Arbery was slain on February 23 when the Greg and Travis McMichael, a white father and son, armed themselves and pursued the 25-year-old black man running in their neighbourhood. Greg McMichael told police he suspected Arbery was a burglar and that Arbery attacked his son before being shot. Arbery’s family has said he was out for a jog.

Bryan lives in the same subdivision, just outside the port city of Brunswick. Bryan said he saw the McMichaels driving by and joined the chase, a Georgia Bureau of Investigation agent Richard Dial testified earlier this month at a probable cause hearing.

It wasn’t until May 7 – two days after Bryan’s cellphone video leaked online and stirred a national outcry – that the McMichaels were arrested. Bryan was arrested on May 22, and an arrest warrant said he tried “to confine and detain” Arbery without legal authority by “utilising his vehicle on multiple occasions” before Arbery was shot.

Bryan told investigators that Travis McMichael cursed and said a racist slur as he stood over Arbery, moments after he fatally shot him, Dial testified.

The Georgia Bureau of Investigation took over the case after the video surfaced. The state attorney general appointed Holmes, who’s the district attorney in Cobb County near Atlanta, to prosecute after the local district attorney recused herself because Greg McMichael had worked for her – and two other outside prosecutors also stepped aside.

In addition to malice murder and felony murder charges, the McMichaels and Bryan each are charged with two counts of aggravated assault and one count each of false imprisonment and criminal attempt to commit false imprisonment.

Under Georgia law, a felony murder charge means that a death occurred during the commission of an underlying felony and doesn’t require intent to kill. Malice murder requires “malice aforethought, either express or implied.” Any murder conviction in Georgia carries a minimum sentence of life in prison, either with or without the possibility of parole.

Court functions in Georgia have been severely limited in recent months because of a statewide judicial emergency declared by the chief justice of the state Supreme Court in response to the coronavirus pandemic. Holmes said they were able to call in a grand jury that had been impanelled prior to the judicial emergency.

Attorneys for Arbery’s mother and father issued statements applauding the indictment and stressing their desire to see the three men convicted and sentenced for his death.

Bob Rubin, a lawyer for Travis McMichael, 34, said in an email that prosecutors choose the facts they want to present to a grand jury when seeking an indictment. The defence team has found other facts “that are an integral part of the case,” he wrote.

“To this indictment, Travis McMichael will plead not guilty, and we look forward to presenting all of the facts regarding this tragic death in a court of law,” Rubin wrote.

Attorney Kevin Gough, who represents Bryan, 50, spoke to reporters at the county courthouse right after Holmes announced the indictment.

“We welcome the action of the grand jury today,’ Gough said. “While we disagree with it, it’s an important step in the process to moving this case closer to the speedy trial that Roddie has demanded.”

He said his client has committed no crime and has co-operated with law enforcement officers from the beginning.

Lawyers for Greg McMichael, 64, did not immediately respond to an email seeking comment Wednesday afternoon.

Even if Governor Brian Kemp signs the state hate crimes legislation passed this week, it couldn’t be applied retroactively to this case, Holmes told reporters. The US Department of Justice has said it’s assessing whether federal hate crimes charges are appropriate.

A Tarrant County grand jury has indicted former Texas Rangers player Josh Hamilton on a felony injury to a child charge. 

Hamilton, 38, is accused of hitting and scratching his daughter in a September 2019 incident. 

During the assault, he told his daughter to tell a judge “what a terrible dad I am” so that she would never have to go to his house again, according to Keller police records.

Hamilton has three children but court records show he is accused of assaulting his oldest. 

When interviewed by Child Protective Services, his daughter told the interviewer that Hamilton started to assault and throw things at her after she made a comment that upset him, records show. 

The former baseball player is accused of throwing a full water bottle that hit his daughter in the chest. Hamilton then pulled a chair from under his daughter and threw it at her, a warrant says.

Hamilton then allegedly took his daughter to a room, pinned her to a bed and repeatedly hit her on the back and legs, according to an arrest warrant. 

Police records show Hamilton is 6-feet-4-inches and weighs 250 pounds.  

Tarrant County court records show after the incident, Hamilton’s ex-wife, Katie Hamilton, filed for a temporary restraining order against him on behalf of her daughter.

Former Texas Rangers star and 2010 American League MVP Josh Hamilton was indicted on a felony charge for injury to a minor on Monday, reports Jeff Wilson of the Fort Worth Star-Telegram. Hamilton turned himself in to police and was arrested in October for hitting and scratching his daughter.

Hamilton, 38, hasn’t appeared in the majors since 2015. In addition to the Rangers, he played for the Cincinnati Reds and Los Angeles Angels over parts of a nine-season career. The No. 1 pick in 1999 draft, Hamilton’s career was delayed and at times overshadowed by substance abuse and addiction issues — including at least one reported relapse back in 2015.

During Hamilton’s career, he hit .290/.349/.516 (129 OPS+) with 200 home runs and 50 steals. He made five All-Star Games, won three Silver Sluggers, and was the 2010 Most Valuable Player.

Already charged with resorting to fraud and bribery to get his son into USC, John Wilson was indicted Tuesday on a new count of tax fraud, deepening the Massachusetts financier’s legal troubles and suggesting prosecutors have opened a new line of attack to pressure parents who have resisted plea deals.

For help getting his son into college, Wilson paid $220,000 in 2013 to William “Rick” Singer, a Newport Beach college admissions consultant who has admitted orchestrating a decade-long scheme to defraud some of the country’s most elite universities through doctored exams, fake athletic credentials and bribes.

Prosecutors allege Wilson was aware that Singer would misrepresent his son’s athletic prowess and intended to bribe Jovan Vavic, USC’s water polo coach. Wilson’s attorneys say the financier’s son was a bona fide water polo player and that Singer had led him to believe the payment was a legitimate donation to USC.

Wilson has pleaded not guilty to conspiracy to commit fraud, bribery and money laundering, one of 15 parents who have maintained their innocence in the scandal. Prosecutors are trying to extradite a 16th parent who was arrested in Spain.

Seventeen parents have pleaded guilty to an array of fraud and money laundering charges. Vavic, fired by the university in March, has pleaded not guilty to conspiracy to commit racketeering, fraud and bribery.

Federal prosecutors in Massachusetts unsealed a new indictment Tuesday, alleging Wilson committed tax fraud when he wrote off the payments in 2014. The day after his son was admitted to USC as a water polo recruit, Wilson emailed Singer, thanked him for “making this happen” and asked if he could bill him for “consulting or whatever” so he could pay with a corporate account, the indictment says.

“Yes we can send you an invoice for business consulting fees and you may write off as an expense,” Singer wrote.

Wilson’s reply, according to an affidavit filed in federal court: “Awesome!”

Singer’s accountant, Steven Masera, emailed an invoice to an employee at Wilson’s firm, Hyannis Port Capital, requesting $20,000 be paid to Singer for a “professional development program” and $100,000 to Singer’s for-profit counseling company for “business consulting.” Masera also attached a letter thanking Wilson for a $100,000 contribution to Singer’s purported charity.

Once Wilson’s firm wired the $220,000, the indictment says, Singer sent Vavic a $100,000 cashier’s check, made out to the USC men’s water polo program. Wilson wrote off the payments as charitable donations and business expenses on his 2014 tax returns, underreporting his taxable income, prosecutors allege. Wilson’s attorney didn’t respond to a request for comment. Masera has pleaded guilty to conspiracy to commit racketeering and is cooperating with the government.

Wilson pursued a similar deal in 2018 for his twin daughters, whom he hoped to see matriculate at Stanford or Harvard, prosecutors say. Pressed by Singer — who by that point was cooperating with the government — to commit $1.2 million, Wilson’s firm wired $500,000 to Singer’s foundation in October 2018, the indictment says.

“It’s a $500k donation I am going to make this year,” Wilson wrote to his assistant in an email, according to the indictment. “Tax write off and help getting into colleges.”

His firm wired another $500,000 two months later.

Several of Singer’s clients deducted similar payments from their tax bills, according to charging documents filed in the case. Elisabeth Kimmel, charged with conspiring to have her children admitted to Georgetown and USC as phony athletes, wrote off $275,000 that her family’s charity paid to Singer’s foundation, according to an affidavit filed in federal court. The wife of Homayoun Zadeh, a dentistry professor, asked Singer to furnish them with a tax receipt for a $25,000 donation, the affidavit says.

Zadeh has been charged with conspiring to commit fraud, bribery and money laundering to have his daughter admitted to USC — where he chaired the periodontology department — as a fake lacrosse player. Kimmel and Zadeh have pleaded not guilty.

USC, meanwhile, parted ways Tuesday with three top officials in the athletic department: Steve Lopes, its chief operating and financial officer; Ron Orr, who led fundraising efforts; and Scott Jacobson, who also worked in fundraising.

Derrick Mason, a former Tennessee Titans wide receiver, was recently indicted on a misdemeanor domestic assault charge.

The charge stems from an October 2017 incident where a woman that the 44-year-old had been dating told authorities that he grabbed hold of her neck and then slapped her and hit her in the stomach.

The Wrap reports that in December 2017 she contradicted those claims in a preliminary court hearing.

Initially, Mason was charged with felony aggravated assault involving strangulation, but that was reduced to the misdemeanor assault charge.

He is currently out of jail after posting bond.

Mason was drafted by the Tennessee Oilers in 19997 and stayed with the team after they changed their name to the Tennessee Titans.

He later went on to play for the Baltimore Ravens, the New York Jets and the Houston Texans, finally leaving the NFL in 2011.

Most recently, Mason hosted a sports talk show on Nashville’s 102.5 The Game, but was placed on leave following his arrest.

Mason isn’t the only NFL player to make headlines lately, as former Miami Dolphins star Jonathan Martin was recently arrested after sharing a photo on his Instagram page that caused police to believe he was making threats against his former prep school, Harvard-Westlake.

Martin was detained and Harvard-Westlake closed for the day. Students and faculty were instructed to stay away for their own safety.

Police also saw the photo of a gun and bullets, which included text that read, “When you’re a bully victim [and] a coward your options are suicide, or revenge,” as a possible threat to his ex-teammates Richie Incognito and Mike Pouncey, as he tagged their Instagram accounts in the picture.

Law enforcement brought Martin in on Friday and, while he has not been formally charged with any crime as of yet, he is undergoing a psychiatric evaluation.

“The individual we believe to be responsible for the social media post has been detained and the investigation is ongoing,” police are said to have told TMZ.

Previously, Martin was in the news after accusing both Pouncey and Incognito of abusing him physically and emotionally during his time playing with the Miami Dolphins.

The two men claimed that they were “harmlessly” hazing him, but an NFL investigation determined and ruled that Martin’s claims had validity and that he was harassed. As was previously noted, Martin is no longer an NFL player, but Pouncey still plays for the Dolphins and Incognito plays for the Buffalo Bills.

Former Tennessee Titans wide receiver Derrick Mason has been indicted on a misdemeanor domestic assault charge stemming from an incident in October.

Mason, who was a two-time Pro Bowler during his time in the NFL from 1997 to 2011, was handed a one-charge indictment by the Davidson County grand jury on Friday, the Tennessean reported.

According to court documents cited by the report, Mason, 44, attacked a woman who he had been dating in October 2017. She initially told police officers that he grabbed her by the neck, hit her in the stomach and slapped her, but later contradicted those statements in court during a preliminary hearing last December.


Mason was at first charge with felony aggravated assault involving strangulation but the charges were then reduced to a misdemeanor assault charge. He is currently out of jail on bond.

After being drafted by the Tennessee Oilers in the fourth round of the 1997 NFL draft, Mason remained with the team when they charged their name to the Tennessee Titans. He went on to play for the Baltimore Ravens, New York Jets and Houston Texans.

Mason recently co-hosted a Nashville sports talk radio show on 102.5 The Game but was placed on leave of absence following his arrest.

“We do not fully know what occurred in court this morning,” Bud Walters, president of the station’s parent company, The Cromwell Group, said in a statement to the Tennessean in December. “We are trying to learn more. Derrick has always maintained that he is completely innocent of the charges and we have no reason not to believe him.” He is still listed on the station’s website and social media channels.

HARRIS COUNTY— A Harris County grand jury indicted Philadelphia Eagles defensive end Michael Bennett Friday for injuring a 66-year-old disabled NRG security employee.

On Feb 5, 2017, Bennett was in Houston to watch his brother, play for the New England Patriots.

Immediately following the game, Bennett shoved his way onto the field where players were gathering to celebrate.

The NRG Security personnel told Bennett that he had to use a different entrance for field access. Bennett ignored their requests and pushed his way through them, including the elderly woman who was part of the security team.

The charge, injury to the elderly, includes intentionally and knowingly, causing bodily injury to a person 65 years or older. The charge carries a penalty of up to ten years in prison and a $10,000 fine.

Markhale Hart, the man indicted in the murder of Auburn football player Jakell Mitchell, will face additional charges in his upcoming retrial.

According to court documents, prosecutors have also charged Hart with manslaughter and certain persons forbidden to carry a pistol.

Hart went to trial in December but after four days of deliberation, a mistrial was declared. Officials say the jury was not able to come to a verdict.

According to the mistrial order, Hart’s retrial is expected to begin sometime during the jury trial term which will begin on Feb. 26.

LEE CO., AL (WSFA) -

Markhale Hart, the man indicted in the murder of Auburn football player Jakell Mitchell, will face additional charges in his upcoming retrial.

According to court documents, prosecutors have also charged Hart with manslaughter and certain persons forbidden to carry a pistol.

Hart went to trial in December but after four days of deliberation, a mistrial was declared. Officials say the jury was not able to come to a verdict.

According to the mistrial order, Hart’s retrial is expected to begin sometime during the jury trial term which will begin on Feb. 26.

RALEIGH — The felony assault case against suspended N.C. State basketball player Markell Johnson has been continued until Jan. 8, according to his attorney’s office.

Johnson and three other defendants were in court Thursday morning for a pretrial conference at the Cuyahoga (Ohio) County Justice Center in Cleveland, Ohio. The four are charged with assaulting Michael Blackwell, 37, in Cleveland in early October.

Johnson, Demarious Green, Michael Melton and Johnnie Pullum were indicted on Dec. 5. Each was jailed on Dec. 20, ordered to supply a DNA sample and released on $5,000 bond.

According to the Oct. 8 Cleveland police report, Blackwell said he got into a verbal altercation with Johnson. Blackwell said Johnson struck him in the face “about 10 times” before he fought back. In the police report, Blackwell also says that Green, Melton and Pullum threw punches and grabbed his neck before Blackwell bit one of his attackers.

Blackwell later that night sought medical attention and later told police his eye socket was fractured and he suffered a concussion. Blackwell also received stitches, according to the police report.

Johnson, 19, and his attorney, John Paris, have not responded to requests for comment. Neither Pullum’s attorney, Andy Petropouleas, nor Green’s attorney, Lisa Rankin, could be reached Thursday for comment. Melton’s attorney, Thomas Shaughnessy, declined to comment.

Blackwell posted a photo of himself, bloodied, on Facebook on Oct. 8. When contacted Thursday in Cleveland, Blackwell declined to comment.

Johnson, who was N.C. State’s starting guard for the first 10 games this season, was indicted in Cuyahoga County on Dec. 5. He played four days later — on Dec. 9 — against Missouri-Kansas City in the game at Reynolds Coliseum. However, the structure of the Ohio court system might have caused a delay of when Johnson was notified of the charges against him.

Cuyahoga County sent a certified letter to Johnson’s Cleveland address on Dec. 5 to notify Johnson of the charges and his court date. Johnson wasn’t in Ohio on Dec. 11, when the letter was signed for at the home address.

Debbie Yow, N.C. State’s athletic director, said Thursday the school did not learn of Johnson’s indictment until Dec. 14. Johnson was suspended the same day. The school then announced on Dec. 16, prior to N.C. State’s game against UNC Greensboro, that Johnson had been suspended indefinitely for violating the school’s student-athlete code of conduct. Johnson sat on the sideline, not in uniform, that day.

“We acted appropriately as soon as we found out about it,” Wolfpack coach Kevin Keatts said Thursday.

Keatts said he has had contact with Johnson but did not comment on what was said between the two. Johnson was not at the Wolfpack’s games against Robert Morris on Dec. 19 or against Jacksonville on Dec. 22.

In Ohio, a felonious assault is defined as “knowingly causing serious physical harm to another person” and is a second-degree felony unless the victim is a law-enforcement officer. In the North Carolina court system, Johnson would have been arrested and taken before a magistrate to determine bond conditions on the same day he was indicted.

The felony charge would have triggered the automatic suspension under N.C. State athletic department’s rules.

According to the school’s student-athlete code of conduct, a student-athlete charged with a felony crime will be immediately and indefinitely suspended from athletics participation, pending the final disposition of all charges.

N.C. State faces Clemson on Saturday in its ACC opener and plays Notre Dame (Jan. 3) and Duke (Jan. 6) before Johnson’s next pretrial hearing.

Wolfpack junior Torin Dorn said the players are not aware of all the details of Johnson’s case.

“We don’t know a lot that’s going on, either,” Dorn said Thursday. “We’re just hoping for the best for him in his situation and praying for him. We hope his situation gets figured out, and he’ll be back with us, hopefully.”

Efforts to reach Johnson and his attorney were unsuccessful.

North Carolina State announced Johnson’s indefinite suspension December 16. At the time, athletic department spokesman Craig Hammel cited a violation of the school’s student-athlete code of conduct but provided no further details.

According to the school’s code of conduct, a student-athlete charged with a felony crime will be immediately and indefinitely suspended from athletics participation, pending the final disposition of all charges.
