Eight men were arrested early on Wednesday morning in connection with the theft of R2,7-billion at VBS Mutual Bank between 2015 and 2018. The National Prosecuting Authority issued a racketeering certificate in which the group is accused of being instrumental in the fleecing of the bank’s resources and its ultimate implosion. They will be prosecuted for a broad range of crimes, including allegations of racketeering, corruption, money laundering, fraud, bribery and theft, Scorpio was told.

Four bankers, two officials from the Public Investment Corporation (PIC), a KPMG auditor and a lieutenant-general in the South African police have been arrested in connection with their instrumental role in the theft of over R2,7-billion from VBS Mutual Bank, a bank mainly catering for the poor. This group includes four chartered accountants and an attorney.

Those arrested are:

  • Tshifhiwa Matodzi, chairman of VBS and Vele Investments (a company which obtained the majority shareholding in VBS through an alleged scam);
  • VBS treasurer Phophi Mukhodobwane;
  • VBS CFO Philip Truter;
  • non-executive directors of VBS and nominees of the PIC Ernest Nesane and Paul Magula;
  • KPMG auditor Sipho Malaba;
  • CEO and executive director of VBS Andile Ramavhunga; and
  • VBS non-executive director and chair of the bank’s audit committee, lieutenant-general Avhsahoni Ramikosi.

This marks the first arrests in the VBS scandal after Advocate Terry Motau and law firm Werksmans at the behest of the SA Reserve Bank investigated what looked like a “liquidity issue” in 2018. In October that year, Motau and Werksmans announced that the bank was actually robbed into insolvency. Investigators fingered the bank’s managers, auditors, attorneys, politicians and fixers as the main beneficiaries of the scam.

Under the guise of a legitimate business the men participated in a “pattern of racketeering activity”, the National Prosecuting Authority (NPA) said. This refers to the planned, ongoing, continuous and/or repeated participation or involvement of several offences which aimed to hoodwink the bank (and ultimately its depositors) out of their money.

They will be charged and prosecuted under the Prevention of Organised Crime Act (Poca) of 1998.

The lead prosecutor in the case is the highly experienced deputy director of public prosecutions Advocate Hein van der Merwe.

The Hawks and a task team of investigators and prosecutors have been investigating the orchestrated theft at VBS for months. Their colleagues in the NPA have sung their praises, saying “South Africa has really good prosecutors and investigators who worked very hard on this matter to ensure we bring justice for the bank’s poor depositors”.

Racketeering is a complex crime – it essentially refers to the group activity of running and hiding a criminal enterprise while deriving benefit from it. A group of people can be prosecuted for racketeering when at least two concomitant crimes mentioned in Prevention of Organised Crime Act (Poca) are present. This ensures that the definition of racketeering is extremely broad. The Constitutional Court has considered and upheld the broad nature of Poca, saying the act “seeks to ensure that the criminal justice system reaches as far and wide as possible in order to deal with the scourge of organised crime in as many of its manifestations as possible”.

This ensures that even when a person only knew of – or reasonably ought to have known of – a racketeering enterprise they can be found guilty of a crime.

The crime of racketeering carries the penalty of a fine not exceeding R100-million and/or imprisonment for up to life behind bars.

In the judgment of State vs Phillip Nsofor delivered by the High Court in Gauteng on 2 November 2018 – where the appellant was sentenced to 25 years imprisonment – the court explained that “heavy sentences for racketeering” are based on the fact that the crimes committed are organised and planned over time, “which is regarded as more reprehensible and damaging to a society than a person who yields to temptation to commit crime”.

The eight VBS-looters

Tshifhiwa Matodzi was fingered by Motau and Werksmans as the most central character in the scam that fleeced VBS of its resources. Matodzi ordered and orchestrated the flow of over R325-million in VBS money to companies and people associated with him. He used multiple fronts to hide his role in these crimes, Motau found. He was the chairman of both VBS and a company called Vele Investments, which obtained the majority shareholding in VBS through a scam, Motau found. Matodzi baldly denied any wrongdoing, but WhatsApps and internal documents Scorpio has seen shows how Matodzi ordered his co-accused to distribute VBS money to companies and individuals involved in the secret

Matodzi accused his right-hand man, former VBS treasurer Phophi Mukhodobwane, of the VBS crimes. Mukhodobwane admitted under oath to Motau to have played a central role in manipulating the banking system and fraudulently misrepresented the bank’s financial position while fleecing VBS of its resources over the course of about four years. Along with his co-accused, Mukhodobwane acted on Matodzi’s instructions, WhatsApp-discussions Scorpio has seen, show. In several instances, for example, Matodzi ordered Mukhodobwane to pay millions of VBS-rand to the front company of EFF leaders Julius Malema and Floyd Shivambu, adding that they were “lobbying fees”, that the account was “extremely strategic” to the business of VBS and that “they” were under “pressure”.  He allowed over R30,5-million in cash and banking facilities to be channelled towards front companies and people linked to him. Matodzi bought a helicopter and Ferrari while living the high life on his VBS riches.

On paper, Mukhodobwane reported to former VBS CFO Philip Truter, but WhatsApp-discussions between the two suggest that it was, in fact, Mukhodobwane who pulled Truter’s strings. Truter admitted to having participated in the manipulation of the VBS banking systems, and along with his co-accused made fraudulent misrepresentations in VBS’ 2017 annual financial statements, while lying to the Reserve Bank by submitting fraudulent DI returns. Truter received R5,8m for being a team player. His testimony can tie several of his co-accused to the crime.

Former KPMG auditor Sipho Malaba helped Truter to hide the black hole in VBS’ finances. He received more than R33,9-million for his trouble. Malaba was a qualified chartered accountant who was KPMG’s engagement partner on the 2017 VBS audit. Malaba had obtained substantial facilities from VBS which were not at arm’s length. He was severely compromised, borrowing from the bank that he audited. Malaba also signed off on the fraudulent annual financial statements and lied to the Reserve Bank in VBS’ DI returns. He spent his VBS riches on Land Rovers, a Mercedes Benz, properties, and paid off his debt with big cash transactions.

Matodzi further bought the silence of two nominees from the PIC – attorney Ernest Nesane and Paul Magula. They were both non-executive directors at VBS and was tasked with guarding the PIC’s investment.

Nesane was the executive head for legal counsel, governance and compliance at PIC. He eventually confessed his misdeeds to Motau, after putting up strenuous denials. He resigned from the PIC two days after testifying to Motau. Nesane received R16,64-million in VBS-loot with which he acquired a BMW and property. Nesane used two bagmen who acted as fronts to hide his hand in the bank robbery.

He testified to Motau, saying “we received these payments, and it had become clear that these payments were for us so that we would not really raise any issues when there were issues that we would ordinarily have to raise”.

The second PIC nominee, Magula, was a non-executive director of VBS and the executive head of risk management at the PIC. He too confessed, after putting up strenuous denials at first. Magula received R12,89-million for being a team player and spent it on cars, property, and a home renovation. He, too, used a bagman to launder money and hide his hand in the VBS crimes.

Former executive director and CEO of VBS Andile Ramavhunga steadfastly denied his involvement in the VBS crimes. Yet he received R28,9-million, which he described as “consultancy fees”. Ramavhunga was a banker by profession. Motau described the weight of evidence against him as damning. His finances suggest that Ramavhunga bought a Land Rover, Mercedes Benz and a lot of fast food with his VBS riches. He also channelled millions of rand in cash to his private Investec account.

A former lieutenant-general in the police, Avhashoni Ramikosi, was the eighth to be arrested on Wednesday morning. He was a non-executive director of VBS, chair of the audit committee, SAPS’ CFO and a chartered accountant. Ramikosi eventually confessed to having received unlawful payments made to a front company. His price was “significantly lower” than his co-accused, Motau found, having only received about R5,9-million in VBS-loot. DM

MIRAMAR (CBSMiami) – Two NFL players arrested in South Florida had their first court appearance Sunday.

Deandre Baker and Quinton Dunbar are facing multiple armed robbery charges.

A judge allowed bond for both Baker and Dunbar despite the state’s wishes.

Baker’s bond was set at $200,000 while Dunbar was offered bail at $100,000.

However, they are not allowed to have contact with witnesses and must turn over and firearms they own.

Both men are expected to be released sometime Sunday. Their lawyers mentioned during the hearings that both Baker and Dunbar had no criminal history.

The men turned themselves into police on Saturday after warrants were issued for their arrests.

Investigators said it all stems from an incident at a house party in Miramar Wednesday night.

One of the witnesses told police that “attendees were playing cards, video games and gambling” when an argument broke out involving Baker. The witness said Baker flipped the card game table, and then pulled out a gun as did Dunbar.

Baker, Dunbar, and two other men, one identified only as “Shy” began robbing other people at the party of thousands of dollars in cash, luxury watches, and other valuables, witnesses told investigators.

Police said the four men then fled the home in three vehicles: a Mercedes Benz, a Lamborghini, and a BMW. Witnesses said the vehicles were parked in a way that would make it easy to leave quickly, leading detectives to believe the robbery was planned. No injuries were reported.

Dunbar‘s attorney Michael Grieco said, “He did not participate in any robbery.” He said that 4 alleged victims and a witness changed their stories saying “…any robbery or assault did not involve Mr. Dunbar…” that “…he fled the home.”

Baker and Dunbar are both from Miami.

Baker was one of three first-round draft picks the Giants had last season.

“We are aware of the situation. We have been in contact with Deandre,” the Giants said in a statement. “We have no further comment at this time.”

Dunbar signed with the Washington Redskins as an undrafted free agent out of Florida in 2015 and was traded to the Seahawks in March.

“We are aware of the situation involving Quinton Dunbar and still gathering information,” the Seahawks said in a statement. “We will defer all further comment to league investigators and local authorities.”

Dunbar spent Thursday morning on a video conference with the Seattle media for the first time since being traded from Washington to the Seahawks in March.

“You just want to feel wanted at the end of the day. I just hope to repay them with the way I carry myself as a person,” Dunbar said on the video conference.

Baker, a 22-year-old cornerback for the New York Giants, pleaded not guilty on Monday to four counts of aggravated assault with a firearm, as well as to four counts of armed robbery. He and Dunbar, a 27-year-old cornerback for the Seattle Seahawks, turned themselves in to authorities Saturday and were released from jail Sunday after posting bond.

An attorney for Dunbar, Michael Grieco, said Friday that he had affidavits from the same five witnesses whose accounts formed the basis for the arrest warrants. The witnesses recanted their testimonies against Dunbar in the affidavits, according to Grieco.

At a court hearing Sunday, a Broward County prosecutor called the sudden recantations “suspect” and wondered whether the witnesses had been pressured or bribed into changing their stories. Grieco told the Seattle Times that the witnesses came to him and signed the new affidavits “in the presence of a notary.”

“This was not some back alley,” the attorney said. “This was in my office.”

A lawyer for Baker, Brandon Cohen, said Friday on Instagram that he, too, was in possession of “affidavits from several witnesses that dispute the allegations and exculpate our client.” Patrick Patel, another member of his legal team, indicated that those affidavits may be from different people than the original witnesses cited by Miramar police.

“The victims have already recanted against Dunbar, and I wasn’t comfortable going to these victims and getting them to sign papers because they’re already waffling and making up stories,” Patel said Monday to the New York Post.

The arrest warrants said that Baker pulled out a semiautomatic firearm and directed Dunbar and the masked man to take money and valuables from some attendees of the party. Baker also was accused of telling the masked man to shoot someone who had just walked into the Miramar residence, but the man did not. There were conflicting accounts of whether Dunbar was also armed.

Dunbar, Baker and the other man were alleged to have left in three separate cars — a Mercedes-Benz, a BMW and a Lamborghini — that were described as having been parked in a manner that might facilitate a quick escape. That gave witnesses the impression, per the original affidavit, that the robbery was planned ahead of time.

Patel said Baker’s legal team was working on acquiring video that would show the Giants player getting into the passenger seat of his car as a designated driver waited in line with other vehicles to pass through a security checkpoint at the gated community in which the party took pace.

In addition, Patel told the New York Post that far from being part of any dice game or other form of gambling that sparked the robbery, as witnesses had alleged, Baker was playing the “Madden” NFL video game while sitting in another room.

“He doesn’t have anything to do with the ruckus. He didn’t even see it,” Patel said of Baker. “The only thing he sees is out of the corner of his eye a table getting flipped over and everybody running, screaming and yelling. And he’s out. Thank God he bounced.’’

Grieco said Monday (via SI.com) that Dunbar was not even at the residence when the alleged robbery took place.

“I can’t speak to whether or not something happened inside the house,” the attorney said. “I can tell you Mr. Dunbar wasn’t there at the time, if it occurred at all.”

Dunbar, who was traded to Seattle in March from the Washington Redskins for a fifth-round pick, apologized Sunday via social media (per Pro Football Talk) for “any unnecessary distractions that these allegations against me may have caused.”

“In addition,” Dunbar reportedly wrote, “I am very grateful to be apart of a team that supports one another and uphold the credibility of each of its members through adverse situations. Moving forward, this entire situation has taught me how to not associate myself with environments that may mischaracterize my values and who I am.”

Lawyers for both Baker and Dunbar have asked for jury trials, but both have asserted they expect all charges to eventually be dropped. According to NJ.com, future court hearings in the two cases have yet to be scheduled.

Quinton Dunbar and DeAndre Baker have maintained their innocence in a wild story that ended up with each NFL cornerback being accused of armed robbery.

Dunbar, who was traded to the Seattle Seahawks this offseason, made it official.

Dunbar officially pleaded not guilty to four counts of armed robbery, according to Bob Condotta of the Seattle Times. The charges came from an alleged incident in which three men, including the two NFL players, were accused of robbing guests at an illegal dice game in Miramar, Florida.

While the NFL’s conduct policy accounts for instances in which a player avoids a conviction, pleading guilty practically ensures a suspension.

Quinton Dunbar, DeAndre Baker try to make amends with teams

The NFL will still investigate Dunbar and Baker, a 2019 first-round pick of the New York Giants, regardless of what happens in the court system.

Baker was accused of pulling out a gun at the dice game last week and telling Dunbar and a third unidentified man to rob the other guests. Dunbar’s bail was set at $100,000 and Baker’s was set at $200,000. They both made bond and were released.

There are messes for each player to clean up with their respective teams. Dunbar apologized to the Seahawks on an Instagram post for unnecessary distractions. The New York Post said Baker asked the Giants’ vice president of security that his apologies be relayed to teammates and general manager Dave Gettleman. He has been asked to stay away from virtual team meetings.

Baker, Dunbar face multiple charges

Whatever happens legally, the story will be far from over for the cornerbacks.

Their teams and the NFL will have their say when the legal system is done. Baker faces four charges of armed robbery with a firearm and four counts of aggravated assault with a firearm. Dunbar faces four charges of armed robbery.

Dunbar just joined the Seahawks this offseason after a trade with the Washington Redskins. His not guilty plea is just the first step of many.

The attorney for Seattle Seahawks cornerback Quinton Dunbar is claiming his client was never at a cookout at a Florida home where an armed robbery allegedly unfolded.

Michael Grieco tweeted Wednesday night: “If, according to the accusers, our client Quinton Dunbar lost a bunch of money earlier in the week at some gambling party (suggesting he had motive)..why did the organizer text Dunbar about not knowing about the prior party and what went down? Answer: because he wasn’t there. So, did the ‘victims’ accuse the wrong guy of robbery or did they fabricate this motive just like they did the whole rest of the case? Good thing I can account for Quinton’s whereabouts all 3 days prior to the alleged robbery for good measure.”

Grieco included a screenshot of a text from organizer, which said: “You missed some good money yesterday bro dolphin players Dre baker even beat him we beat him out of 10k on the game and then it’s was shooting dice bout another 60k out there”

Dunbar and New York Giants cornerback DeAndre Baker were allegedly attending the cookout last week when a fight broke out, and Baker purportedly pulled out a handgun, according to the warrant. Baker, Dunbar and two other men allegedly began robbing people of thousands of dollars, watches and other valuables, witnesses told investigators.

Baker’s lawyer said Tuesday his client was playing video games when the crime occurred.

Patrick Patel, one of the second-year NFL player’s attorneys, told the New York Post that his client was in a different room when the incident at the home in Miramar occurred.

“Far from an individual who’s going somewhere with an alleged intent to rob somebody, an armed robbery, to go there and hook up his ‘Madden’ game, play the game for over an hour and then leave it there and go home,” Patel told the newspaper.

Dunbar is charged with four felony counts of armed robbery. The Seahawks defender posted a $100,000 bond.

Baker posted a $200,000 bond after a Zoom hearing with Broward Circuit Judge Michael Davis. The New York Giants defender is charged with four counts of armed robbery with a firearm and four counts of aggravated assault with a firearm in the incident.

Baker and Dunbar have both apologized to their teams.

Dunbar signed with Washington as an undrafted free agent out of Florida in 2015 and was traded to the Seahawks in March. He started 11 games for the Redskins last season, making 37 tackles and four interceptions.

Baker was one of three first-round draft picks the Giants had last season. He was the 30th pick overall out of Georgia. He played in all 16 games, starting in 15. He had 61 tackles and no interceptions.

The attorney for Seattle Seahawks cornerback Quinton Dunbar is claiming his client was never at a cookout at a Florida home where an armed robbery allegedly unfolded.

Michael Grieco tweeted Wednesday night: “If, according to the accusers, our client Quinton Dunbar lost a bunch of money earlier in the week at some gambling party (suggesting he had motive)..why did the organizer text Dunbar about not knowing about the prior party and what went down? Answer: because he wasn’t there. So, did the ‘victims’ accuse the wrong guy of robbery or did they fabricate this motive just like they did the whole rest of the case? Good thing I can account for Quinton’s whereabouts all 3 days prior to the alleged robbery for good measure.”

Grieco included a screenshot of a text from organizer, which said: “You missed some good money yesterday bro dolphin players Dre baker even beat him we beat him out of 10k on the game and then it’s was shooting dice bout another 60k out there”

Dunbar and New York Giants cornerback DeAndre Baker were allegedly attending the cookout last week when a fight broke out, and Baker purportedly pulled out a handgun, according to the warrant. Baker, Dunbar and two other men allegedly began robbing people of thousands of dollars, watches and other valuables, witnesses told investigators.

Baker’s lawyer said Tuesday his client was playing video games when the crime occurred.

Patrick Patel, one of the second-year NFL player’s attorneys, told the New York Post that his client was in a different room when the incident at the home in Miramar occurred.

“Far from an individual who’s going somewhere with an alleged intent to rob somebody, an armed robbery, to go there and hook up his ‘Madden’ game, play the game for over an hour and then leave it there and go home,” Patel told the newspaper.

Dunbar is charged with four felony counts of armed robbery. The Seahawks defender posted a $100,000 bond.

Baker posted a $200,000 bond after a Zoom hearing with Broward Circuit Judge Michael Davis. The New York Giants defender is charged with four counts of armed robbery with a firearm and four counts of aggravated assault with a firearm in the incident.

Baker and Dunbar have both apologized to their teams.

Dunbar signed with Washington as an undrafted free agent out of Florida in 2015 and was traded to the Seahawks in March. He started 11 games for the Redskins last season, making 37 tackles and four interceptions.

Baker was one of three first-round draft picks the Giants had last season. He was the 30th pick overall out of Georgia. He played in all 16 games, starting in 15. He had 61 tackles and no interceptions.

MONROEVILLE, PA – A Gateway High School football player is in the Allegheny County Jail after being charged with participating in an armed robbery in August. Jaquan Thomas faces six felony counts, including robbery, theft, receiving stolen property and conspiracy.

Thomas, 18, is a starting wide receiver and defensive back for the Gators.

According to police, Thomas and another person allegedly robbed two people at gunpoint in the
Cambridge Square apartments. The victims had arranged to meet Thomas to sell a backpack and two pairs of shoes, but during the meeting Thomas allegedly pulled a gun and took a wallet, Rolex watch, cellphone and a handgun.

Felony robbery charges against a former University of Nebraska at Kearney football player have been dismissed after prosecutors couldn’t locate the alleged victims.

Vance Johnson, 20, originally of Salina, Kansas, was charged in Sarpy County District Court with use of a firearm to commit a felony, felony robbery and first-degree forgery in connection with a Sept. 26 incident. Johnson was accused of robbing a Papillion woman of a diamond ring.

However, Phil Kleine, a deputy Sarpy County Attorney, said the charges were dismissed after prosecutors were unable to make contact with the alleged victims. The case was dismissed without prejudice, which means charges can be refiled.

In late September, a Papillion resident posted a diamond ring for sale on an online site, Papillion Police Chief Deputy Chris Whitted said at the time.

Johnson allegedly contacted the seller and they agreed to a sale. When Johnson met with the seller in a Papillion residential area, he allegedly provided the seller with counterfeit money, Whitted said.

When the seller realized the money was counterfeit, she confronted Johnson and asked for the ring back. Johnson allegedly produced a handgun and left the area with the ring.

Through their investigation, Papillion police were able to identify Johnson as a suspect. A warrant was issued, and Johnson was arrested at his then-Kearney residence.

Johnson is not currently enrolled at UNK, according to UNK spokesperson Kelly Bartling. At the time of the alleged incident, he was a UNK student and had been a defensive back with the Loper football team.
