A former high school freshman claims in a lawsuit that his junior varsity football teammates raped him in a Montgomery County locker room in 2018.

A member of the Seneca Valley High School junior varsity football team was allegedly raped by teammates in an unsupervised locker room in September 2018, according to a civil lawsuit filed in Montgomery County Circuit Court.

The student — identified in court documents as “John Doe” — was a freshman when he was assaulted before practice on Sept. 17, 2018, the lawsuit said.

“For several minutes, several football players held him down, forced his pants and underwear down, and penetrated, touched, assaulted and slapped John Doe,” according to the suit, which was filed March 9.

The negligence suit claims the Montgomery County Board of Education, school principal Marc Cohen, Athletic Director Jesse Irvin, varsity football coach Fred Kim and JV coach Cody Martin were aware of previous sexual assaults in football locker rooms, and didn’t do enough to prevent the Seneca Valley attack.

According to the suit, Seneca Valley High School didn’t notify law enforcement until four days after the assault.

Kim and Martin were fired in December 2018, according to the lawsuit. Cohen and Turner still work at Seneca Valley.

Thomas DeGonia and Jerry Hyatt, the lawyers for the boy and his mother, said the school officials knew of an earlier football locker room assault, in 2017 at Damascus High School. It was reported to the school, school security and county administration, “but no corrective action was taken by MCPS.”

A few months later, in February 2018, a student-athlete was sexually assaulted in a locker room as part of a hazing ritual.

The Seneca Valley incident occurred about a month before four Damascus High School football players were sexually assaulted by their teammates. After initially being charged as adults in the Damascus case, a judge referred all the defendants to juvenile court, which provides more leniency and privacy for people charged.

According to DeGonia and Hyatt, school officials “knew or should have known of abuse, sexual or otherwise, in the Seneca Valley locker room and in MCPS locker rooms around the county, and as a result, it was reasonably foreseeable that this incident would occur absent proper supervision.”

At this point, there have been no adult or juvenile criminal charges filed in the Seneca Valley case.

In addition to the plaintiffs in the Seneca Valley suit, DeGonia represents the plaintiffs in the Damascus suit, which was filed in February.

Gboyinde Onijala, a spokeswoman for the school system, said in an email, “MCPS is committed to the safety of all students. The Seneca Valley High School administration acted quickly when these allegations were brought to their attention. While the Montgomery County police were unable to pursue charges based on what the victim shared at the time with the school and law enforcement, the school did take disciplinary action against those believed to have been involved and provided robust support to the student and their family.”

A local adult league hockey player is suing a former opponent, league brass and even the City of Kelowna in relation to injuries he sustained while on the ice in 2018.

Ryan Bachmeier, a Kelowna physiotherapist, filed a notice of civil claim in Kelowna court on April 22, alleging Greg Hopf injured him while playing in a ‘careless, reckless and negligent manner’, during a ‘no contact’ Pacific Adult Hockey League game on October 16, 2018.

“During the game, the plaintiff was in the defensive corner without the puck when the defendant Hopf violently and negligently charged at the plaintiff and attacked the plaintiff from behind, pulling him backwards with the defendant Hopf landing on top of him, while repeatedly striking him in the face as he was still laying on the ice, causing injuries, loss and damage,” claimed Bachmeier in the suit.

Bachmeier claimed he suffered a dislocated and fractured right ankle, as well as torn ligaments among other injuries. The suit contests this suffering has followed him since the incident, causing pain, discomfort, loss of enjoyment of life, permanent physical disability and loss of earnings, both past and prospective.

According to the suit, the league itself is also at fault, naming league co-ordinator Larry Lenarduzzi. He is accused of letting Hopf continue to play even though he ‘knew or ought to have known that he played hockey in a careless, reckless and negligent manner’.

The suit also mentioned Hopf’s penalty minutes, stating Lenarduzzi failed to assess the penalties from season to season. Bachmeier claimed this as evidence of both the league’s negligence and Hopf’s propensity to play hockey in a violent manner.

The City of Kelowna is accused of failing to manage the Pacific Adult Hockey League when it knew or ought to have known rules and the code of conduct was not being enforced.

Bachmeier is seeking damages related to his health care costs and loss of income, as well as punitive and aggravated damages.

None of the claims have been proven in court and none of the defendants have responded to the notice of claim. Parties have 21 days to submit a response.

OREM, Utah – A member of the Utah Valley University men’s basketball team was arrested and charged with forcible sex abuse and assault.

Accord to a report from the Utah County Sheriff’s Office, 20-year-old Zachary Mogbo attended a party Friday night and into Saturday morning at a home about two miles north of campus.

A 22-year-old woman told police she was dancing with Mogbo around 12:30 a.m. when the two went into a bathroom to “make out.”

She told police Mogbo began touching her private areas without permission. When she asked him to stop and attempted to leave the room, the woman told officers with the Orem Police Department that Mogbo “grabbed her by the groin attempting to hold her there,” according to the report.

The woman said she then yelled for help and kicked the suspect, trying to leave the room.

A 21-year-old friend of the woman told police he heard the yelling and went to the bathroom to help. After confronting the suspect, he said Mogbo punched him in the face. Investigators said they found bruising on the side of the man’s face consistent with his story.

Witnesses said Mogbo then made his way out of the bathroom, he punched a hole in the wall. On his way out of the house, they said another male confronted the suspect, who Mogbo reportedly told the man he had a gun and threatened to use it.

When police responded to the home, they found a vehicle outside with three males inside. They said Mogbo identified himself, and matched the description they had been given of the suspect.

They also found fresh cuts on Mogbo’s hand and jacket.

Mogbo was placed under arrest, and charged with forcible sexual abuse, assault and criminal mischief. He was also charged with possession of another person’s identity documents after police found another person’s California driver license in his pants pocket.

The Florida native played two seasons at Palm Beach State College in Boca Raton before new head coach Mark Madsen announced Mogba was transferring to UVU.

The university released a statement after the arrest.

“Zachary Mogbo transferred to Utah Valley University beginning with the 2019 fall semester, and is a newly recruited member of the 2019-20 basketball team,” the statement read. “We are aware of the accusations against him. Per athletic team rules, he was suspended pending the outcome of the investigation. We cannot comment further, and refer calls to the Orem Police Department.”

As of Tuesday, Mogbo was no longer listed on the UVU men’s basketball roster.

ONTARIO COUNTY, NY — Janoris Jenkins’ brother, William has been charged in the death of Roosevelt Rene, the dead man found at Jenkins’ home in Fair Lawn, New Jersey, authorities announced Wednesday.

William Jenkins was arrested in Ontario County, NY early Tuesday morning about nine hours before Rene’s body was discovered, according to TMZ.

Jenkins was charged with aggravated manslaughter in Rene’s death, the Bergen County Prosecutor’s Office and Fair Lawn Police Department stated.

Rene, a Spring Valley native, was a hip-hop and R&B music producer known as Trypps Beatz. Rene is a family friend of the residents who live at the Van Saun Place house and had been living there of late, authorities said.

Rene, 25, was found in the home Tuesday, said acting Bergen County Prosecutor Dennis Calo. Fair Lawn Police received a call about the body just before 10:30 a.m., Fair Lawn Police Sgt. Brian Metzler confirmed.

Janoris Jenkins was not at home when Rene’s body was discovered, ESPN reported. Jenkins has been in Florida since Giants mini-camp ended two weeks ago, according to sources. Jenkins’ attorneys advised him to stay in Florida.

The Bergen County Medical Examiner’s Office will perform an autopsy on Rene’s body to determine the cause of death.

The prosecutor’s office said it would release more information once it becomes available.

The New York Giants are “aware of and monitoring the situation,” according to multiple reports.

Former dealer, Long Vu Tong, 34, of Souderton, and Lieu Khang David Bui, 21, of Philadelphia, are charged with theft by deception, criminal conspiracy and forgery in connection with the exchange of fake bills for $4,000 in cash on the casino floor last fall.

According to arresting documents, Bui entered the casino around 7:11 p.m. on Nov. 7, 2017, and sat down at the Spanish 21 where Tong was dealing.

Bui removed $2,500 from his pocket, which Tong laid out on the table before depositing in a drop box and handing Bui $2,500 worth of chips.

Bui then played at the table briefly before cashing out and playing a little roulette, but returned to Tong’s table and presented another $1,500 which Tong accepted and exchanged for chips as before.

After playing a little while longer, Bui cashed out again and went to the cage to exchange his chips for cash.

Casino counters discovered that the bills Bui gave to Tong did not have embedded red and blue fibers and were not printed on genuine U.S. currency paper. And on Nov. 21, the bills were confirmed to be counterfeit by a Secret Service Agent.

On Nov. 28, and again on Nov. 29, Tong was interviewed by state troopers with the Valley Forge Gaming Office.

According to the affidavit of probable cause, he initially admitted only a passing acquaintance with Bui, but later said he received a phone call from Bui earlier on the day of the incident in which Bui informed him of his intentions to pass the counterfeit bills.

Tong told investigators that he initially thought Bui was joking and he told him not to do it, but Bui showed up at his table anyway so he “let it slide” and continued on with his work.

Tong also told investigators he later drove Bui to the King of Prussia Mall and voiced his displeasure at the situation by “cursing and telling him off.”

He said Bui offered him a cut, but he refused.

Preliminary hearings for both men are scheduled for March 7.

UPPER MERION >> On Feb. 8 criminal complaints were filed in Montgomery County District Court against two men for their roles in a counterfeit cash scheme at Valley Forge Casino.

Former dealer, Long Vu Tong, 34, of Souderton, and Lieu Khang David Bui, 21, of Philadelphia, are charged with theft by deception, criminal conspiracy and forgery in connection with the exchange of fake bills for $4,000 in cash on the casino floor last fall.

According to arresting documents, Bui entered the casino around 7:11 p.m. on Nov. 7, 2017, and sat down at the Spanish 21 where Tong was dealing.

Bui removed $2,500 from his pocket, which Tong laid out on the table before depositing in a drop box and handing Bui $2,500 worth of chips.

Bui then played at the table briefly before cashing out and playing a little roulette, but returned to Tong’s table and presented another $1,500 which Tong accepted and exchanged for chips as before.

After playing a little while longer, Bui cashed out again and went to the cage to exchange his chips for cash.

Casino counters discovered that the bills Bui gave to Tong did not have embedded red and blue fibers and were not printed on genuine U.S. currency paper. And on Nov. 21, the bills were confirmed to be counterfeit by a Secret Service Agent.

On Nov. 28, and again on Nov. 29, Tong was interviewed by state troopers with the Valley Forge Gaming Office.

According to the affidavit of probable cause, he initially admitted only a passing acquaintance with Bui, but later said he received a phone call from Bui earlier on the day of the incident in which Bui informed him of his intentions to pass the counterfeit bills.

Tong told investigators that he initially thought Bui was joking and he told him not to do it, but Bui showed up at his table anyway so he “let it slide” and continued on with his work.

Tong also told investigators he later drove Bui to the King of Prussia Mall and voiced his displeasure at the situation by “cursing and telling him off.”

He said Bui offered him a cut, but he refused.

Preliminary hearings for both men are scheduled for March 7.
