall, and when Latimer told him to calm down, the altercation broke up, according to the police report.

Latimer was later arrested at 3:15 a.m. and charged with:

  • Assault in the second degree, a class 4 felony
  • Menacing, a class 5 felony
  • Illegal discharge of a firearm, a class 5 felony
  • Prohibited use of weapons, a class 2 misdemeanor
  • Reckless endangerment, a class 3 misdemeanor.

A protection order against Latimer was put in place and a hearing for filing charges has been scheduled for 8:30 a.m., July 24.

Steinberg, Latimer’s attorney, in court Monday asked the judge that deputies not speak to Latimer about the sexual assault allegations, which are not against him, unless Latimer’s attorney is present. The judge agreed.

Latimer, 27, was a second-round draft pick for the Broncos in 2014. He never developed as a receiver, although he did become a special teams standout.

After four seasons, Latimer became a free agent and played the past two years with the New York Giants. He recently signed with Washington.

Former NFL and University of Colorado football player Justin Bannan on Tuesday was formally charged with attempted murder and first-degree assault in connection with a shooting in Boulder last week.

Bannan, 40, was charged with attempted first-degree murder after deliberation, attempted first-degree murder with extreme indifference, first-degree assault with a deadly weapon causing serious bodily injury and first-degree assault with extreme indifference, according to court records.

Prosecutors also filed four crime of violence sentence enhancers for those charges. Boulder County District Attorney’s spokeswoman Shannon Carbone said the two attempted murder charges are Class 2 felonies and could carry sentences of 16 to 48 years in prison if Bannan were to be convicted and crime of violence sentence enhancer was proven, while the assault charge is a Class 3 felony that could carry eight to 24 years with the sentence enhancer.

First-degree burglary was among the charges for which Bannan was arrested, but the count was ultimately not filed. Prosecutors did however add a charge of carrying a weapon on school grounds. The arrest affidavit did not mention a school, and officials with the Boulder County District Attorney’s Office and the Boulder Police Department said they could not yet comment on the added charge.

Bannan, who was released from Boulder County Jail after posting $500,000 bond, now has a preliminary hearing on Dec. 9 to determine if there is enough evidence for the case to proceed.

Boulder police said the shooting was reported at 2:24 p.m. Oct. 16 at Black Lab Sports, 3550 Frontier Ave.

According to police, Bannan used a handgun to shoot a 36-year-old woman in the arm. She was transported to Boulder Community Health’s Foothills Hospital with non-life threatening injuries.

Police said the shooting appears to be “random,” as Bannan and the woman worked in the same building but do not appear to have any other connection and were only distantly acquainted.

According to an affidavit, the woman went to unlock her therapy room in the building when Bannan, who was already in the room, instantly shot her in the shoulder while she was standing in the doorway.
