McCabe’s lawyer, Tom Burton, said after the arraignment that prosecutors didn’t have any grounds to bring felony charges. He said his client is a decorated military veteran with a clean record as a police officer.

“Nobody started out their day intending to hurt this fellow,” Burton said. He added that if the victim had followed commands to back off, “none of this would have happened.”

A phone message was left with Torgalski’s lawyer.

The footage shows the man, identified as longtime activist Martin Gugino, approaching a line of helmeted officers holding batons as they cleared demonstrators from Niagara Square around the time of an 8pm curfew.

Two officers push Gugino backward, and he hits his head on the pavement. Blood spills as officers walk past. One officer leans down to check on the injured man before another officer urges the colleague to keep walking.

The police officers “knew this was bad,” Flynn said of the video. “Look at their body language.”

The video of the encounter sparked outrage online as demonstrators take to cities across the country to protest racial injustice sparked by the death of George Floyd, a black man who died after a white police officer pressed a knee into his neck for several minutes.

“I think there was criminal liability from what I saw on the video,” Gov. Andrew Cuomo said at a briefing Saturday. “I think what the mayor did and the district attorney did was right, and I applaud them for acting as quickly as they did.”

“What we saw was horrendous and disgusting, and I believe, illegal,” he added.

But dozens of Buffalo police officers who were angered over their fellow officers’ suspensions stepped down from the department’s crowd control unit Friday. The resigning officers did not leave their jobs altogether.

A crowd of off-duty officers, firefighters and others gathered on Saturday outside the courthouse in a show of support for the accused officers and cheered when they were released.

“It was tremendous, tremendous to see,” John Evans, president of the Buffalo Police Benevolent Association, told WIVB-TV. “I just think it’s a strong indication of the outrage basically over this travesty.”

Flynn said he understood the concerns of officers who don’t feel they are being supported and pointed out that he’s also prosecuting protesters “who have turned into agitators” and “need to be dealt with as well”.

“There will be some who say that I’m choosing sides here,” he said. “And I say that’s ridiculous. I’m not on anyone’s side.”

HOUSTON (AP) — Buffalo Bills defensive lineman Ed Oliver was arrested during a traffic stop in the Houston area and charged with drunken driving and illegally carrying a handgun, authorities said.

Montgomery County sheriff’s deputies pulled Oliver over Saturday after receiving reports around 9 p.m. of someone driving recklessly in a construction area north of the city while towing an ATV on a trailer, Lt. Jim Slack of the Montgomery County constables office said in a statement.

Oliver failed a sobriety test and the deputies found a small caliber pistol in his truck, Slack said. Texas law prohibits having a handgun while committing a crime, and Slack said Oliver faces a misdemeanor charge for having the weapon.

MONTGOMERY COUNTY, TEXAS — Buffalo Bills defensive tackle and former University of Houston player Ed Oliver Jr. was arrested in Montgomery County last night.

Police responded to reports of a reckless driver in a construction zone around 9 p.m., where they found a white pickup truck failing to maintain a lane.
They arrested Oliver and transported him to Kingswood Hospital for a blood draw.

Oliver has been charged with driving while under the influence, and unlawful possession of a firearm.

Former UB basketball player Rodney Pierce was one of four people arrested Tuesday in a Buffalo drug-trafficking bust.

Pierce, 32, was arrested and charged with conspiring to distribute 500 grams “or more” of cocaine. If convicted, he faces a mandatory minimum sentence of five years and maximum of 40 years in prison.

U.S. Attorney James P. Kennedy, Jr. also announced the indictment of David Washington, 39, Eleazar Martinez Medina, 50, and David Burgin, 47, who is Pierce’s uncle.

During the investigation, investigators seized six firearms, ammunition, marijuana, over 7.5 kilograms of suspected cocaine and crack cocaine, over two kilograms of fentanyl, over $750,000 in cash, six “traps,” scales and drug packaging materials.

In a press conference Tuesday, Kennedy said the seized fentanyl was enough “to wipe out the population of Erie County.”

Pierce attended Hutchinson Central Technical High School in Buffalo, where he became the 17th highest scoring player in Western New York history. He committed to Rider University, before transferring to UB.

Pierce was a member of the UB basketball team from 2006 to 2010. He was named first-team All-MAC in 2009 and 2010. He led the team in scoring and started every game those two seasons.

Burgin and Pierce made initial appearances in court and were released on conditions.
