A Superior Court of Guam judge has allowed a South Korean soccer player charged with sexual assault to return home for military service, pending his trial.

Kim Byong-oh is accused of sexually assaulting a woman on Jan. 22 at a Guam resort, the Pacific Daily News reported Monday.

Kim was indicted on three counts of third-degree criminal sexual conduct and four counts of fourth-degree criminal sexual conduct. He has pleaded not guilty to the charges.

Kim was on Guam with the Sangju Sangmu soccer team for training in January.

The 22-year-old woman who accused Kim told police that she woke up in a hotel room to Kim rubbing her stomach and breast. She told police that Kim also took off her underwear and raped her.

The woman said she ran out of the hotel room and found a security guard who called police.

Kim’s attorney, F. Randall Cunliffe, has said there’s video evidence from the hotel disputing the allegations made against his client.

Kim, an active duty member of the Korea Armed Forces Athletic Corps, was deemed AWOL because he couldn’t leave Guam and return to his unit after he was charged, Cunliffe said.

Cunliffe filed a motion, asking the court to allow Kim to leave Guam and return to his military unit. Kim was then ordered to be released to Lt. Col. Hyeon Chul Park.

Kim will have to check in with probation through phone or email once a week and must stay away from the woman who accused him of sexual assault. Prosecutors have said the woman accusing Kim lives in Korea, but Cunliffe said Kim’s military base is far from where the woman attends college.

Kim is also restricted to his military base.

Kim will have to return to Guam on July 18 for a court hearing. (AP)

A South Korean soccer player charged with sexual assault was allowed to return to South Korea for military service, pending his trial, according to a recent decision by Superior Court of Guam Judge Arthur Barcinas.

Byong Oh Kim is accused of sexually assaulting a woman on Jan. 22 at the LeoPalace Resort in Yona, according to court documents. Kim was on Guam with the Sangju Sangmu soccer team for training in January, according to a news release from the soccer team.

In addition to playing soccer, Kim is an active duty member of the Korea Armed Forces Athletic Corps and was AWOL because he couldn’t leave Guam and return to his unit after he was charged in Guam, according to his attorney, F. Randall Cunliffe.

Cunliffe filed a motion, asking the court to allow Kim to leave Guam and return to his military unit. Kim needed the court’s permission before he could leave the island. 

Judge grants request 

Barcinas granted the request and ordered that Kim be released to Lt. Col. Hyeon Chul Park and travel to South Korea until Kim’s trial.

Kim will have to check in with probation through phone or email once a week and while he’s in Korea he is ordered to stay away from the woman who accused him of sexual assault. Prosecutors have said the woman accusing Kim lives in Korea, but Cunliffe said Kim’s military base is far from where the woman attends college.

Kim is also restricted to his military base.

When Park was on Guam for a court hearing last month, he assured the judge that Kim would not be allowed to leave the base.

Kim to return for court 

Kim will have to return to Guam on July 18 for a court hearing, the order states.

“Should (Kim) fail to appear for any scheduled court appearances or violate any terms of his release, the court shall initiate bail forfeiture procedures and/or issue a warrant for his arrest,” Barcinas wrote in his order.

Kim posted $10,000 cash bail.

He was indicted on charges of three counts of third-degree criminal sexual conduct and four counts of fourth-degree criminal sexual conduct.

A soccer player for a South Korean soccer team charged with sexual assault on Guam after a woman told local police he raped her in a hotel asked the court to allow him to return home pending his trial.

Superior Court of Guam Judge Arthur Barcinas said Tuesday he will decide at a later time if Byong Oh Kim will be allowed to leave Guam for South Korea. 

Kim is accused of sexually assaulting a woman inside a room on Jan. 22 at the LeoPalace Resort. He was indicted on charges of three counts of third-degree criminal sexual conduct and four counts of fourth-degree criminal sexual conduct.

Kim is an active duty member of the Korea Armed Forces Athletic Corps, according to the defense’s court filings translated into English. He’s also a player for the Sangju Sangmu soccer team, which was on Guam in January for training, according to a news release from the soccer team. 

“Kim is a member of the Korean Army and is currently AWOL because he could not return to his unit,” stated his attorney, F. Randall Cunliffe.

Col. Hyeon-Cheol Park, an officer with the South Korean Ministry of National Defense, at Tuesday’s hearing, said Kim is expected to be discharged from the military on Sept. 4, if they don’t add time for the weeks he’s been absent.

When he’s discharged, he will be a free man, according to Park.

Cunliffe said military duty is mandatory in South Korea.

The prosecution opposed releasing Kim to South Korea. Assistant Attorney General Sean Brown said the woman accusing Kim said she is “very scared” and feels less scared because Kim is currently on Guam. The woman lives in South Korea, documents state.

Brown also said there’s no way to ensure the woman’s safety if Kim is in South Korea, the probation office on Guam isn’t able to monitor him there. If Kim violates his conditions, there’s no way to investigate it, Brown said.

“Once Kim leaves the island, there’s no guarantees for his return,” Brown said.

Park said that if Kim is allowed to go back to South Korea, he will be restricted to the military base and they will ensure he returns to Guam for his court hearings and the trial in August. “My country will guarantee he will come back for court,” Park said.

There wasn’t an interpreter for Kim at Tuesday’s hearing. Barcinas said he will schedule another hearing when an interpreter is available.

Cunliffe in court filings said Kim’s military base is in central South Korea and the woman accusing him of sexual assault was attending college in Pusan which Cunliffe said was in the southern part of South Korea and far from where Kim is stationed.

Kim is currently on pre-trial release after posting $10,000 cash bail.

A Superior Court of Guam grand jury this week returned a true bill indictment against South Korean soccer player Byong Oh Kim, charging him with additional counts of sexual assault.

Kim, 29, was initially charged in a magistrate’s complaint with one count of third-degree criminal sexual conduct and one count of fourth-degree criminal sexual conduct.

The grand jury on Thursday charged Kim with three counts of third-degree criminal sexual conduct and four counts of fourth-degree criminal sexual conduct. All the counts relate to the same incident, alleged to have happened on Jan. 22.

A Jan. 9 news release from the team stated members would be on island for training until Jan. 26.

LeoPalace Resort

Kim is accused of sexually assaulting a 22-year-old woman at LeoPalace Resort, according to the magistrate’s complaint.

Court documents state the woman was asleep in a hotel room, and at about 2 a.m., she awoke to Kim rubbing her stomach and breast. She alleged Kim took off her underwear and had sex with her. She “froze and did not know what to do,” the court complaint states.

The woman also alleged Kim carried her to the restroom and had sex with her again, documents state. She told authorities that she screamed and Kim reportedly covered her mouth, so she bit Kim’s hand, the court complaint states.

The woman reportedly “ran out of the room yelling for help,” and Kim chased after her, court documents state.

Defense: Hotel footage contradicts allegations

She found a security guard, who called police, court papers state.

Kim’s attorney, F. Randall Cunliffe has said security footage from the hotel tells a different story.

Cunliffe said security video shows Kim, the woman and another man walking calmly from the elevator, and the woman wasn’t screaming as described in court documents.

Kim has been released on a $10,000 cash bail. He’s not allowed to leave Guam without permission from the court, and his passport was confiscated.

His next hearing is an arraignment on Feb. 7.

Guam – A professional Korean soccer player is facing felony charges of criminal sexual conduct after being accused of raping a woman as she slept in a hotel room.

Kim Byung-oh, 29, spent the night in jail earlier this week following allegations that he sexually assaulted a 23-year-old woman known to him.  The crime occurred, according to the woman, while she slept in a hotel room at the Leo Palace Resort.

Court documents say the woman awoke to find Kim rubbing her stomach and breast, before taking off her undergarments and raping her. She alleges that he then carried her into the restroom where he continued to rape her.

As the victim “let out a scream,” court documents continue, Kim covered her mouth with his hand in an attempt to keep her quiet. The victim then bit her alleged attacker’s hand allowing her to break free and run out of the room.  It is further alleged that Kim chased after her in an attempt to prevent her from getting assistance. However, the victim was able to locate a security guard who then contacted authorities.

Kim is listed as a forward on the Sangju Sangmu team which is part of South Korea’s professional association soccer league.  He has been charged with third degree criminal sexual conduct as a second degree felony and fourth degree criminal sexual conduct as a misdemeanor.

Kim has since posted bail $10,000. His next hearing is on February 2.

A soccer player for a professional South Korean team was charged with sexually assaulting a woman at LeoPalace Resort Guam this week, according to a magistrate’s complaint recently filed in the Superior Court of Guam.

Byong Oh Kim is listed as a forward for the Sangju Sangmu team, according to the team’s official website.

Police in the early morning hours on Monday responded to LeoPalace in Yona, where they met with a 22-year-old woman who alleged Kim raped her in a hotel room, court documents state.
