McCabe’s lawyer, Tom Burton, said after the arraignment that prosecutors didn’t have any grounds to bring felony charges. He said his client is a decorated military veteran with a clean record as a police officer.

“Nobody started out their day intending to hurt this fellow,” Burton said. He added that if the victim had followed commands to back off, “none of this would have happened.”

A phone message was left with Torgalski’s lawyer.

The footage shows the man, identified as longtime activist Martin Gugino, approaching a line of helmeted officers holding batons as they cleared demonstrators from Niagara Square around the time of an 8pm curfew.

Two officers push Gugino backward, and he hits his head on the pavement. Blood spills as officers walk past. One officer leans down to check on the injured man before another officer urges the colleague to keep walking.

The police officers “knew this was bad,” Flynn said of the video. “Look at their body language.”

The video of the encounter sparked outrage online as demonstrators take to cities across the country to protest racial injustice sparked by the death of George Floyd, a black man who died after a white police officer pressed a knee into his neck for several minutes.

“I think there was criminal liability from what I saw on the video,” Gov. Andrew Cuomo said at a briefing Saturday. “I think what the mayor did and the district attorney did was right, and I applaud them for acting as quickly as they did.”

“What we saw was horrendous and disgusting, and I believe, illegal,” he added.

But dozens of Buffalo police officers who were angered over their fellow officers’ suspensions stepped down from the department’s crowd control unit Friday. The resigning officers did not leave their jobs altogether.

A crowd of off-duty officers, firefighters and others gathered on Saturday outside the courthouse in a show of support for the accused officers and cheered when they were released.

“It was tremendous, tremendous to see,” John Evans, president of the Buffalo Police Benevolent Association, told WIVB-TV. “I just think it’s a strong indication of the outrage basically over this travesty.”

Flynn said he understood the concerns of officers who don’t feel they are being supported and pointed out that he’s also prosecuting protesters “who have turned into agitators” and “need to be dealt with as well”.

“There will be some who say that I’m choosing sides here,” he said. “And I say that’s ridiculous. I’m not on anyone’s side.”

HOUSTON, Texas (KTRK) —

A Harris County grand jury Friday indicted Philadelphia Eagles defensive end Michael Bennett for the felony charge of injury of the elderly for injuring a 66-year-old paraplegic who was working at NRG Stadium to control access to the field at Super Bowl LI, prosecutors said.

On Feb. 5, 2017, Bennett was a spectator and in town to watch his brother, a player for the New England Patriots.

Immediately following the game, Bennett shoved his way on to the field where players were gathering to celebrate.

NRG Security personnel, including the 66-year-old disabled victim, told Bennett he had to use a different entrance for field access.

Instead, he pushed through them, including the elderly woman who was part of the security team.

The charge, injury to the elderly, includes intentionally and knowingly, causing bodily injury to a person 65 years or older.

It carries a penalty of up to 10 years in prison and a $10,000 fine.

As a result of the indictment, a warrant has been issued for Bennett’s arrest. Prosecutors are working with Bennett’s counsel regarding his surrender.

LANSING (WWJ/AP) – A Michigan State University trustee and former NFL player has been charged with assault following a dispute over a referee’s calls during a girls’ basketball tournament.

The Lansing State Journal reported Friday that Mitch Lyons was coaching one of the teams when he allegedly pushed a referee after a December game. Lyons faces a misdemeanor charge of assault and battery.

His attorney says Lyons, who has been a university trustee since 2011, denies the allegations.

The referee told police that he had to make a couple calls that caused one team to lose, then issued two technical fouls following a verbal dispute that followed. The ref said coach confronted him after the game and twice pushed him in the chest with his hands.

Lyons played football from 1988 to 1992 at Michigan State before spending seven years in the NFL with the Pittsburgh Steelers and Atlanta Falcons.

The charge comes amid other troubles for Lyons, as some have called for all MSU trustees to resign on accusations the university ignored or mishandled reports of abuse by then campus sport doctor Larry Nassar.

Lyons made headlines last week as the first board member calling for the ouster of MSU president Lou Anna Simon, who has since resigned.

A court hearing in Lyons’ assault case is set for Feb. 12.
