A drama student accused of mowing down a young mother before ditching her car has admitted she was high on drugs at the time of the alleged hit and run. 

Police allege Nakeisha Shaneye Smith, 20, hit Olivia McKay with her Honda on April 26 in Midland, Perth – leaving the mother-of-one with a broken leg. 

Smith then allegedly dumped her blue 2005 Honda Accord, leading to a two-and-a-half-week police hunt for the driver. 

She appeared in Midland Magistrate’s Court on Thursday where she admitted: ‘I was on drugs’.

Ms McKay was walking with a friend on a footpath about 6.30am when Smith’s Honda mounted the curb and struck her.

Smith, who attends the prestigious Western Australian Academy of Performing Arts, then allegedly drove off.

She was charged with grievous bodily harm with intent after police managed to track her down.

The court heard Smith and Ms McKay were in the same friendship circle, but the pair aren’t close.

Ms Smith’s lawyer said her client planned to check in to a Carlisle drug rehabilitation facility once released from custody. 

Magistrate Kevin Tavener said despite the charges being serious, he granted Smith bail after a police prosecutor agreed to it with strict conditions.

The incident left Ms McKay so badly injured she needed to have her ankle pinned back together. 

The young mother said she only remembered waking in excruciating pain.

‘I don’t remember anything other than waking up… I was screaming, I’ve never been in so much pain before in my life,’ she told The West Australian. 

Smith will appear in court again on June 11.

Mr Moore resigned from the WA Police force in 2018, after being jailed for unrelated offences.

The state prosecutor alleged Mr Moore’s modus operandi was to meet women on dating sites, gain their trust, engage in a consensual sexual relationship, and then use a drink to drug them and conduct “depraved sexual acts” upon them without their consent.

The alleged acts – which Mr Moore recorded – included chaining the victims up, urinating on them, inserting objects into their bodies, and forcing sexual interactions with a dog.

“The women didn’t pass out, but they reached a stage where they couldn’t consent,” the state prosecutor said.

The state opposed bail due to concerns Mr Moore would reoffend or try to contact his alleged victims to encourage them not to give evidence.

His lawyer, Mark Andrews, said Mr Moore would be pleading not guilty to all charges against him, claiming the sexual acts, which while “depraved”, were consensual and done in the context of sadomasochistic relationships.

He noted any trial for Mr Moore to prove his innocence would be at least 18 months away, and that bail should be granted – with strict conditions that prohibit him from accessing the internet or contacting the complainants.

He said one of the new complainants attended Mr Moore’s 50th birthday after the alleged offences had taken place, another, he claimed, was evidently consenting to being filmed.

Mr Andrews said some of the new complainants also claimed to have remembered conversations with Mr Moore while drugged – including one who alleged he had sex with her in a car, telling her, “It will be ok, you’ll enjoy it”.

Another of the new complainants, Mr Andrews said, was a jilted ex-girlfriend.

The Magistrate reserved her decision on whether to grant Mr Moore bail to next week, with the 50-year-old to be held in custody until then.

At the time of his arrest in May, Acting Inspector Simone Van Der Sluys said she believed Mr Moore may have used his position as a police officer to pressure and intimidate the women in their 40s, which was why the alleged offending had not come to light sooner.

“I think they were embarrassed. I think there’s a lot of dynamics that exist here for victims of a sex crime and also to add to that, him being a police officer,” she said.

“I want to stress and assure any women out there who are grappling with that decision, any information they supply to police, it is their decision if they want to go to court.”

On Friday, WA Police spokeswoman Susan Usher said the investigation into Mr Moore was still ongoing, and they believed some victims were still yet to come forward.

“Women who have concerns they have been a victim of an assault but who do not wish to speak to police can seek support from the Sexual Assault Resource Centre (SARC) on 6458 1828,” she said.

Sex Assault Squad detectives are urging anyone with information to contact police via Crime Stoppers on 1800 333 000 or make a report online.

Fallen AFL champion Ben Cousins is facing 15 charges including aggravated stalking and breaching a restraining order after being arrested again in Perth.

The former West Coast Eagles captain was taken into custody on Wednesday after allegedly being found with methamphetamine in the suburb of East Victoria Park.

Police had earlier been searching for a vehicle that was seen driving erratically in nearby inner-southern suburbs.

Cousins, 41, was allegedly found in possession of 2.5 grams of meth.

He has also been charged with aggravated stalking and 13 charges relating to the breaching of a restraining order between April 2 and April 15.

Those charges do not relate to yesterday’s incident and the victim is known to Cousins, police said.

He was refused bail and will face Armadale Magistrates Court today.

The former premiership player and Brownlow medallist has been in and out of prison in recent years as he struggled with his meth addiction, and served almost a year behind bars for stalking his ex-partner Maylea Tinecheff.

He had been scheduled to face a trial last September over more alleged family violence offences, but after charges of stalking and threatening to harm Ms Tinecheff were dropped, he pleaded guilty to 12 lesser offences.

He was sentenced to eight months in prison but it was backdated and with time already served, he was able to walk free in August.

His lawyer Michael Tudori said at the time his client was doing well and continuing to self-fund his rehabilitation with the Whitehaven Clinic, saying it was “a long road to recovery”.

The teenager made a brief appearance from custody at Perth Sheriff Court and made no plea or declaration in relation to the murder charge.

The case against him was continued for further investigation and Kmieciak was remanded in custody after making no motion for bail.

Kmieciak, from Perth, is alleged to have struck Mr Rymackiewicz on the body with a knife and murdered him at Wallace Court in Perth at the weekend.

The street was cordoned off by police after the incident on Saturday night and a series of door-to-door inquiries were carried out by officers from Police Scotland.


Detective Inspector Brian Geddes, who is leading the investigation, said: “I would like to reassure the local community that this was a contained and isolated incident and at no point was there any threat posed to any other member of the public.

“Our thoughts are with the family and friends of the man. I would like to thank people who live nearby for their patience.”

It is understood that a number of people had been within the Wallace Court property for a Christmas celebration on Saturday.

A Gofundme page in honour of East Fremantle father Charles McCarthy has attracted heartfelt tributes and more than $45,000 in donations from across Australia and his native Ireland.

The page was created by Alan Ahern who wrote that Mr McCarthy was “one-of-a-kind” and that the lives of wife Nicole and young children Clara and Niall had “changed forever” following his death two days before Christmas.

Mr Ahern said his mate’s “quick laugh lit up every room” and that he adored, and was adored by, his children.

“A wonderful husband, an incredible father, and the most loyal friend you could ask for,” Mr Ahern’s tribute reads.

“He is irreplaceable and will be forever missed.”

The fundraising page smashed its $30,000 goal in fewer than 24 hours with more than 440 people donating and sharing their memories of the 32-year-old Irish migrant, who is originally from Cork.

In messages from around the globe Mr McCarthy was described as a kind and loving soul taken far too young.

“You were a true gent. Life is so cruel. May you rest in peace Charlie,” wrote Yvonne Foley.

Mr McCarthy was allegedly struck in the head with “an object” by fisherman Andrew Doan while walking along Riverside Drive with his wife and a friend in the early hours of December 23.

He spent three days at Royal Perth Hospital, brother Daniel and sister Siobhan travelling to Perth to be by his side when the life support machine was switched off on Boxing Day.

Mr Doan maintains his innocence and his lawyer has indicated in court the 34-year-old would argue he had been “charged” by Mr McCarthy and that his actions on the night were in self-defence.

Back in Mr McCarthy’s hometown, the Aghada Gaelic Athletic Association has opened a book of condolences for its former player.

Club secretary Darren Lee said on Facebook those associated with the club were deeply saddened by Mr McCarthy’s death.

“Charlie joined us in his teenage years and had a positive impact with his energy, dedication and attitude throughout his time in the club,” said Mr Lee.

“On moving to Australia, he continued to wear the club colours with pride and celebrated club successes like so many at home and abroad.

“What is clear from listening to those who knew him best was that the dedication and energy we experienced on the pitch, was small compared to his dedication for his wife Nicole and their children Ciara and Niall.”

Money raised by the GoFundMe page will be used to cover unexpected expenses, with the remainder set aside in a trust for Mr McCarthy’s children.
