A couple of years ago, former University of Florida football standout Monty Grow was found guilty of pocketing $18 million in kickbacks for referring military service members and veterans to a local pharmacy that billed the U.S. government for unnecessary medications.

Grow, sentenced to 22 years in prison, has appealed his conviction.

But the federal investigation didn’t end with the ex-NFL player. It got bigger.

Miami prosecutors have charged two former employees with Pompano Beach-based Patient Care America with bilking $87 million from a military healthcare program run by the U.S. Department of Defense. The alleged scheme included patient referrals that Grow and several others steered to them through marketing companies over a one-year span, according to court records.

Matthew Smith, a pharmacist and former vice president of PCA, and Alisa Catoggio, a pharmacy technician, were charged in late April with conspiring to commit healthcare fraud by submitting bogus claims for prescribed drugs to the federal Tricare program for thousands of military service members and veterans who didn’t need them. The former PCA employees are accused of mixing ingredients to create expensive pain creams to treat the scars of military personnel with questionable prescriptions who were not charged any co-payments for the drugs.

The former football player, who owned a marketing firm, used telemedicine companies to prescribe the compound medications, paying them approximately $100 per telephone or video consultation. Grow and his associates filled out prescription forms, faxed them to telemedicine companies for signing by a doctor, and then sent them to the pharmacy.

According to court records, a pain cream prescription that costs the PCA pharmacy about $700 to fill could be reimbursed by Tricare for $16,000. Grow and his team of recruiters received $7,000 in commissions each time.

Of the $87 million that the PCA pharmacy collected from Tricare between 2014 and 2015, about half was kicked back to Grow, his team of associates and other companies for the patient referrals. In addition to healthcare fraud, both Smith and Catoggio are accused of paying and receiving healthcare kickbacks.

Prosecutor Jon Juenger, who handled the Grow case, declined to comment about the expanding pharmacy investigation. Smith’s defense attorney,

Ryan Stumphauzer, a former federal prosecutor who specialized in healthcare fraud cases, said his client “denies the criminal charges and looks forward to vindicating himself in court.”

Catoggio could not be reached for comment.

The Pompano Beach pharmacy business has been mired in controversy over kickback allegations involving the Tricare program for several years. In 2019, Patient Care America, CEO Patrick Smith and and pharmacist Matthew Smith, the former vice president of operations, agreed to settle a False Claims Act case with the Justice Department. PCA, along with a private equity firm, paid $21 million; Patrick Smith paid $300,000; and Matthew Smith paid $12,788. The payments resolving the civil case were based on the ability to pay, according to the Justice Department.

Patrick Smith, the CEO, was not charged criminally. But Matthew Smith, along with his assistant, Catoggio, were charged in the criminal case, which began with the prosecution of Grow and several others.

At Grow’s trial in 2018, the federal jury had to decide whether he intentionally defrauded the military healthcare program or was simply paid lavish but legitimate sales commissions by the pharmacy for referring thousands of patients to Tricare through his marketing company.

Grow’s lawyers urged U.S. District Judge Federico Moreno to be reasonable in his sentencing, which didn’t pan out. They pointed out that eight other defendants in the case — including former University of Florida star and retired NFL quarterback Shane Matthews — received punishment ranging from probation to less than two years. In the conspiracy to fleece the Tricare program, Matthews was sentenced to three months in prison for his bit role on Grow’s marketing team, lining up sales representatives who then landed patients for the PCA pharmacy.

At Grow’s appellate hearing via teleconference last month, his attorney David O. Markus argued that the doctors, not Grow, should be held responsible for the prescriptions. Markus argued that “in every single case a doctor had to approve of the prescription and the doctor was free to change it, alter it or not give it.”

“We have real doctors issuing real prescriptions to real patients who got their medicine,” he told the appellate panel in Atlanta. “Medical necessity was not an issue.”

Contacted by the Miami Herald on Monday, Markus expressed optimism about 48-year-old Grow’s appeal. “Both his conviction and sentence are extremely problematic,” he said.

Keshav Maharaj has put himself forward as a wildcard candidate to take over as South Africa’s Test captain. The position remains unfilled following Faf du Plessis stepping down in February, even though South Africa have appointed Quinton de Kock as their white-ball captain.

Maharaj has not been among those named as likely future Test leaders – a status reserved for Temba Bavuma, Aiden Markram and Dean Elgar – but he wants the captaincy, and not just in red-ball cricket.

“I really want to captain the Proteas. It’s been my dream. Not many people know that, but those close to me know that I do want to captain the South African team across all three formats,” Maharaj said. “And I want to raise the World Cup trophy in my hand as the leader of the side.

“Apart from wanting to play for the Proteas as a childhood dream, captaining the team to a World Cup-winning campaign would be everything I have ever dreamed of and my life would be fulfilled from a cricketing perspective.”

While Maharaj’s goals may seem ambitious to those who follow South African cricket, he has previous experience on which to make his case. Maharaj led his franchise, the Dolphins, in last season’s one-day cup, where they were declared winners after the competition was suspended because of the Covid-19 pandemic. The Dolphins finished top of the points’ table with seven victories from 10 matches. Maharaj was their leading wicket-taker and fourth-highest overall, numbers that earned him an ODI recall against Australia after an absence from the team for 18 months.

Maharaj had only played four ODIs before that, two in England in 2017 and two against Sri Lanka in 2018, and was considered to be behind Imran Tahir and Tabraiz Shamsi in the national pecking order. But with Tahir’s ODI retirement after the 2019 World Cup and South Africa open to playing XIs with more than one spinner, Maharaj knew he could establish a regular place and the team management even gave him a blueprint for how to do it. “I got told that apart from bowling, you need to work on your batting.”

Though he only batted five times in the tournament, Maharaj finished with the Dolphins’ second-highest average, and scored his maiden List A half-century, which helped his team to a match-winning total in a low-scoring game against the Cobras.

That knock came after Maharaj scored two Test fifties, in Pune against India and in Port Elizabeth against England, innings that showed why he had initially been spoken about as someone with all-round potential. “I have a lot more ability than the numbers I have been showing,” he said.

Maharaj had two first-class hundreds and seven fifties to his name when he made his Test debut in 2016, but his early international displays, which often involved wild swings, did not indicate he could be considered an allrounder. However, he showed a more measured approach last summer, and now wants to work his way up the Test line-up. “In India, I got a taste of what it’s like to score an international fifty. I wanted to really kick on but it was a bit unfortunate to get out,” he said. “I really want to take my batting seriously and move to a bowling allrounder or a fully-fledged allrounder so I can contribute evenly. I know I am capable of scoring bigger runs. My biggest problem was getting the first fifty so I now I want to try and kick o from that and get big hundreds and match-winning hundreds.”

Maharaj hopes that if he scores runs in the longest format, it may also help him get into the international scene in the shortest one; he has not yet been capped in T20Is. “I do want to break into the T20 format but I know I have to bide my time in ODI cricket and score some big runs in Test cricket to improve my chances of selection,” he said.

Until then, he is happy to put in the hard work, under de Kock, who has changed the way South Africa approach their limited-overs cricket. “It’s a different dynamic to when I first debuted in terms of the aggression. It’s exciting,” Maharaj said. “You’ve got a younger leader and with youth comes a lot of flair.”

Maharaj has spent the lockdown working on developing flair of his own, as he looks to become a multi-format international regular. He will have more time to do that over the next few months after his overseas deal with Yorkshire was canceled as the counties look for ways to cut costs in the face of Covid-19. That means the earliest Maharaj will play is if South Africa’s July-August tour to West Indies goes ahead, a tour they will undertake with a new Test captain. Whether that is Maharaj remains to be seen.

In the meanwhile, he also has a wedding to reschedule. Maharaj and his fiancee Lerisha were due to tie the knot last Saturday but had to postpone their big day with the ban on social gatherings still in place. Even though he is disappointed not to have been able to say his “I dos”, Maharaj can see the silver lining. “It was tough accepting [the postponement] but it gives us some extra time to make the wedding even more perfect than what it was going to be.”

South African and Sale Sharks centre Rohan Janse van Rensburg has been suspended for two weeks and fined £32,500 ($40,202) for signing contracts with two English Premiership rugby clubs.

Van Rensburg signed a three-year deal with Sale before the 2018/19 season, having already agreed a three-year deal with Gloucester Rugby in 2017.

The dates of Van Rensburg’s suspension will be confirmed when more details of the playing calendar are available.

Sale Sharks were slapped with a suspended five-point deduction for two seasons and fined £20,000 ($24,740) for their involvement in the scandal. The suspended point deduction is on condition that Sale does not violate RFU Regulation 7 which applies to players, approaches, contracts, payments and player movements.

Gloucester Rugby will be paid £25,000 ($30,925) in compensation out of the £32,500 fine for money which was given to Van Rensburg but not repaid.

According to the Rugby Football Union (RFU), the governing body for rugby union in England, both parties accepted the charges against them.

Van Rensburg was charged with conduct prejudicial to the interests of the game contrary to RFU Rule 5.12 while Sale Sharks were charged with breaches of RFU Regulation 7.5 which relates to approaches to players, the RFU said.

The RFU confirmed that there is a right to appeal against the decision.

Two men who had been involved in a fender-bender decided to drive recklessly when they sped down a busy street and crashed into a minivan, killing a 16-year-old high school baseball player and critically injuring his father in south Torrance nearly three years ago, a prosecutor told jurors Wednesday, Jan. 15.

But defense attorneys for both Darryl Leander Hicks Jr., 31, of Los Angeles and Tung Ming, 24, of Rancho Palos Verdes said several complicating factors, and not mere recklessness, led the pair to speed down the hill from Rolling Hills Estates on March 7, 2017.

They said the prosecution overreached in charging the men with gross vehicular manslaughter in a three-vehicle crash that killed Jesse Esphorst Jr. and critically injured his father, also Jesse, during opening statements of an anticipated 10-day trial in Torrance Superior Court.

But prosecutor Ryan Gould told the jury that usually after a fender bender, both parties pull over, exchange information and move on.

“That is not what happened here,” he said. “Because of a series of choices both defendants made, they drove recklessly, carelessly and without regard for human life.”

Witnesses and police estimated the two vehicles to be traveling about 80 miles per hour when they collided in succession with the Esphorts’ minivan as it attempted to make a left turn on a green arrow from southbound Crenshaw Boulevard to eastbound Crest Road.

The minivan clipped Hicks’ vehicle as it sped by on a red light, but Ming’s SUV followed and hit the minivan head on, which was believed to be the fatal collision.

Witnesses who ran up to render aid found Jesse Esphorst Sr. slumped over his son in the passenger seat, with the younger Esphorst’s upper body partly hanging out the passenger window.

The son suffered a broken sternum, skull fractures and a neck dislocation, while the father suffered a broken right nasal bone, a three-centimeter cut on his scalp requiring 10 staples and brain hemorrhaging, Gould said.

Ming stayed at the scene following the collision while Hicks fled. His damaged car was found a quarter-mile away from the crash site and he was arrested days later.

Both men face counts of vehicular manslaughter and reckless driving on a highway causing injuries and death. Hicks also faces counts of hit-and-run driving resulting in death or serious injury to another person, hit-and-run driving resulting in injury to another person and misdemeanor counts of hit-and-run resulting in property damage and driving on a suspended license.

Hicks faces 12 years in prison if convicted as charged, while Ming faces nine years. Both men are free on bail.

The incident began when Hicks made an illegal U-turn to go southbound on Crenshaw Boulevard while Ming was making a legal left turn from Silver Spur Road. Their cars collided before Hicks fled and Ming pursued while calling 911, which led to the fatal crash, Gould said.

Richard Hutton, representing Ming, said the case was unique in the fact that the co-defendants had never met.

Hicks’ attorney Daniel Perlman told the jury his client was headed home with his girlfriend when he made the U-turn. After the collision, Ming’s SUV appeared to veer toward Hicks’ sedan and Hicks fled out of fear that Ming would retaliate, Perlman said.

Hutton told the jury that Ming was simply following the order of a sheriff’s department 911 operator, who asked him three times to try to get the license plate number of the vehicle that had hit him, only to request he stop chasing the vehicle almost simultaneously with the moment of impact, which was heard on the recording.

The defense attorneys were not disputing that the collisions occurred, or that there was tremendous loss as a result, but disagreed with the vehicular manslaughter charge and the contention that gross negligence was involved.

Perlman said Hicks’ girlfriend, seated in the passenger seat of his car, told him that she could no longer see Ming’s SUV in the rear view mirror and suggested he slow down in the seconds before the collision with the Esphorsts, adding Hicks was unaware Ming also hit the minivan.

“You will hear evidence and testimony that my client did not know the second collision occurred or how serious it was,” Perlman told the jury.

Hicks heard about the fatal collision on the news, Perlman said, adding Hicks called him and planned to turn himself in, but was called in to work first and arrested there by police.

Hutton followed and pointed out that Ming was the listed victim in one of the counts against Hicks. He argued that if Hicks was truly afraid, he should have called 911. He claimed Hicks may have fled because he had been drinking and was driving on a suspended license.

Ultimately, Ming didn’t display the mental state of someone with a disregard for human life, Hutton argued.

“It doesn’t make it right, but maybe there are other factors involved,” Hutton said. “In no way, shape or form do we blame the Esphorsts for any part of what happened. It’s a true tragedy and my client feels terrible about it.”

Jesse Esphorst Jr. was a talented shortstop for the South Torrance High baseball team and had just hit a home run to lead his team to victory hours prior to the crash.

More than 2,000 people, including hundreds who knew him through high school and Little League, attended his funeral.

SOUTH BEND — A jury could not come to a verdict and a mistrial was declared Thursday for the second former Indiana University South Bend basketball player accused of rape.

Phillip Corthen, 20, was charged with two counts of Level 3 rape. A jury found him not guilty on the first count, but couldn’t come to a decision on the second. Corthen could now be heading for a new trial on that second count.

Corthen and fellow basketball player Joseph Bannister, 21, were both accused of raping a woman in February 2017 while she was unconscious in Bannister’s on-campus apartment. Bannister allegedly sent two videos of the assault to other basketball players through the social media platform Snapchat.

Bannister was found not guilty of rape last week after a jury deliberated for about 40 minutes. Corthen will return to court for a May 1 hearing.

A former University of South Dakota football player has pleaded guilty to sexual assault this week. 

Danny Rambo Jr., 21, pleaded guilty Feb. 9 to sexual content without consent with a person incapable of consenting — a Class 1 misdemeanor. He was originally charged with one count of second-degree rape. 

Rambo was sentenced to 10 days in jail (180 with 170 suspended). He will serve his time starting Nov. 1 and will pay about $2,400 in court costs. He was ordered to enroll in counseling to “address any sexual issues” he has.  

Rambo Jr. and Dale Williamson, 21, turned themselves in the Monday after the incident that occurred on Oct. 22, according to the Vermillion Police Department. Williamson was charged with one count of attempted second degree rape. He has pleaded not guilty to the charge.

According to court documents, a woman says Rambo and Williamson entered a bedroom where she was having consensual sex with another player and assaulted her Oct. 22, 2017, at the off-campus residence the three players shared. She said the player did not seem surprised the others entered the room and didn’t ask them to leave. 

Rambo admitted he made sexual contact with the victim, according to court documents, but Williamson denied involvement and said he wasn’t even in the room. Alcohol was not involved in the incident. 

“The victim was very reluctant about having an investigation started due to the backlash she believed she would suffer from the football team, student population and community,” according to the affidavit. 

Williamson is charged with rape in the second degree in a separate case, with court documents stating that on March 3, 2017, he “unlawfully accomplish(ed) an act of sexual penetration with another person … through the use of force, coercion, or threats of immediate and great bodily harm against the victim or other persons within the victim’s presence.”

He pleaded not guilty to the charge.

A soccer player for a South Korean soccer team charged with sexual assault on Guam after a woman told local police he raped her in a hotel asked the court to allow him to return home pending his trial.

Superior Court of Guam Judge Arthur Barcinas said Tuesday he will decide at a later time if Byong Oh Kim will be allowed to leave Guam for South Korea. 

Kim is accused of sexually assaulting a woman inside a room on Jan. 22 at the LeoPalace Resort. He was indicted on charges of three counts of third-degree criminal sexual conduct and four counts of fourth-degree criminal sexual conduct.

Kim is an active duty member of the Korea Armed Forces Athletic Corps, according to the defense’s court filings translated into English. He’s also a player for the Sangju Sangmu soccer team, which was on Guam in January for training, according to a news release from the soccer team. 

“Kim is a member of the Korean Army and is currently AWOL because he could not return to his unit,” stated his attorney, F. Randall Cunliffe.

Col. Hyeon-Cheol Park, an officer with the South Korean Ministry of National Defense, at Tuesday’s hearing, said Kim is expected to be discharged from the military on Sept. 4, if they don’t add time for the weeks he’s been absent.

When he’s discharged, he will be a free man, according to Park.

Cunliffe said military duty is mandatory in South Korea.

The prosecution opposed releasing Kim to South Korea. Assistant Attorney General Sean Brown said the woman accusing Kim said she is “very scared” and feels less scared because Kim is currently on Guam. The woman lives in South Korea, documents state.

Brown also said there’s no way to ensure the woman’s safety if Kim is in South Korea, the probation office on Guam isn’t able to monitor him there. If Kim violates his conditions, there’s no way to investigate it, Brown said.

“Once Kim leaves the island, there’s no guarantees for his return,” Brown said.

Park said that if Kim is allowed to go back to South Korea, he will be restricted to the military base and they will ensure he returns to Guam for his court hearings and the trial in August. “My country will guarantee he will come back for court,” Park said.

There wasn’t an interpreter for Kim at Tuesday’s hearing. Barcinas said he will schedule another hearing when an interpreter is available.

Cunliffe in court filings said Kim’s military base is in central South Korea and the woman accusing him of sexual assault was attending college in Pusan which Cunliffe said was in the southern part of South Korea and far from where Kim is stationed.

Kim is currently on pre-trial release after posting $10,000 cash bail.

PORT ELIZABETH (South Africa): South African fast bowler Kagiso Rabada will face a disciplinary hearing on Saturday that could result in a ban from the third Test against Australia.

Cricket South Africa said Rabada, who devastated the Australian batting order on the first day of the second Test on Friday, has been charged with a level two offence following an incident with Australian captain Steve Smith.

Level two offences are for conduct of a serious nature. In Rabada’s case the alleged offence is that of making inappropriate or deliberate contact with another player.

Rabada shouted in celebration and approached Smith aggressively after winning a leg before wicket decision against him and the shoulders of the players made contact.

It is the second incident of a bad-tempered series after Australia’s vice-captain David Warner was fined 75 percent of his match fee for an altercation in a stairwell with the home side’s wicketkeeper Quinton de Kock.

The charge against Rabada was brought by the on-field umpires, Kumar Dharmasena and Chris Gaffaney. The hearing will be conducted by International Cricket Council match referee Jeff Crowe.

A Cricket South Africa spokesperson said Rabada would defend the charge and argue that the contact with Smith was accidental.

If found guilty Rabada could be fined between 50 and 100 percent of his match fee and could be penalised three or four demerit points. Because he already has five demerit points, which led to him being suspended for a Test match against England last year, Rabada could be liable to serve another suspension, which could rule him out of the two remaining Tests in the series.

Guam – A professional Korean soccer player is facing felony charges of criminal sexual conduct after being accused of raping a woman as she slept in a hotel room.

Kim Byung-oh, 29, spent the night in jail earlier this week following allegations that he sexually assaulted a 23-year-old woman known to him.  The crime occurred, according to the woman, while she slept in a hotel room at the Leo Palace Resort.

Court documents say the woman awoke to find Kim rubbing her stomach and breast, before taking off her undergarments and raping her. She alleges that he then carried her into the restroom where he continued to rape her.

As the victim “let out a scream,” court documents continue, Kim covered her mouth with his hand in an attempt to keep her quiet. The victim then bit her alleged attacker’s hand allowing her to break free and run out of the room.  It is further alleged that Kim chased after her in an attempt to prevent her from getting assistance. However, the victim was able to locate a security guard who then contacted authorities.

Kim is listed as a forward on the Sangju Sangmu team which is part of South Korea’s professional association soccer league.  He has been charged with third degree criminal sexual conduct as a second degree felony and fourth degree criminal sexual conduct as a misdemeanor.

Kim has since posted bail $10,000. His next hearing is on February 2.

A soccer player for a professional South Korean team was charged with sexually assaulting a woman at LeoPalace Resort Guam this week, according to a magistrate’s complaint recently filed in the Superior Court of Guam.

Byong Oh Kim is listed as a forward for the Sangju Sangmu team, according to the team’s official website.

Police in the early morning hours on Monday responded to LeoPalace in Yona, where they met with a 22-year-old woman who alleged Kim raped her in a hotel room, court documents state.

The woman told police that at about 2 a.m. on Monday, she woke to Kim rubbing her stomach and breast and alleged he took off her underwear and raped her, court papers state. “(She) froze and did not know what to do,” court documents state.

The woman said Kim carried her to the restroom and raped her again and when she screamed, Kim put his hand over her mouth “in an attempt to keep (her) quiet,” court documents state.

She told police she bit his hand and then ran out of the room, yelling for help. Kim reportedly chased after her to keep her from getting help, according to the court complaint.

The woman found a security guard who called police, documents state.

Kim is charged with third-degree criminal sexual conduct as a second-degree felony and fourth-degree criminal sexual conduct as a misdemeanor.
