“Nobody started out their day intending to hurt this fellow,” Burton said. He added that if the victim had followed commands to back off, “none of this would have happened.”

A phone message was left with Torgalski’s lawyer.

The footage shows the man, identified as longtime activist Martin Gugino, approaching a line of helmeted officers holding batons as they cleared demonstrators from Niagara Square around the time of an 8pm curfew.

Two officers push Gugino backward, and he hits his head on the pavement. Blood spills as officers walk past. One officer leans down to check on the injured man before another officer urges the colleague to keep walking.

The police officers “knew this was bad,” Flynn said of the video. “Look at their body language.”

The video of the encounter sparked outrage online as demonstrators take to cities across the country to protest racial injustice sparked by the death of George Floyd, a black man who died after a white police officer pressed a knee into his neck for several minutes.

“I think there was criminal liability from what I saw on the video,” Gov. Andrew Cuomo said at a briefing Saturday. “I think what the mayor did and the district attorney did was right, and I applaud them for acting as quickly as they did.”

“What we saw was horrendous and disgusting, and I believe, illegal,” he added.

But dozens of Buffalo police officers who were angered over their fellow officers’ suspensions stepped down from the department’s crowd control unit Friday. The resigning officers did not leave their jobs altogether.

A crowd of off-duty officers, firefighters and others gathered on Saturday outside the courthouse in a show of support for the accused officers and cheered when they were released.

“It was tremendous, tremendous to see,” John Evans, president of the Buffalo Police Benevolent Association, told WIVB-TV. “I just think it’s a strong indication of the outrage basically over this travesty.”

Flynn said he understood the concerns of officers who don’t feel they are being supported and pointed out that he’s also prosecuting protesters “who have turned into agitators” and “need to be dealt with as well”.

“There will be some who say that I’m choosing sides here,” he said. “And I say that’s ridiculous. I’m not on anyone’s side.”

A Greenbushes resident has been arrested and charged with murder and robbery, following the brazen attack on an elderly couple in their home in Rowallan Park, a week ago.

Police spokeswoman Colonel Priscilla Naidu said it is alleged that last Saturday between 10:30am and 11:30am the couple were at home in Maasdorp Street when an unknown suspect entered through the unlocked back door.

According to Naidu the 29-year-old man confronted Martha Snyman, 83, in the passage of the house.

In the altercation, Snyman’s head was injured . She died at the scene Naidu said.

The man then went to the lounge where he confronted Snyman’s husband, David, 76. He sustained slight head injuries and survived the attack, Naidu said.

Two cellphones, cash, jewellery and other household items were taken.

On Thursday members of the Kabega Park SAPS followed up on information received about a possible suspect in the Kuyga area and a 29-year-old male was detained for further questioning.

“Follow-up investigation on Friday [May 15] led members of the Mount Road Cluster Detective Trio Task team and the K9 unit members to several houses in the Kuyga area where most of the stolen items were recovered,” Naidu said.

Police recovered Snyman’s diamond ring, two cellphones, a DVD player, watch and a jacket.

The man has been charged with murder and house robbery and will appear in the Port Elizabeth magistrates’ court on Monday.

Mount Road Cluster Commander, Major General Thembisile Patekile commended the teams for their swift investigation and arrest of the suspect.

“The SAPS has an inherent responsibility to ensure that the elderly are safe and secure therefore we will be working in close collaboration with the prosecuting authority to ensure a successful prosecution,” Patekile said.

CONCORD, NH — An elderly driver from North Conway was injured and taken to the hospital crashing at a tollbooth in Rochester Thursday. The driver, 65, was in a Subaru Impreza driving north on Route 16 when, according to New Hampshire State Police, he attempted to change lanes, drove into a concrete barrier, and went airborne at just after 1 p.m. After that, the Subaru struck a 2019 Chevrolet van being driven by a woman from Barrington.

The Subaru rested on its side and the driver was taken to Portsmouth Regional Hospital by Rochester EMTs. State police did not report whether or not the woman was injured during the incident.

State police were assisted at the scene by Rochester firefighters and the New Hampshire Department of Transportation.

The cause of this crash remains under investigation, according to Lt. John Hennessey of Troop A. Anyone with information about the incident is asked to contact Trooper Daniel Peete, New Hampshire State Police, Troop-A, at 603-223-8490 or Daniel.Peete@dos.nh.gov.

More Commercial Vehicles Stopped

On Tuesday, state troopers were in Ossipee conducting commercial motor vehicle enforcement when they stopped a 2018 Chevrolet box truck on Route 25, reportedly without a U.S. Department Transportation number. The vehicle was pulled over and inspected. The driver, Juan Yupangui, 39, of Ecuador, “did not possess a valid driver’s license, his driving privileges were suspended, was unable to communicate in English as required of commercial motor vehicle operators, and was not medically qualified to drive the vehicle,” according to Lt. Andrew Player of Troop G. Four individuals were also found in the cargo area of the vehicle and not wearing seatbelts as required, according to a report.

An inspection of the truck reportedly found numerous infractions including worn tires, cords that were exposed, and tires that were contacted each other on a rear axle, and the anti-lock braking system was not functioning properly.

Yupangui was charged with operating after suspension.

During the investigation, the owner of the company, Juan Quizhpi, 26, of Haverhill, Massachusetts, arrived in a 2017 F-350 truck. His truck, according to Player, also failed to display the company name and US DOT information. The vehicle also did not have proof of inspection, didn’t have a fire extinguisher, and the company failed to correct issues cited in a previous motor vehicle inspection, state police reported. Quizhpi was also accused of not having possession of a medical certificate. He was cited to appear in court in February.

During the investigations, a third contractor arrived at the site. Andrew Averill, 48, of Hollis, Maine, was driving a 2018 GMC Sierra that also was not properly marked and was not inspected, according to Player. Averill, state police said, also didn’t possess his medical certification — something he was previously cited for. He was given a summons and is also due in court in February.

Man Accused Of Submitting False ID

A Nashua man was arrested on tampering with public and private records and driver’s license prohibition after an incident at the Nashua Division of Motor Vehicles Monday.

State police were called to the DMV to investigate a man who appeared to have a fraudulent driver’s license. State police were eventually able to identify the driver as Julio Garcia Diaz, 35, of Nashua. State troopers accused him of presenting an application for a driver’s license along with a Puerto Rican driver’s license to clerks.

“Both displayed indicators of potential fraud,” according to Player.

As they furthered the investigation, troopers learned that Diaz “had not held a valid license since 2010 and that the license presented was fraudulent.”

Diaz was arrested and is due in court on March 4.

A former NFL player has pleaded not guilty to felony charges for allegedly kidnapping, raping or burglarizing several elderly women. 

Kellen Winslow Jr., a former tight end for teams including the Cleveland Browns and New York Jets, was arrested Thursday for offenses including allegedly raping two women in his Hummer H2, according to The San Diego Union-Tribune.

He pleaded not guilty on Friday to all charges and was denied bail. He faces life in prison if convicted.

The prosecutor in the case, Deputy District Attorney Dan Owens, said Winslow targeted victims he could exploit.

“These charges themselves are extremely serious, and it is clear to the people that these were committed against the most vulnerable victims in society,” Owen said after the court appearance, according to the Associated Press.

All of the alleged crimes happened in Encitas, California, where Winslow, 34, lives. The first incident happened on March 17, 2018, according to court documents. Winslow allegedly lured a 54-year-old woman into his car and raped her. He was charged with kidnapping, rape and forced oral copulation. He did the same thing, documents said, on May 13 to a 59-year-old woman. He’s charged with kidnap, rape and sodomy in that case. He allegedly told both women he would kill them them if they said anything, according to court documents.

Also in May, he allegedly approached a 55-year-old woman and exposed himself to her.

In two more incidents, Winslow is accused of entering mobile homes with the intention of raping the women inside.

On June 1, he entered the home of a 71-year-old woman, documents said, but left after being confronted. Then, on June 7, he went into the home of an 86-year-old woman but was seen by a neighbor, who called police. He was arrested on charges of burglary.

After his arrest, police kept Winslow under surveillance and said he may have been trying to sell his car to get rid of evidence. They charged him with the rape offenses in the other cases.

“The San Diego Sheriff’s Department, in the investigation of each of these separately reported incidents, did an excellent job tying all the leads together, being able to conduct a thorough investigation, which ultimately led to our ability to charge in this case,” Owens told The San Diego Union-Tribune after the hearing.

Winslow is the son of NFL Hall of Fame great and former Los Angeles Chargers players Kellen Winslow, who released a statement outside the courtroom Friday along with his son’s wife, Janelle Winslow.

“On behalf of our son and my husband, we want to reiterate our love, support and affection for him during this difficult process,” he said. “We will always be there for him and we know the true facts will come out.”

Winslow Jr. was a sixth-round draft pick in 2004. He played 10 seasons in the NFL, with the Cleveland Browns, the Tampa Bay Buccaneers, the New England Patriots and then the Jets.

He was once the highest paid tight-end in the league, after signing a $29 million contract in his rookie year with the Browns, but he was suspended in 2013 by the Jets for violating the performance-enhancing drug policy. In November of that year, he was arrested after a woman told police she saw him masturbating in a car. He was charged with possession of synthetic marijuana, but not exposure. There were two open bottles of vaseline in the center console, according to an arrest report. The charges were later dropped.

HARRIS COUNTY, Texas – A Texas A&M women’s basketball player and her twin sister were arrested in May on charges of injury to an elderly person.

According to Harris County court records, Caylinne Martin and her sister Corinne allegedly caused bodily injury to a man over 65 years old by striking him during an incident late last year.

Caylinne Martin has been suspended indefinitely from the women’s basketball team. Corinne Martin once served as the team’s manager, but is set to graduate in August and is no longer with the TAMU Athletic Department.

The incident happened on Christmas Eve 2017. Police say the Martin sisters were part of a group that included at least three others. The victim said the group of five allegedly entered his apartment and struck him and his son multiple times.

During the altercation, the victim claims he was able to bite down on Corinne Martin’s thumb, drawing blood and prompting Caylinne Martin to strike him.

Police say the victims identified both Martin sisters as the attackers. Caylinne Martin has denied her involvement in the incident.

Caylinne transferred to A&M from McLennan Community College before the 2016 basketball season.

The incident happened on Christmas Eve 2017. Police say the Martin sisters were part of a group that included at least three others. The victim said the group of five allegedly entered his apartment and struck him and his son multiple times.

During the altercation, the victim claims he was able to bite down on Corinne Martin’s thumb, drawing blood and prompting Caylinne Martin to strike him.

Police say the victims identified both Martin sisters as the attackers. Caylinne Martin has denied her involvement in the incident.

Caylinne transferred to A&M from McLennan Community College before the 2016 basketball season.

COLLEGE STATION, Texas (KBTX) An investigation continues after two members of the 2017-18 Texas A&M women’s basketball team were charged with injury to the elderly in connection with an incident that occurred in December.

According to a probable cause statement, a 68-year-old man and his son said they were attacked by a group of five people which included Caylinne and Corinne Martin.

The man said he bit Corinne Martin on the thumb during the incident.

According to documents, the man said he suffered a broken nose as a result.

According to Texas A&M, Caylinne Martin has been suspended from the team per policy, and Corinne is no longer a part of the team after fulfilling her duties as a manager and is scheduled to graduate in August.

Caylinne Martin, a 6-foot-3 junior, was a junior college All-American at McLennan Community College.

She averaged six minutes and 1.8 points per game, backing up senior Khaalia Hillsman.

A GAA star who admitted attacking an elderly man with his own walking stick after a row at a chip shop has escaped going to jail.

Judge Paul Kelly told Tyrone player Dean McNally he can consider himself “extremely lucky” after he struck out the charges against him.

McNally (27) previously appeared at Letterkenny District Court in Co Donegal after being told to pay victim Eugene Ferry €2,000.

The court heard there had been a verbal row at a chip shop involving McNally, two of his friends, and Mr Ferry, who was using a walking stick.

The row spilled out onto the street outside the Downings Bay Hotel on the night of March 4, 2017. Once outside, McNally broke Mr Ferry’s walking stick on the ground. Mr Ferry was then pushed to the ground and hurt his hand.

McNally, of Cabhan Alvinn, Pomeroy, Dungannon, Co Tyrone, then threw a part of the walking stick at the elderly man, hitting him on the back. The court heard both McNally and his two friends then began to verbally abuse Mr Ferry.

The victim made a complaint to bouncers who contacted gardaí. Garda Colm McConigley viewed CCTV footage of the attack and was able to identify McNally as the culprit.

McNally’s solicitor, Kieran O’Gorman, said his client never meant to get involved in any row. The court heard he is engaged to be married.

The GAA player was charged with being intoxicated, using threatening and abusive language and also assault.

A victim impact statement was handed into court.

McNally told the court: “I apologise for what happened and I should not have been involved.”

The court was initially told that €500 had been paid to Mr Ferry as compensation, but Mr Ferry said this was not the case.

He added he had been offered €100 but nothing ever came of it. The judge asked if two other accused men involved in the case had appeared before the court.

He said: “I’m curious about the other two individuals. The injured party said he was attacked by three males outside the chip shop.

“Is he covering up for other people is the question I’m asking.”

Garda Inspector Goretti Sheridan told the court it was a bouncer outside the premises who identified McNally and no other people were sought in connection with the attack.

The judge ordered that €2,000 be handed over to Mr Ferry and that another €500 lodged in court by McNally be given to the victim.

“On that basis, I will strike out the charges against him…He can consider himself very lucky,” he added.

Last year, while on a stag party in Las Vegas, McNally was locked up for three weeks after being accused of sexually assaulting a 12-year-old girl.

“They accused me of touching the bum of a 12-year-old girl while walking down the street. It was completely untrue,” he said later.

Despite maintaining his innocence, he said he was forced to accept a lesser charge of ‘simple battery’ rather than spend two years in jail awaiting trial.

HOUSTON (WPVI) —

Philadelphia Eagles All-Pro defensive end Michael Bennett surrendered to authorities in Houston on a charge that he injured a paraplegic woman as he tried to get onto the field after last year’s Super Bowl to celebrate with his brother.

Bennett made a brief court appearance Monday where the judge set his bond at $10,000 on a felony count of injury to the elderly. He is now is free on bond.

After the hearing his attorney, Rusty Hardin, said neither the district attorney nor the police have the whole story.

“If you look at this guy’s career, personality, his family, he would never assault an elderly person, a disabled person,” Hardin said.

A release from the district attorney’s office states that Bennett was a spectator and in Houston to watch his brother, then a player for the New England Patriots, on Feb. 5, 2017. After the game, Bennett allegedly shoved his way onto the field, where players were gathering to celebrate, according to the DA’s office.
NRG security personnel, including a 66-year-old paraplegic woman, told Bennett he had to use a different entrance for field access, but the defensive end pushed through them, including the woman.

Speaking at a news conference Friday, Houston Police chief Art Acevedo said Bennett allegedly told the people he had pushed, “You all must know who I am, and I can own this (expletive). I’m going down to the field, whether you like it or not.”

The woman suffered a sprained shoulder, according to Acevedo.

The injury to the elderly charge includes intentionally and knowingly causing bodily injury to a person 65 years or older and carries a penalty of up to 10 years in prison and a $10,000 fine.

“Mr. Bennett might think that he’s an NFL player, and at that time and place, he thinks he doesn’t have to answer to police officer. I’m proud of the fact our department took the time to investigate this thoroughly,” Acevedo said.
Acevedo said a detective did not actively start working the case until September because the police department had prioritized more serious cases. There is no video of the alleged incident, according to Acevedo.

The Eagles said they are aware of the situation and gathering more information. A spokesman for the NFL said the league is looking into the matter.

Bennett was traded from the Seattle Seahawks to the Eagles along with a seventh-round pick on March 14 for a fifth-round pick and wide receiver Marcus Johnson.

Eagles executive vice president of football operations Howie Roseman, speaking at the NFL owners meeting in Orlando, Florida, said the team did not find out about the alleged incident until Friday, when the indictment was announced.

Roseman expressed full trust in the Seahawks organization and general manager John Schneider, dismissing any notion that Seattle might have withheld information, and said it was important to let the legal process play out.

“I think we’re in a great country, and in this country, people are presumed innocent, and I think we have to be fair about that in all these matters,” Roseman said. “I don’t think it’s fair in any situation to not give people the right to present their side. I don’t want to get into this, but our overriding philosophy on things are people are innocent until proven guilty.”

Roseman stressed that the Eagles do thorough background work on players before bringing them in, a process that includes talking to current members of the team about their experiences with that player. The feedback they received on Bennett, Roseman said, was positive.

“What we found out is that he is a good teammate. They like playing with him,” Roseman said. “Some of our players have been with him in the Pro Bowl; some of our players had trained with him, and we rely on information like that. Obviously, he came to our facility and we had a chance to sit down with him and talk to him.”

Roseman said the team has been in contact with Bennett since the alleged incident came to light.
