Former NFL wide receiver Antonio Brown will serve two years of probation, attend a 13-week anger management program and undergo a psychological exam as part of a plea deal relating to a January incident at Brown’s Hollywood home involving a moving company truck driver.

On Friday, Brown changed his plea to no contest on charges of burglary with battery, burglary of an unoccupied conveyance and criminal mischief, which means he will accept the sentence but did not admit guilt.

The order issued by Broward Judge Edward Merrigan Jr. also requires Brown to complete 100 hours of community service and restrict his travel to within the United States for work purposes. Merrigan withheld adjudication, meaning Brown will not be convicted of a crime.

On Jan. 21, the driver of a moving truck arrived at Brown’s Hollywood home to deliver his household goods from California.

Soon after, the driver called police to report a vandalism, saying Brown threw a rock at his truck. The driver told police that Brown paid the $4,000 he owed for moving, but refused to pay $860 for the damage and his time, according to the police report. The driver also told police that Brown grabbed him and pulled him during the struggle.

Recently released dashcam video of the tussle in the cab of the moving company truck showed the reflection of Brown entering the cab and shouting at the driver. Then the video showed what appeared to be a tussle.

Glenn Holt, Brown’s trainer, was arrested on Jan. 21 and charged with one count of burglary with battery.

Brown, who grew up in Liberty City and graduated from Miami Norland Senior High, refused to speak to officers and a warrant was issued for his arrest. The next day Brown turned himself in. He had been out on a $110,000 bond since January 24. He originally pleaded not guilty to all charges.

“Rather than engage in a protracted legal case, Antonio decided to resolve this matter in an expeditious manner,” his attorneys said in a news release Friday.

In recent months, Brown, who was traded from the Pittsburgh Steelers to the Oakland Raiders after a 2019 off-season and then released before the season began, has been in the spotlight. He was picked up by the New England Patriots, but was cut after only playing one game. A former trainer filed a lawsuit alleging sexual assault.

Then eight days before the moving company truck incident, Hollywood police were called to Brown’s home after an altercation involving Brown’s ex-girlfriend, Chelsie Kyriss. Brown was not arrested, but police say Brown waved penis-shaped gummy candies at officers while calling them “a bag of d—-.”

Alana Burstyn, an adviser for Antonio, said in a statement Friday that “with this matter now resolved, Antonio looks forward to continuing his cooperation with the NFL and resuming his professional career.”

BROOKFIELD, Wis. (CBS 58) — Former Brookfield Central High School basketball player Gage Malensek entered a plea agreement Monday, Feb. 24. 

He pleaded guilty to two felony drug charges, and six other felonies and misdemeanors were dropped.

Police say Malensek sold marijuana and THC vape cartridges to undercover officers and gave items to another boy to sell.

Malensek will return to court for sentencing on March 20.

Fallen AFL champion Ben Cousins has pleaded not guilty to a string of new charges, including aggravated stalking, but faces months behind bars in Perth after his bail bid was rejected.

During a minor outburst in Armadale Magistrates Court today, the former West Coast Eagles captain and drug addict said “that’s not fair, Your Honour” as his bail application was refused.

Magistrate Brian Mahon warned Cousins his video link from Hakea prison would be muted if he was not quiet.

Mr Mahon said it gave him “no pleasure” to conclude there were no conditions he could impose that would stop Cousins from offending if he was released on bail.

“On analysis of Mr Cousins’ record, he endures a difficulty with methamphetamine, well known to the community,” he said.

“I am saddened that you endure such an issue with methamphetamine.”

Mr Mahon also noted Cousins had 22 convictions for breaching a violence restraining order and 20 of those offences resulted in a prison sentence.

Cousins, 41, repeatedly said “oh no” and ran his hands through his hair in frustration as Mr Mahon concluded his comments on the bail application.

The premiership player was arrested on Wednesday after allegedly being found with about 2.5 grams of methamphetamine in East Victoria Park.

Police had earlier been searching for a vehicle that was seen driving erratically in nearby Kensington.

Cousins pleaded guilty to the drug offence and was fined $1500.

The court has heard whenever Cousins faces a crisis he turns to drugs for comfort, as it is the way he deals with stress in his life.

The Brownlow medallist was also charged with aggravated stalking and 13 counts of breaching a violence restraining order between April 2 and 15.

He pleaded not guilty to those charges, which relate to his ex-partner Maylea Tinecheff, whom he allegedly tried to contact via phone calls and text messages more than 100 times.

Cousins’ lawyer Michael Tudori previously told the court those charges were different to the ones Cousins previously spent almost one year in jail for, as there were no threats involved.

Mr Tudori said Cousins had been spending time with his children under a parenting plan, but less than one month before the alleged offending, Ms Tinecheff ceased all communication.

It came after Cousins participated in a paid TV documentary about his family, substance abuse and time in jail.

Mr Tudori said although he could not currently present a signed copy of the parenting plan, it had been signed in September and would be part of the trial.

The police prosecutor argued even if there was a parenting plan, Cousins’ behaviour was inexcusable, alleging he once visited Ms Tinecheff’s home at 8pm wanting to speak to his two children.

Mr Mahon said he did not know with certainty that a signed parenting plan existed.

Cousins was remanded in custody until his two-day trial starting on October 28.

A negotiated guilty plea deal by a former Covington Catholic High School basketball player will enable the victims, four teenage girls, to avoid the publicity of a trial.

Joseph Eubank pleaded guilty in court Wednesday to one count of rape and three sex abuse charges.

The 17-year-old was charged as an adult in the rape of a teenage girl and sex abuse of three others. He was indicted Nov. 7, 2018, according to court documents.

 “Avoiding publicity that inevitably surrounds a case like this was very important to some of our victims, but I don’t think anyone in their right mind would look forward to testifying in open court about events that are so painful,” said Kenton County Commonwealth’s Attorney Rob Sanders of the plea deal.

Sanders said that each of the four charges pertains to a different victim. Each of those victims, he said, are teenage girls. 

The indictment states the incidents occurred on or between Feb. 1, 2017, and March 31, 2019. Eubank was 14-to-16 years old at the time, Sanders said.

“There are no winners in this case,” Sanders said. “A young man is going to jail for a very long time and several young women are going to be dealing with the emotional scars of his crimes for the rest of their lives.”

The terms of the plea deal are that Eubank will be sentenced to 25 years in prison. The sentence is based upon 10 years on the rape charge and five years on each of the three sex abuse charges.

Sanders said he will be eligible for parole after 8.5 years in prison.

The lengthy prison sentence is deserved because of the number of victims and the defendant’s conduct, Sanders said

“It was done after extensive consultation with the victims in the case and spares the victims from testifying in an open courtroom and brings a quick resolution to the matter,” Sanders said of the plea deal.

Kenton Circuit Court Judge Gregory M. Bartlett will have formal sentencing March 23 after a sex offender evaluation is conducted, Sanders said.

The guilty plea shows victims in sex abuse cases can confidently decide to come forward, he said.

“They will be taken seriously and  we will fight for justice on their behalf,”

FLORESVILLE — A former La Vernia High School football player, accused in a hazing scandal that led to multiple arrests in 2017, will stand trial after rejecting plea bargains offered Monday by prosecutors with the Texas Attorney General’s Office.

About a dozen other accused athletes, both juveniles and adults, have accepted plea deals, bringing resolution to all but one of the criminal cases that roiled the small Wilson County town.

Alejandro Ibarra, now 20, rejected two offers from Assistant Attorney General Sharon Pruitt. Visiting Judge Donna Rayes scheduled Ibarra’s trial for July 13 and lawyers anticipate it will last four days.

Defense lawyer Adrian Perez requested one more chance for his client to accept a plea deal closer to trial, but a visibly frustrated Pruitt said all offers would expire Monday, adding, “Today’s our day.”

Ibarra was among 13 students arrested or detained in the case, which the La Vernia police chief at the time said involved athletes in the high school’s football, baseball and basketball programs. They were variously accused of using objects to violently sodomize at least 10 newer varsity teammates in so-called initiations.

Local officials at the time said the practice might have started in the 2014-15 school year. A federal lawsuit against the school district brought by families of the victims is expected to go to trial in February.

A grand jury indicted four men who were adults at the time of the incidents: Ibarra, Dustin Norman, Colton Weidner, and Christian “Brock” Roberts, on second-degree felony charges of engaging in organized criminal activity. Each could have faced as many as 20 years in prison.

Norman, 21, Weidner, 20, and Roberts, 20, pleaded no contest to lesser charges of unlawful restraint, a state jail felony, avoiding prison time under agreements with prosecutors. Weidner and Roberts last month were ordered to serve five years of deferred adjudication probation, while Norman on Monday was given three years deferred adjudication. The three can avoid convictions on their records if they successfully complete the terms, and can ask for early release after completing community service hours and paying fines and court fees.

Two other adults and several juveniles who were charged also avoided jail time. In October, Robert Olivarez Jr., 20, pleaded no contest to unlawful restraint and drew five years of deferred adjudication. On Monday, John Rutkowski, 20, was allowed to plead no contest to hazing, a class B misdemeanor, in exchange for one year’s deferred adjudication.

Weidner’s lawyer, Stephen Barrera of Floresville, said the sentences were appropriate.

“A lot of guys that were accused are also victims” of previous hazing, he said.

Pruitt told the court that Ibarra was offered three years of deferred adjudication probation and a shot at early release if he would plead to the state jail felony of unlawful restraint. When he declined, the prosecutor offered 30 days in the county jail and a plea on a misdemeanor level of unlawful restraint, but Ibarra again rejected it.

Ibarra requested one year of probation for the misdemeanor charge, but Pruitt would not offer less than two years with the misdemeanor, Perez said.

He could not say why his client wouldn’t take the offers, and added, “Frankly, I might not even know.”

Ibarra was quick to defend himself on social media after his arrest. He commented on Facebook posts saying he, Norman and Olivarez were innocent.

“They didn’t do anything. … I was with them every day and we were never involved in this stupid s—t!” Ibarra wrote on the Facebook page of a local reporter for San Antonio’s Telemundo affiliate.

After the hearing, Perez apologized to the prosecutor for the back-and-forth negotiations over two hearings beginning in November.

LANSING, MI – Three former MSU football players charged with criminal sexual conduct pleaded down to a lesser charge of “seduction” on Wednesday, leaving even some legal experts asking: what’s that? 

It’s an old law on Michigan’s books that states, “Any man who shall seduce and debauch any unmarried woman shall be guilty of a felony,” punishable by 5 years in prison and/or a fine of $2,500. Versions of it have been on the books since 1846, and it hasn’t been updated since 1931.  

But the Ingham County Prosecutor’s Office dusted off the outmoded statute on Wednesday in a plea deal for ex-MSU football players Josh King, Donnie Corley and Demetric Vance. Each pleaded to seduction, and King to an additional felony charge of surveilling an unclothed person. They had initially faced criminal sexual conduct charges.

On top of being old, the use of the this law is rare.  

“In my almost 30 years as a lawyer and my 15 years as a prosecutor I never once prosecuted a seduction case,” said Lisa Halushka, assistant dean and professor at Western Michigan University Cooley Law School.  

It’s “outdated,” she said, and she’s not the only one who thinks so. 

Ingham County Prosecutor Carol Siemon in a statement issued after the hearing acknowledged the law was “archaic.”

“The use of ‘seducing and debauching an unmarried female’ as a plea is one that prosecutors have used consistently, but infrequently in the State of Michigan. The law itself is archaic and while the statute itself is valid, it certainly was originally enacted in a bygone era,” Siemon said.  

“The plea to seduction is a tool that we have as prosecutors, but it is an imperfect tool. It allows the criminal justice system to acknowledge the victim, and it provides an incentive for that offender to plea, in particular because it’s not an offense that requires that they register as a sex offender.”  

The Prosecuting Attorneys Association of Michigan does not have statistical information about the use of that statute, according to Director of Public Affairs KC Steckelberg.  

Before its use on Wednesday, the law had caught the attention of websites that compile strange laws, as well as some Michigan attorneys.  

Attorney Evan Chall, with Farmington Hills-based Wright Beamer, included it in a 2015 list of “Michigan laws that might surprise you” on the firm’s blog.  

He’s not a criminal attorney but ran a search and was unable to locate any recent published cases involving it. 

“I’m actually surprised to learn that there’s a case involving a plea bargain under this particular statute. I think there are some constitutional questions surrounding this statute; however, those questions are unlikely to be resolved in the present context, since the parties have apparently agreed upon its application,” Chall said.  

The law’s existence also wasn’t a surprise to Kahryn Riley, director of the Mackinac Center for Public Policy’s criminal justice policy initiative. She reviews Michigan laws for what she calls “overcriminalization.” As of the center’s 2015 review there are 3,100 laws on the list, along with a slew of regulatory rules.  

It’s led to a situation where, “you’ve got more offenses than the government could reasonably enforce, and you’ve got more laws on the books than citizens could reasonably follow,” she said.  

Michigan has so many crimes, you may not know you’re committing one  

Rep. Peter Lucido, R-Shelby Twp., is a member of the Michigan Law Revision Commission, a group charged with cleaning up the old laws on Michigan’s books. The legislature has repealed other old-timey laws, but this specific seduction charge is new to him.  

“I’ve never heard of the crime. I’ve done criminal law for 30 years,” Lucido said.  

Lucido said the Michigan Law Revision Commission hadn’t had that law brought up. But it strikes him as being similar to other crimes he has heard of, like adultery.  

“Why have old laws on the books that you’re never going to enforce?” He said.

LANSING – Three former MSU football players accused of sexually assaulting a female student during a party pleaded guilty to lesser charges of seduction as part of an agreement with prosecutors.

Josh King, Donnie Corley and Demetric Vance each faced sexual assault charges stemming from an incident during a party at a campus apartment in January 2017. They were charged in June and dismissed from the football team.

The agreement, made public in a hearing before Ingham County Circuit Judge Rosemarie Aquilina this morning, calls for all three to have no up-front jail time. 

Their court records also would become non-public under a Michigan law that allows judges to close the records of young offenders as long as they meet the terms of their agreement and do not commit any future offenses. Aquilina said during the hearing that she was granting Holmes Youthful Trainee status to all three.

They can withdraw their guilty pleas if Aquilina includes jail time in their sentences, which are scheduled to be set in a hearing at 8:30 a.m. on June 6.

Ingham County Assistant Prosecutor Steve Kwasnik said the victim had been consulted and approved of the terms of the plea agreements.

Shannon Smith, King’s attorney, declined to comment. Attorneys for the other two players couldn’t be reached for comment immediately following the plea hearing.  

The seduction charge is a felony with a maximum sentence of up to five years in prison. It involves seducing an unmarried woman for sexual acts.  

Under the agreement, King, of Darien, Illinois, also pleaded guilty to a charge of surveilling an unclothed person. He originally faced the most serious charges:  one count of first-degree criminal sexual conduct and one count of third-degree criminal sexual conduct, and capturing an image of an unclothed person. He faced up to life in prison if convicted.

Corley and Vance both of Detroit, had been charged with third-degree criminal sexual conduct. They each faced up to 15 years in prison if convicted.

Michigan State University Police said at a hearing that led to the charges that the victim reported King invited her to “speak somewhere quiet,” then “pulled” her into a bathroom and forced her to perform oral and vaginal sex; Corley and Vance were each accused of later forcing her to perform oral sex. 

Police also allege that King recorded himself having sex with the woman.

The former players, who had been suspended from the team during the police investigation, were dismissed from the football team after they were charged in June. They were also dismissed from MSU following university Title IX investigations.  

A fourth former player, 20-year-old defensive end Auston Robertson, awaits trial on two counts of third-degree criminal sexual conduct in connection with a separate incident.

One of the five Wheaton College football players charged in a hazing incident is expected to strike a plea deal Thursday.

Noah Spielman, 21, was expected to enter a plea, prosecutors said, declining to reveal further details of the deal.

Spielman, of Columbus, Ohio, is charged with aggravated battery, mob action and unlawful restraint in connection with a hazing incident that occurred in March 2016, authorities said.

He and four other football players are accused of forcibly taking a freshman teammate from his dorm, tying him up with duct tape, beating him and then leaving him half-naked in a baseball field, officials said.

Investigators and the victim’s attorney say the freshman player, who identified himself as Charles Nagy, had tears in his shoulders from the incident that required surgeries to repair.

Last week, the Chicago Tribune reported Nagy filed a lawsuit against Wheaton College and seven players – not including Spielman, who is the son of former NFL linebacker Chris Spielman.

That lawsuit alleges that freshman players were regularly hazed and the team’s coach as well as school officials were aware of the hazing.

Spielman was expected to appear before a judge at the DuPage County Courthouse Thursday morning.
