Former NFL player Kellen Winslow Jr. pleaded guilty Monday to raping an unconscious teen in 2003 and to sexual battery involving a 54-year-old hitchhiker in a deal that spared him the possibility of life in prison.

Winslow initially hesitated and seemed to agonize over his decision.

He asked the judge for more time before he finally entered the guilty pleas moments before he was about to be retried on six felonies including kidnapping, sodomy, forced oral copulation and two charges of rape in San Diego County Superior Court that could have sent him to prison for life if he was convicted.

In exchange for his plea, the court agreed to sentence him to between 12 and 18 years in prison for the two charges and dismiss the others.

In June, the jury found him guilty of the attack last year on the homeless woman in his picturesque beach community of Encinitas. Jurors also convicted him of two misdemeanors — indecent exposure and a lewd act in public — involving two other women.

But after six days of deliberation, jurors said they were hopelessly deadlocked on the other criminal charges, including the alleged rape of the hitchhiker and the rape of the unconscious 17-year-old girl in 2003 when he was 19, prompting the judge to declare a mistrial.

The 36-year-old former tight end — at one point, one of the highest-paid in the NFL — initially pleaded not guilty to the charges, but on Monday, Winslow changed his plea to guilty of rape of an unconscious person and felony sexual battery and waived appeal rights for his previous convictions. The remaining charges were dismissed.

“Your honor, I would like to waive my right to a jury trial,” Winslow said.

At one point, Winslow could be heard saying, “I’m not thinking clearly.”

The judge then asked Winslow if he was sure, to which Winslow said he needed “a couple of minutes.” Eventually, Winslow accepted the plea deal.

Defense attorney Marc Carlos said Winslow made a difficult choice to accept the plea deal.

“The downside of any conviction would land him in prison for the rest of his life, and he made this decision based upon his family, his father, his children, and he wanted to be there for them in the future,” Carlos said.

Five women took the witness stand this summer, and three of them were expected to testify again before his change of plea.

“I’m satisfied that now Mr. Winslow’s been held accountable for his conduct involving five separate victims over the course of 15 years,” Deputy District Attorney Dan Owens said after Winslow’s change of plea Monday.

A judge said Winslow would face at least 12 years in prison as part of his plea deal.

“The victims are supportive of this kind of resolution,” Owens said.

Previously, Winslow faced a maximum sentence of life in prison, but Monday’s deal would lessen that maximum sentence to 18 years in prison.

“I pray to God for 12 years, so I can return to my family,” Winslow said.

Winslow will be sentenced on Feb. 19, 2020.

“In addition, he is going to be a mandatory lifetime sex offender registrant. That is a mandatory requirement for each of the charges for which he’s been convicted,” Owens said.

As part of his plea deal, Winslow could “face a possible commitment as a sexually violent predator to an indeterminate term for the rest of his life into a state hospital if he is found to meet that criteria,” Owens said.

That aspect of the plea deal will not be determined until Winslow is eligible for parole upon his potential release from state prison.

“He will not be automatically released into the community until he has been evaluated by two psychologists appointed by the state,” Owens added.

He may also face a life parole term, Owens told NBC 7.

By 2 p.m., the jury was dismissed from the San Diego County Superior Court.

Winslow, who played for Cleveland, Tampa Bay, New England and the New York Jets, earned more than $40 million over 10 seasons in the NFL. He is the son of Chargers Hall of Fame receiver Kellen Winslow, who was in the courtroom throughout the first trial.

The defendant did not testify at his first trial.

Winslow has been held in custody and will be sentenced for the rape conviction after the second trial.

This summer, jurors listened to several days of testimony from five different women who accused the former NFL player of sexual assault and indecent exposure from June 2003 to earlier this year.

Jane Doe 1 said she was raped when a man in an SUV stopped to pick her up as she was hitchhiking in Encinitas in March 2018.

Jane Doe 2 said a man in an SUV picked her up on Vulcan Avenue and raped along Manchester Avenue in May 2018.

Jane Doe 3 said a man exposed himself to her while she was gardening at a residence on Lake Drive in May 2018.

Jane Doe 4 said a man raped her while she was unconscious in a Scripps Ranch townhouse when she was 17 in June 2003.

Jane Doe 5 said a man exposed himself to her on two separate occasions at a Carlsbad gym and began masturbating in front of her in February 2019.

SAN DIEGO — A California jury that convicted former NFL player Kellen Winslow Jr. of raping a 58-year-old homeless woman has been ordered to return to deliberations Tuesday after deadlocking on eight other charges against him, including two additional counts of rape involving a 54-year-old hitchhiker and an unconscious teen.

A jury on Monday in San Diego Superior Court in Vista found the son of a Hall of Famer guilty of the attack last year on the homeless woman in his picturesque beach community of Encinitas, north of San Diego.

The jury also found the 35-year-old former tight end guilty of indecent exposure and lewd conduct involving two other women, but jurors found him not guilty of one count of a lewd act.

Winslow, who played for Cleveland, Tampa Bay, New England and the New York Jets, faces up to life in prison if convicted of all counts.

All five women testified during the nine-day trial. Winslow did not take the stand.

Defense attorneys pointed out inconsistencies in the accusers’ testimonies and argued the women invented the allegations to prey on the wealth of Winslow, who reportedly earned over $40 million during his 10 seasons with the NFL.

Prosecutors say the son of Hall of Famer Kellen Winslow felt empowered by his fame to abuse the most vulnerable.

Let our news meet your inbox. The news and stories that matters, delivered weekday mornings.

Prosecutor Dan Owens told the jury of eight men and four women that Winslow is a “wolf in sheep’s clothing.”

The five women testified that they didn’t know Winslow was famous when they met him.

The homeless woman in Encinitas, who was 58 at the time, testified that he befriended her and attacked her next to his vehicle after inviting her for a coffee in May 2018.

A 54-year-old hitchhiker said he drove her to an Encinitas shopping center parking lot and raped her in his Hummer in March 2018.

A 57-year-old woman said he exposed himself to her while she tended to her garden in May of 2018. The jury found him guilty of that charge Monday.

After news of the attacks broke, a woman came forward and said Winslow had raped her when she was a 17-year-old high school student in 2003. He was 19 at the time and had come home from college for the summer.

A 77-year-old woman who went to the same gym as Winslow in the nearby beach community of Carlsbad said he committed lewd acts in front of her, including touching himself, while Winslow was free on $2 million bail in February. The jury found him guilty of touching himself in front of the woman while she exercised, but not guilty of committing a lewd act in front of her on a separate occasion in the gym’s hot tub.

After the jury sent a note saying it was deadlocked on the eight other charges, the judge sent them back to deliberate. They went home less than an hour later and were ordered to return Tuesday.

Jurors on Friday sent a note to the judge indicating it was struggling to reach agreement.

“The jurors could benefit from an explanation as to what being under oath means,” the note said. “Additionally, how we should follow the law and not what we think the law means.”

The judge told jurors being under oath means telling the whole truth and that they should follow the law how it is written.

Defense attorney Marc Carlos questioned the credibility of the women’s claims, saying they had lied, misconstrued things or were unable to initially identify him correctly.

Defense lawyers also said the sex was consensual and that Winslow had cheated on his wife repeatedly with no-strings-attached sex.

Prosecutors said the crux of the women’s stories didn’t change and that evidence included traces of Winslow’s DNA on one of the accuser’s pants and GPS locations placing him where the women said the assaults occurred.

SAN DIEGO (KGTV) – A judge ruled Thursday that former NFL player Kellen Winslow Jr. will not be allowed to be released on bail.

Winslow Jr., who is accused of breaking into homes and kidnapping and sexually assaulting two women in the North County, was ordered by a judge during his arraignment to be held without bail because he “presented a threat to society.” Prosecutors also alleged Winslow Jr. threatened to kill those women if they reported what happened.

The no-bail ruling remained in effect following a hearing Thursday morning, according to the San Diego County District Attorney’s Office.

Winslow Jr. is scheduled to return to court July 11 for a preliminary hearing.

At his arraignment, the former San Diego high school football star pleaded not guilty to two counts of kidnapping with intent to commit rape, two counts of forcible rape, one count of forcible sodomy, one count of forcible oral copulation, two counts of residential burglary, and one count of indecent exposure.

The charging document in the case detailed the alleged crimes:

  • March 17 – 54-year-old woman kidnapped and raped
  • May 13 – 59-year-old woman kidnapped and raped
  • May 21 – Indecent exposure
  • June 1 – Burglary of a 71-year-old woman
  • June 7 – Burglary of an 86-year-old woman

Two of the reported victims are transients, according to court documents.

RELATED STORIES:

Winslow Jr., the son of legendary Chargers tight end Kellen Winslow, had been arrested the week before on suspicion of burglary at an Encinitas mobile home park.

There are criminal reports from 2013, stating Winslow was arrested in New Jersey for masturbating inside his Escalade, while staring at a woman in her 50s at a parking lot. He was not charged with indecent exposure.

Winslow, who starred at Scripps Ranch High School and went on to play at the University of Miami, was drafted by the Cleveland Browns in 2004, and later played for the Tampa Bay Buccaneers, Seattle Seahawks, New England Patriots, and New York Jets.

He has not played in the league since 2013.

Former NFL tight end Kellen Winslow Jr. has been arrested on charges of rape and other sex crimes on the day he was to appear in court on an unrelated burglary charge.

The San Diego Union-Tribune reports sheriff’s deputies arrested Winslow on Thursday at his home in the San Diego suburb of Encinitas.

The 34-year-old Winslow was charged with two counts of rape, two counts of kidnapping with intent to commit rape and single counts of forcible sodomy, oral copulation and indecent exposure. He’s free after posting $50,000 bail.

Defense attorney Brian Watkins declined to comment to the Union-Tribune.

Winslow was due to appear in court Thursday after being charged with burglary following an incident last month at a mobile home park. He now faces arraignment Friday.

The son of Hall of Fame tight end Kellen Winslow, the younger Winslow spent 10 seasons in the NFL from 2004-13 with Cleveland, Tampa Bay, New England and the New York Jets. The former University of Miami star had 469 catches for 5,236 yards and 25 touchdowns in 105 games.

Once NFL’s highest-paid tight end, he was suspended in 2013 with the Jets for violating the league’s performance-enhancing drug policy. In November 2013, he was arrested after a woman told police she saw him masturbating in a parked car outside of a New Jersey department store. Winslow was arrested for possession of synthetic marijuana, and the charge was dropped after he completed court-ordered terms.

Drafted No. 6 overall by Cleveland, he broke his right leg in his rookie season, then sustained a serious right knee injury in a motorcycle accident that offseason.

The family of former NFL star Kellen Winslow Jr. is speaking out after his arrest for allegedly kidnapping and raping two older women and targeting others, including an 86-year-old.

Winslow’s wife, Janelle, issued a joint statement with his parents, including father Kellen Winslow Sr., an NFL Hall of Famer.

“On behalf of our son and my husband, we want to reiterate our love, support and affection for him during this difficult process,” the statement reads. “We will always be there for him and we know the true facts will come out.”

Winslow, 34, faced a San Diego Court on Friday and pleaded not guilty to charges of rape, kidnapping and other crimes, according to court records.

According to The San Diego Union-Tribune, Deputy District Attorney Dan Owens claimed that the first alleged victim was a 54-year-old woman who had been hitchhiking when she accepted a ride from Winslow in March. She alleges he “told her if she screamed, he would murder her,” saying he then raped her, Owens said in court.

A 59-year-old woman alleges that after she got in his car in May, Winslow kidnapped, raped and sodomized her, the newspaper reported. He was charged with indecent exposure against a third alleged victim, 55, in May.

The newspaper also reported Winslow is charged with burglary with the intent to rape a 71-year-old woman in June and burglary with the intent to rape an 86-year-old woman that same month.

Winslow was first taken into custody on June 7 after being accused of burglary at a mobile home, according to the Los Angeles Times. He posted $50,000 bond and was released from the Vista, California, jail.

Police then arrested him on the rape charges on Thursday and, following his arraignment Friday, he was denied bail and will stay behind bars. His next court date is June 25.

Winslow is facing a maximum sentence of life in prison, the AP reported.

His attorneys, Brian Watkins and Harvey A. Steinberg, have not responded to PEOPLE’s requests for comment. Winslow agent also has not returned PEOPLE’s calls.

But Steinberg has said, “He would have no need to burglarize or steal anything from anyone at a trailer park,” according to the San Diego Union-Tribune. Steinberg added the former football player “looks forward to being vindicated” in court.

Winslow was arrested and charged with drug possession in 2014 after being accused of having synthetic marijuana. He received a conditional discharge.

Winslow’s father played 10 seasons in the NFL with the San Diego Chargers from 1979 to 1987. Winslow’s Sr. is recognized as one of the greatest tight ends in the league’s history.

Winslow Jr. played college football at the University of Miami, and was later drafted by the Cleveland Browns in 2004 with the sixth overall pick. He also played for the Tampa Bay Buccaneers, the Seattle Seahawks, the New England Patriots and the New York Jets.

A former NFL player has pleaded not guilty to felony charges for allegedly kidnapping, raping or burglarizing several elderly women.

Kellen Winslow Jr., a former tight end for teams including the Cleveland Browns and New York Jets, was arrested Thursday for offenses including allegedly raping two women in his Hummer H2, according to The San Diego Union-Tribune.

He pleaded not guilty on Friday to all charges and was denied bail. He faces life in prison if convicted.

The prosecutor in the case, Deputy District Attorney Dan Owens, said Winslow targeted victims he could exploit.

“These charges themselves are extremely serious, and it is clear to the people that these were committed against the most vulnerable victims in society,” Owen said after the court appearance, according to the Associated Press.

All of the alleged crimes happened in Encitas, California, where Winslow, 34, lives. The first incident happened on March 17, 2018, according to court documents. Winslow allegedly lured a 54-year-old woman into his car and raped her. He was charged with kidnapping, rape and forced oral copulation. He did the same thing, documents said, on May 13 to a 59-year-old woman. He’s charged with kidnap, rape and sodomy in that case. He allegedly told both women he would kill them them if they said anything, according to court documents.

Also in May, he allegedly approached a 55-year-old woman and exposed himself to her.

In two more incidents, Winslow is accused of entering mobile homes with the intention of raping the women inside.

On June 1, he entered the home of a 71-year-old woman, documents said, but left after being confronted. Then, on June 7, he went into the home of an 86-year-old woman but was seen by a neighbor, who called police. He was arrested on charges of burglary.

After his arrest, police kept Winslow under surveillance and said he may have been trying to sell his car to get rid of evidence. They charged him with the rape offenses in the other cases.

“The San Diego Sheriff’s Department, in the investigation of each of these separately reported incidents, did an excellent job tying all the leads together, being able to conduct a thorough investigation, which ultimately led to our ability to charge in this case,” Owens told The San Diego Union-Tribune after the hearing.

Winslow is the son of NFL Hall of Fame great and former Los Angeles Chargers players Kellen Winslow, who released a statement outside the courtroom Friday along with his son’s wife, Janelle Winslow.

“On behalf of our son and my husband, we want to reiterate our love, support and affection for him during this difficult process,” he said. “We will always be there for him and we know the true facts will come out.”

Winslow Jr. was a sixth-round draft pick in 2004. He played 10 seasons in the NFL, with the Cleveland Browns, the Tampa Bay Buccaneers, the New England Patriots and then the Jets.

He was once the highest paid tight-end in the league, after signing a $29 million contract in his rookie year with the Browns, but he was suspended in 2013 by the Jets for violating the performance-enhancing drug policy. In November of that year, he was arrested after a woman told police she saw him masturbating in a car. He was charged with possession of synthetic marijuana, but not exposure. There were two open bottles of vaseline in the center console, according to an arrest report. The charges were later dropped.
