Terrell Perriman’s initial court appearance Thursday morning did not produce anything out of the ordinary.

A Rule 16 Discovery Request was made and a new court date of Feb. 18 was set. At that time, Perriman will stand before Judge Chelsea Koch at the Third District Court in West Jordan. Perriman will remain in Salt Lake County Jail on $750,000 bail.

A Rule 16 Discovery Request is a standard motion that defense attorneys file asking prosecutors to give them all of the evidence that they have.

When asked about the Perriman situation on Wednesday afternoon during his National Signing Day press conference, Utes coach Kyle Whittingham balked.

“I made the statement on that, and due to the nature of the nature of the investigation, what’s going on, I’m precluded from saying anything or comment in any way, shape or form,” Whittingham said.

Perriman was immediately suspended from the team last week, but as of Thursday afternoon, he remained on Utah’s official roster.

A statement describing the probable cause for his arrest alleges that he met the girl on Instagram and then the two connected on Snapchat. The teenager told police, according to court documents, that Perriman pressured her to send him nude photos and that he sent her several sexually graphic videos and a picture.

On Jan. 23, the girl said Perriman sent her an Uber ride so she could come to his apartment. Once she was there, charges allege, he trapped her in his room and wouldn’t let her leave. The teen told police she was afraid after she saw that Perriman had a stun gun.

She asked him if she could go, according to court documents, and he said only after she had sexual contact with him. She told him she didn’t want to and that she was only 17 and in high school. Perriman allegedly blocked the door, took her cellphone and covered her mouth while she screamed. She tried to bite him.

The girl said he then pulled his pants down and forced her out of hers and raped her, according to court documents. Perriman then ordered another Uber and sent the teen home, according to the probable cause statement.

YORK COUNTY, S.C. (CN2 NEWS) — A 26-year-old who played football for Northwestern High School is facing murder charges.

The family of Montrece Kennedy says he also played for California State University.

But now, he is charged with murdering a man just two days after Christmas.

A judge has yet to make a decision on Kennedy’s bond hearing – because as CN2’s Indira Eskieva learned – there are several factors affecting the judge’s decision.

One nuance the judge will consider when making his decision – is Montrece Kennedy’s safety. Prosecutors say there is a lot of tension between families on both sides.

“At least his family can see him. I go to the graveyard everyday,” Demetria Dockery said.

Dockery says she practically raised her brother, 39 year-old Robert Dockery Junior.

Detectives say Dockery was shot to death on Calhoun Street in Rock Hill – just two days after Christmas.

Former Northwester High School Football Player – 26-year-old Montrece Kennedy – is charged with his murder.

“And I know that he want to take this back – but unfortunately, we can’t turn back the hands of time,” the suspect’s aunt, Constance, said.

Detectives say on December 27th — Dockery and Kennedy got into an argument over Dockery’s dog.

Witnesses say the argument escalated – and Dockery pulled a knife out – which is when Kennedy pulled out a gun.

“We did find a knife within the vicinity of Mr. Dockery. However, one of the witnesses said that Mr. Dockery fled from Mr. Kennedy so fast – that she thought he had made it further than from where his body was discovered,” Det. Quate said.

Rosie Jones says Dockery had two children, including her 8 year old son.

She says she doesn’t want Kennedy released on bond – because he used to be friends with Dockery – and her son would recognize the man charged with his father’s murder.

“You know I don’t want my son to go outside because he knows Montrece, and “there the man who killed my father.” What kind of shock would that bring him,” Jones stated.

But Kennedy’s family says he is not violent, and was only defending himself.

“If my nephew could take it all back, he would. But if he could take it all back – and the man had a chance to use the knife, this man is not no saint,” Constance said.

Prosecutors said Kennedy does have a history involving possession of marijuana. They said he was federally prohibited from owning a firearm at the time of the alleged incident.

Second due process lawsuit against UNM in less than two weeks

Joseph Caldwell, a University of New Mexico student, has been kicked out of campus housing, stopped from registering for spring classes, and banned from playing on the basketball team.

His crime? He has only been accused of one at this point: battery. Caldwell “has not been arrested or charged, much less proven guilty in a court of law,” according to a federal lawsuit filed against the public university earlier this month.

It’s not clear that UNM even has authority to investigate the allegation, the suit claims: The accuser is not a student and may not live in the state.

The taxpayer-funded university has not followed its own procedure to determine whether Caldwell (above) violated its code of conduct, the suit alleges. He was deprived a hearing where witnesses and evidence against him could be heard and challenged, as well as the opportunity to appeal.

Caldwell is suing the Board of Regents, the university-owned housing nonprofit Lobo Development Corporation and Dean of Students Nasha Torrez for violating his due process rights.

He also claims that board and Lobo breached their contracts with him. In return for Caldwell agreeing to play basketball for the university, “UNM has contracted to provide Plaintiff with access to its undergraduate degree programs.”

By preventing him from being able to continue his education, the university is not following up on its side of the bargain, the complaint argues. Lobo also “failed to honor its obligation of good faith and fair dealing” by breaking his lease.

It’s the second due process lawsuit filed against the university for a disciplinary investigation in less than two weeks. Prof. Nick Flor filed suit Dec. 31 after the university blamed him for a student’s attempted blackmail and suspended him for a year.

Evicted for ‘unlawful action’ (without being charged with a crime)

On Dec. 19, Caldwell received an email from UNM notifying him that he was “hereby interim banned” from campus except to seek medical care and take his “in-person courses for Spring 2020 semester.”

The problem? At this point, Caldwell has registered for only one class, and this ban prevented him from signing up for any more that meet on campus.

The Albuquerque Police Department took a report on battery allegations against Caldwell three days earlier. The email stated that the allegations were “under the jurisdiction of the Office of Equal Opportunity” of the university, and that Caldwell would be unable to contact the dean of students’ office during the Dec. 21-Jan. 1 holiday break.

He met with the Office of Equal Opportunity briefly and denied the charges against him. Afterwards, Dean of Students Torrez “reiterated that he was suspended and that she would make the decision whether or not to continue his indefinite suspension at some unknown later date.”

The same day he was banned from campus, Caldwell received an eviction notice from Lobo requiring him to remove all of his belongings from his university-affiliated apartment within three days.

It claimed that his “unlawful action causing serious physical harm to another person” violated the terms of his lease. According to his complaint, Caldwell has not been charged with a crime.

Four days after it served the eviction notice, Lobo forced Caldwell out of his apartment, even though he had been told he would not be evicted until after Jan. 3. The university would be open on that date, and presumably he could properly address the charges against him at that time.

The suit says Caldwell has not received a written complaint of detailed allegations from the university, any evidence or discovery regarding allegations, the identity or statements of adverse witnesses, or an opportunity to address the allegations with “confrontation rights.”

All are required by UNM’s own procedure before findings can be submitted to the dean of students.

Caldwell says that he “has had no opportunity to appeal any such findings, as there are none to appeal.”

FRANKLIN, Tenn. — The first court appearance for a Nashville Predators player accused of assaulting his girlfriend at a gas station earlier this month has been postponed to next month.

Franklin police arrested team forward Austin Watson on June 16 and charged him with domestic assault on his girlfriend, with whom he has an infant.

Watson, 26, of Nashville, had initially been set to appear in Williamson County General Sessions court Thursday on the misdemeanor charge. Court records show the hearing is now set for July 24.

As of Thursday, Watson, remained free from jail on $4,500 bond. 

According to an arrest warrant, on the evening of the reported offense, a Franklin Police Department officer was flagged down by a witness for a possible domestic situation at the Shell Station on Murfreesboro Road.

The officer soon learned Watson and his girlfriend — with whom he had a child in April — got into an argument in a vehicle at a gas station about her drinking and not being able to attend a wedding.

At the scene, the affidavit continues, Watson admitted to pushing his girlfriend and an officer noticed red marks on the woman’s chest.

If convicted of the misdemeanor, Austin faces up to 11 months and 29 days in jail and up to a $2,500 fine, said Williamson County District Attorney Kim Helper.

A first-round pick in 2010, Watson signed a three-year, $3.3 million contract in July 2017. He had a career-high 14 goals and 19 points this past season as well as eight points in 13 playoff games.

Both the Predators organization and the NHL are aware of the arrest.

“We are still gathering facts and it is not appropriate for us to comment further at this time, but this is a matter that we are taking very seriously and will cooperate fully with the investigation by law enforcement,” the Predators released in a statement several days after Watson’s arrest. “The Nashville Predators have and will continue to stand side by side with AMEND in the fight to end violence against women.”

VERMILLION, S.D. — A University of South Dakota football player accused of rape remains scheduled to stand trial next month.

A motion hearing scheduled for Thursday in Dale Williamson Jr.’s case did not take place. A status hearing has been set for April 13, and an April 30 trial date remains on the court calendar, Clay County Circuit Court officials said.

Williamson, 21, of Texarkana, Texas, has pleaded not guilty to attempted second-degree rape in connection with an Oct. 22 incident at an off-campus residence in Vermillion and second-degree rape for a March 3, 2017, incident involving another woman.

A second player charged in connection with the October incident has pleaded guilty to sexual contact without consent with a person capable of consenting.

Danny Rambo Jr., 21, of Donaldsonville, Georgia, was sentenced Feb. 9 to 180 days in jail. He is scheduled to serve 10 days beginning Nov. 1, and have the remaining 170 days suspended, provided he meets several conditions, including completion of counseling and not possessing or consuming alcohol, marijuana or other controlled substances, for two years. He also must pay a $2,000 fine.

Both players were accused of entering a room while their teammate Adam Harris was having sex with a woman and sexually assaulting her.

According to court documents, Rambo approached the victim from behind without her knowing and inserted his fingers into her vagina.

Williamson twice tried to force the victim to perform a sex act with him, court documents said, and on one of those occasions grabbed the woman by the hair on the back of her head.

Williamson has denied any involvement and told police he was not in the room.

Rambo, a junior defensive back, and Williamson, a sophomore defensive back, both were suspended from the team in October and did not play the remainder of the season. They are not currently listed on the player roster on the team’s website.

Bryan Boettcher, assistant athletic director for sports information, said their status has not changed.

“Their suspensions continue,” Boettcher said.

Harris, a senior defensive back and team captain from Clearwater, Florida, also was suspended. He was not arrested.

CEDAR RAPIDS — A federal judge reset a detention hearing Thursday for a former Iowa Barnstormers coach, who is charged with secretly recording three naked teen players.



Greg Stephen, 42, was arrested Tuesday. Police were initially tipped off when after a contractor who was working in Stephen’s Monticello home about a month ago discovered a recording device in the former youth basketball coach’s bathroom and became suspicious.  



Stephen was charged by information Tuesday with one count of knowingly transporting child pornography, and a judge ordered that he would remain in jail pending a detention hearing set for today.



His lawyer asked that the hearing be delayed so Luis Rosell, a forensic psychologist in Mt. Pleasant, could testify. The hearing will determine if Stephen will be released pending trial.



Rosell, a former sex offender treatment director for Iowa Department of Corrections and now in private practice, specializes in treatment of sex offenders and those charged with child pornography. He frequently conducts evaluations for state and federal court proceedings, according to his resume.   



U.S. Chief Magistrate CJ Williams reset the detention hearing for 1 p.m. next Wednesday.   



The Barnstormers, an amateur athletic union organization, severed ties with Stephen the day authorities searched his house. Organizers since have met with parents and players and agreed to move forward.



According to court records, Stephen, admitted he made the videos but said he did so for a non-sexual reason. He told investigators wanted to look at the “development of the kids how they were growing and developing,” according to the 17-page criminal complaint affidavit filed by the Iowa Division of Criminal Investigation.   



Stephen told DCI Special Agent Ryan Kedley that he might have been “a little bit” aroused when viewing the videos, but “in the same way you would be aroused when you view anyone naked,” according to the complaint.  



The former coach denied having any sexual relationship with past for current teen players.



The investigation began Feb. 18 when the contractor, identified in documents as “V.E.” contacted Monticello police.



The tipster told police, while working at Stephen’s house, he found a USB charger equipped with a video recorder in the bathroom. Authorities said he took the device home to inspect the stored files.



V.E. said the digital files showed what appeared to be teenage boys in a hotel bathroom, disrobing and going in and out of the shower, the complaint states. The device was turned over to the Iowa DCI on Feb. 21 and later search warrants were obtained on Stephen’s home in Monticello and cabin in Delhi, as well as his vehicles.



Stephen, general manager of Stephen Moters, also told investigators the videos were made in hotel room in Illinois Jan. 26-27 when he and boys went to a Chicago Bulls game. None of the boys, ages 12, 13, and 14, were aware he was recording them



A current Barnstormers player told DCI that Stephen was sexually touching himself while sharing a bed with the player during a basketball trip to Las Vegas in 2016.



Prosecutors will convene a grand jury to indict Stephen for the felony, which has a mandatory five year and up to 20 years in prison upon a conviction.

PHILADELPHIA (CBS) — As the defense tries to change the field of play, a highly recruited high school football player, charged with robbing a South Philadelphia Wawa convenience store at which his brother worked, has waived his preliminary hearing. His brother also appeared, as a co-defendant.

A Wawa employee testified while she and 24-year-old Quasir Wingate were in the office last July, a gunman with a hoodie pulled over his head walked in and pointed a gun at her head. Wingate opened the safe and handed the gunman more than $13,000.

Prosecutors allege the gunman was Wingate’s brother, then 17-year-old Isheem Young, a senior running back from Imhotep Charter, once recruited by Penn State and more than two dozen schools.

Defense lawyer Richard Klineburger is trying to punt the case from the Criminal Justice Center to juvenile court.

Assistant District Attorney Matthew Gehrke says a judge will decide whether to “decertify.”

“That judge will determine whether he’s tried as an adult or whether he’ll go back to the juvenile system,” Gehrke said.

Wingate rejected a plea arrangement conveyed by the DA’s office to plead guilty and serve nearly two-years in prison.

Defense lawyer William Ciangalini says while the departing gunman told them to get down on their knees and count to 30, Wingate got up after ten seconds and immediately called 9-1-1.

A third man, the alleged getaway driver, agreed to plead guilty and serve nearly two years under house arrest.

N.C. State sophomore guard Markell Johnson’s pretrial hearing on his felony assault charges has been continued until Jan. 16 at 9 a.m.

Johnson, Demarious Green, Michael Melton and Johnnie Pullum were indicted on Dec. 5. The four are charged with assaulting Michael Blackwell, 37, in Cleveland in early October.

Defense attorneys, including Johnson’s attorney John Paris, expressed concern that Johnson would be unable to play basketball or receive his scholarship while the case was pending. Paris indicated additional witness statements would demonstrate that there were errors in the initial police report.

According to the Oct. 8 Cleveland police report, Blackwell said he got into a verbal altercation with Johnson. Blackwell said Johnson struck him in the face “about 10 times” before he fought back. In the police report, Blackwell also says that Green, Melton and Pullum threw punches and grabbed his neck before Blackwell bit one of his attackers.

Blackwell later that night sought medical attention and later told police his eye socket was fractured and he suffered a concussion. Blackwell also received stitches, according to the police report.

In 2015, Johnson told recruiting and high school sports website The Left Bench that Melton and Blackwell were mentors to him: “Living in the townhouses where I grew up, my next door neighbor Mike Blackwell taught me a lot about the game. He didn’t just tell me, he showed me and helped me.”

The Cuyahoga County prosecutor’s office is expected this week to send its own investigators to interview Johnson’s mother, Sabrina Johnson, and other witnesses.

Under N.C. State’s student-athlete code of conduct, Johnson is suspended from the basketball team until the felony charge is resolved.

Under Ohio law, felony assault is a second-degree felony punishable by two to eight years in prison if convicted. If charges are reduced to a misdemeanor due to a plea offer, it’s punishable by no more that six months in county jail. If Johnson accepts such a plea bargain, he could be eligible to return to N.C. State’s team. It will, however, be up to N.C. State coaches and administrators as to whether or not he’s allowed to return. An N.C. State basketball spokesman declined to comment.

Johnson, who was N.C. State’s starting point guard for the season’s first 10 games prior to his Dec. 14 suspension, has missed the team’s last six games, including the Wolfpack’s 96-85 win over Duke on Saturday. N.C. State has gone 3-3 in those games, including 1-2 in ACC play.

He’ll miss the Wolfpack’s (11-5, 1-2 ACC) two games this week; the first against No. 25 Clemson at home on Thursday, and the second on Sunday at No. 8 Virginia.
